filed an application before the<\/p>\n
replacement of the vehicle””vf.rTom The
\nrespondent directed .t”heA p.e’titi’o.ner:”V.to pro’du”ce the
\ndocuments of replacer vehi-cie’ls’i’molta_neouxs’ly. Aggrieved<\/p>\n
by the said 03rd:-r:_’dated  respondent,<\/p>\n
petitioner’ N’C..,1″22\/’2’U09’V:in the Karnataka State
\nTransport  (.’i<STAT' for short). The<\/p>\n
petitioner had peirmitlkynihi-clh was valid up to 28.22.2009.<\/p>\n
"V'~\u00abC'ons'.i.:Clier\u00a7n:g the fac'ts~~–\u00aba'nd circumstances of the case, the<\/p>\n
 iitsiorder dated 13.3.2009 aliowed the appeal,<\/p>\n
setsVasidei.th'ei.i::impugned order of the respondent and<\/p>\n
"\u00bb,.,_.\u00abpliclyirectedthe respondent to release the existing vehicle<\/p>\n
   No.58\/DK\/99~00, subject to the condition<\/p>\n
 the appellant placing the documents of the replacer<\/p>\n
it   learned HCGP. X<\/p>\n
vehicte within 90 days from release of the existing vehicle<\/p>\n
from the permit. The petitioner could not comply w_'i'th:'_*th'e_<\/p>\n
condition imposed in the said order. Hence,  <\/p>\n
application for extension of time before  .4_'_iie~s._ be<\/p>\n
prayed for 90 days extension of tirne "a <\/p>\n
produce the documents of repia_Vcer_ vehicle and\u00bbv.,tAo'\u00ab:.co–ndone<\/p>\n
the laches on his part. __.The jfribuivnal-\u00bb_,by .i'ts'–o_rde::\u00a7* dated
\n12.8.2009, rejected the   assigned
\nby the Tribunal ytoiirejyectiythe'   a that,\n<\/p>\n
(i)  keep up the
\n ….   Tribunal and<\/p>\n
{ii}, : ‘ Thuatf,-~they’a–p_p’l~ic’ation for extension was not
\n  days time granted by the
\nTnri’bun__a_l_A.,. It also held that, the appiication is<\/p>\n
‘\u00ab..A:,ide_void of merit. Aggrieved by the said<\/p>\n
   this writ petition has been filed.\n<\/p>\n
, 2.”  I have heard learned counsel for the petitioner<\/p>\n

3. Learned counsel for the petitioner submitted
\nthat, if the petitioner is granted 7 days time to produce the<\/p>\n
documents of replacer vehicie before the respondentgahe<\/p>\n
would place the same on or before u<\/p>\n
counsel submitted that, the reasons for not  l<\/p>\n
the order of the Tribunal at AnnexiJre\u00a5i3\u00ab iis”–\u00abion.;4aAcc>oqnt*:Vofl”:<\/p>\n
reasons beyond the control of the 1’pVetitionerA”vandV<\/p>\n
detailed in the writ petition.\n<\/p>\n
4. Learned HC<3i?V_'_subrr\u00a7'itteti 'tn-art, the" petitioner<\/p>\n
has not been operating  and<\/p>\n
has even"sbidiEheggg\u00a7\u00e9\u00a7h:c:ief_'ong3rofS.2oo9 and he has not
\nshown any ubo-na extension of time. Learned<\/p>\n
counsel ..submui'tted=that;- in." the facts and circumstances of<\/p>\n

Whether the Tribunal has considered the
\napplication of the petitioner for extension of<\/p>\n
time in the proper perspective?\n<\/p>\n
6. The appeal of the petitioner was allowedjbyf”t.he.,,<\/p>\n
tribunal on 13.3.2009. 90 days time was  ‘<\/p>\n
which expired on 12.6.2009. The application in<\/p>\n
was no doubt filed after about   <\/p>\n
originally granted. For thei–I:apse oh.__the_: “the
\nappellant\/petitioner, he,-_had  the”exp.lanation.<\/p>\n
Without even considering”‘th\u00e9i’\u00bbV;.vca’uise.,::shown in the<\/p>\n

\napplication is  has accordingly rejected<\/p>\n
the application.” wV|f..en~-._the”Tribunal has not even adverted<\/p>\n

 o.peVtitiofner does not compiy with the condition i.e., produce<\/p>\n
 documents of the replacer vehicle, he shall not be<\/p>\n
