Application<br \/>\n\tNo.15637\/2010.\n<\/p>\n<p>\tThe<br \/>\n\tapplicants-accused are charged with having committed offences<br \/>\n\tunder Sections 302, 307, 323, 324, 427, 120(B), 34, 143, 147, 148<br \/>\n\tand 149 of the Indian Penal Code and under Sections 37(1) and 135 of<br \/>\n\tthe Bombay Police Act, for which, FIR being I-C.R.No.89\/2010 has<br \/>\n\tbeen lodged at Jetpur City Police Station, District : Rajkot<br \/>\n\t(Rural).\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel, Mr.Chhaya for the applicants at the outset does not press<br \/>\n\tthis application qua applicant-accused no.1 viz., Rajubhai Madhabhai<br \/>\n\tVegda. Therefore, the present application is confined to applicant<br \/>\n\tno.2 viz., Manishbhai Madhabhai Vegda. Learned counsel, Mr.Chhaya<br \/>\n\tsubmitted that considering the role attributed and the weapon with<br \/>\n\twhich the applicant no.2 is said to have been armed with and also<br \/>\n\tconsidering the fact that other co-accused have been released, the<br \/>\n\tpresent application may be allowed. For which, he has referred to<br \/>\n\tthe orders passed in other matter also.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Jani resisted the present application. He submitted that<br \/>\n\tsome of the co-accused have been released as the facts were not<br \/>\n\tclearly stated before the Sessions Court.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel appearing for the applicants-accused and<br \/>\n\tlearned A.P.P. for the State and having considered the nature of<br \/>\n\toffence, role attributed to the applicant no.2 and the fact that he<br \/>\n\tis alleged to have been armed with hockey where the other co-accused<br \/>\n\thaving similar weapon or role have been released, the present<br \/>\n\tapplication deserves to be allowed qua the applicant no.2.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed partly. The applicant no.2 viz.,<br \/>\n\tManishbhai Madhabhai Vegda is ordered to be released on regular bail<br \/>\n\tin connection with I-C.R.No.89\/2010 registered with Jetpur City<br \/>\n\tPolice Station, District : Rajkot (Rural) on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM for a period of six<br \/>\nmonths.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute qua the applicant no.2 viz., Manieshbhai Madhabhai<br \/>\n\tVegda. Rule is discharged qua applicant no.1 viz., Rajubhai<br \/>\n\tMadhabhai Vegda.
