Conimissiotifer,Vjfumkur, is challenged in this writ petition. By<\/p>\n
‘V the   the Deputy Commissioner, exercising his powers<\/p>\n
 “‘,.’utider_.&Section 136(3) read with Section 67(2) of the Karnataka<\/p>\n
 Revenue Act, 1964 (for short, ‘the Act’), has held that the<\/p>\n
‘ ing land in Sy.No.272 measuring 2 acres shall be treated<\/p>\n
– 3 Dl\ufb02ld
\nas Government land and the name of the Government shall be
\nentered in Column Nos.9 and 12(2) of the RTC.<\/p>\n
2. The claim of the petitioner is that the property.._hearing<\/p>\n
Sy.No.272 is her ancestral property and she is the-gahsblute<\/p>\n
owner of the property having inherited the <\/p>\n
grandfather late Thimmegowda. According to the titi’on_er,  . <\/p>\n
grandfather Thimrnegowda acquired hearing <\/p>\n
measuring 3 acres 12 guntas  public auction.’l..’1’o\u00a7._evid.ence the<\/p>\n
same, reliance is placed on Column ‘No.9 of the  where
\nname of Thimmegowda is rnentioned”‘nVotigng,, the interest of the<\/p>\n
villagers as well.  Reliance. is Valso ” on the RR entry<\/p>\n

3. The dispugeplliarosell  some of the Villagers moved the
\n  {3:ommissAioI1er…stating that the land in question is a
\nV’7,Gox}e1\u00b0=nn1ent:land–.used by the villagers and the same shall be<\/p>\n
 purpose of construction of a hospital. The<\/p>\n
‘.Deputy..Corrimissioner has initiated proceedings under Section<\/p>\n
it V’ “..j1.3A6{3},_read with Section 67(2) of the Act and has conducted an<\/p>\n
 After giving an opportunity to both the parties, he has<\/p>\n
 .  ‘lg;\/.,VV4V%rded a \ufb01nding holding that the land in question was used<\/p>\n

\nfor public purpose. In the RTC, in Column No.12 (2), it was
\nmentioned as ‘Gramastara Hullu Koppa’ meaning ‘area meant<\/p>\n
for hay stock’. He has also referred to the fact that of<\/p>\n
the land out of 3 acres 12 guntas was demandedby <\/p>\n
for construction to establish a hospita.l_andlvillagers’ . <\/p>\n
had no objection for the sarneg 1’_”I<'urther;"  :l_3Z)e1f,i,ity<\/p>\n
Commissioner has also referred__t"e._the fact 'that"the._us.ufructs 'of'<\/p>\n
the tamarind trees grown in the__said__1and vve1*e.:auct:loned every
\nyear and the amount"…r'ec_eivecl'  used for the
\ndevelopment of th.& tem\ufb01les.   Based on these
\nmaterials,   that as the land
\nin question   individual and was
\nmeant   no impediment for treating it as
\na Government    available for the purpose of<\/p>\n
putting' up construction to establish a hospital.<\/p>\n
   contention of the learned counsel for the<\/p>\n
Ap'eti'done1'vl4lisp:  the proceedings initiated by the Deputy<\/p>\n
V _ Comrnissi_'onei–l"' are without authority of law as the same is<\/p>\n
 initiated "after a lapse of nearly 50 years from the date the<\/p>\n
 ,en.t'1'ies"l were found in the name of the grandfather of the<\/p>\n
 netltioner and that the Deputy Commissioner had no right to<\/p>\n

\npurpose to construct a hospital. Referring to RR755, based on
\nwhich the entries are effected, counsel for the petitioner submits<\/p>\n
that without finding out the nature of the right<\/p>\n
under RR755, the Deputy Commissioner could net <\/p>\n
the impugned order. He has placed, rel.ianceon’  . <\/p>\n

5. Learned. “Additional._C\u00a7overnn1ent Advocate has strongly<\/p>\n
supported the  the Depuw Commissioner, so<\/p>\n
also the counse1’va.ppeari.ng\u00ab .fpr respondents 4 to 8.<\/p>\n
  iDn_._co:isideratisn\u00ab’of the entire materials on record, prima<\/p>\n
“\u00bb.rac.ie”, =1  -the revenue record produced by the petitioner<\/p>\n
collectively  Annexure~\u00bbB series that the name of<\/p>\n
‘,Thimmego’-.2_vda under whom the petitioner claims is not entered<\/p>\n
it ha.\u00bb-siigolwner of the property exclusively. Column No.9 of the RTC<\/p>\n
’ementions the name of Thimmewowda and as aiso the Villagers<\/p>\n

\ndepicting the particulars of the actual cultivators right from the
\nyear 1984-85 it is shown as ‘Gramastara Hullu Koppa’ meaning
\n‘area meant for hay stock of the villagers’. In the absence of any<\/p>\n
material produced by the petitioner to show the e2<.cla,is\u00abi.ife.Vvtitle<\/p>\n
and ownership of Thimmegowda over the propertiyllirIl\u00ab'ques\u00bbtiong<\/p>\n
and in the light of the findingsMregcorded'"by'_" <\/p>\n
Commissioner, this Court in exercise :_'0f.g"\u00a3h\u20ac*,W1'i't' juri'sdii:1i;ion<\/p>\n
cannot record a finding regarding the entitl'en1ent_.3of the<\/p>\n
petitioner.\n<\/p>\n
7. Counsel for the pe\u00a31t:\u00a2n\u00e91=.,i1as  the fact that<\/p>\n
the proceedings Could  by the Deputy<\/p>\n
Commissioner;lafteriifi-such~.long  of time for a direction to
\nenter the ‘named ‘of~.gthef’–C}g:vernment deleting the private<\/p>\n
individuals’ name.’ <\/p>\n
  . .\u00ab.XsE”‘alre’ady referred to above, the records do not disclose<\/p>\n
‘the   of Thimmegowda in the property. The RTC<\/p>\n
._  extracts  the interest of Thimmegowda along With all the<\/p>\n
lR””‘\u00ab._hvillagers ‘v…meaning thereby prima facie the property was<\/p>\n
A  earmarked for public use of the villagers. Based on the same, at<\/p>\n
  the request of some of the villagers, the Deputy Commissioner<\/p>\n
\u00abhas found it just and reasonable to delete the name of<\/p>\n

\nThirnmegowda and of the villagers and to insert the name of the
\nGovernment. This action has been initiated in the background
\nof the request made by the villagers to make use of the property<\/p>\n
for the purpose of constructing a hospital which <\/p>\n
cater to the needs of the entire villagers. Thereforelll <\/p>\n
application of the principle enunciated in.’the-aforesaid  <\/p>\n
decisions will not arise in the facts’,an+;l-circumstance:\u00a7\u00bb.ofi~i\u00e9this<\/p>\n
case. If at all the petitioner intends tux lay,heruclyaimmoverthe’<\/p>\n
property as one absolutely  to her,   is open to
\nher to approach the  herright. In fact,
\nshe has \ufb01led a suit in  pending on the
\nfile of the   v–\u00abw’herein the relief of<\/p>\n
declarat;i,on_ ofVtitle._  ‘svoug t in respect of the very land.<\/p>\n
Petitionerhas  consequential relief of permanent<\/p>\n
in_}’unQ,~;1011, In su_chV1 circumstances, it is appropriate that the<\/p>\n
   thewpetitioner before the Civil Court has to be<\/p>\n
 passed by the Deputy Commissioner, it is<\/p>\n
needless to’oVb’serve, will be subject to the result of the civil suit.<\/p>\n
 rightlyfcontended by the learned Additional Government<\/p>\n
A  :yil:iv”acaA:~te even as per Section 67(2) of the Act, if any person is<\/p>\n
 “”.:,agglieved by such an order passed under Section 67, the<\/p>\n
  lies before the Civil Court to file a civil suit. Petitioner<\/p>\n
\\l\ufb02Jll 8 ._
\nhas rightly availed such a remedy though before passing the
\norder by the Deputy Commissioner. In the light of the same<\/p>\n
without prejudice to the right of the petitioner to and<\/p>\n
prosecute the said suit and keeping open all _t’ii–e <\/p>\n
raised, this writ petition is dismissed;\n<\/p>\n
