The writ petition and<br \/>\nthe appeal are being finally decided under this<br \/>\norder.\n<\/p>\n<p>Brij Ratan Sunder Arya Kanya Inter College is an<br \/>\ninstitution recognized under the Uttar Pradesh<br \/>\nIntermediate Education Act. The said institution has<br \/>\nbeen established by Arya Pratinidhi Sabha Uttar<br \/>\nPradesh (parent body). The elections of committee<br \/>\nof management of the institution are held in<br \/>\naccordance with the approved scheme of<br \/>\nadministration which in turn refers to nomination of<br \/>\nfive members under Clause 5 Sub-Clause IV, V and<br \/>\nVI from local Arya Samaj as well as Arya<br \/>\nPratinidhi Sabha, Uttar Pradesh. The writ petition<br \/>\nwas filed by the erstwhile committee of<br \/>\nmanagement of the Inter Mediate College in power<br \/>\nof the institution challenging the order dated<br \/>\n22.04.2010 passed by Arya Pratinidhi Sabha<br \/>\nconstituting a five member committee for holding<br \/>\n the elections of committee of management of the<br \/>\nsociety. The order was challenged on the ground<br \/>\nthat Arya Pratinidhi Sabha has no right to interfere<br \/>\nin the elections of committee of management if the<br \/>\nrecognized Inter Mediate College as it elections are<br \/>\nto be held in accordance with the Scheme of<br \/>\nAdministration. Reference is also made to a<br \/>\njudgment of the writ Court dated 25th May, 2006<br \/>\npassed in writ petition no. 47738 of 2005 wherein it<br \/>\nhas been held that under the provisions of the Inter<br \/>\nMediate Education Act the Arya Pratinidhi Sabha<br \/>\nhas no power to appoint interim committee for a<br \/>\nrecognized Inter Mediate College. With reference to<br \/>\nthe said judgment it is contended that the order<br \/>\ndated 22.04.2010 constituting a committee for<br \/>\nholding elections of the Inter Mediate College is<br \/>\nwithout authority of law. The Hon&#8217;ble Single Judge<br \/>\nhas been pleased to entertain the writ petition and<br \/>\nthe order of Arya Pratinidhi Sabha, Uttar Pradesh<br \/>\ndated 22.04.2010.\n<\/p>\n<p>By means of present special appeal the order of<br \/>\nHon&#8217;ble Single Judge is being challenged. It has<br \/>\nbeen contended on behalf of respondents that the<br \/>\nwrit petition itself was legally not maintainable in<br \/>\nas much as Arya Pratinidhi Sabha is a private<br \/>\nsociety its order cannot be directly challenged<br \/>\nbefore this Court under Article 226 of the<br \/>\nConstitution of India. It is clarified that in writ<br \/>\npetition no. 47738 of 2005 the High Court had<br \/>\nintervened because the interim committee<br \/>\nconstituted by the Arya Pratinidhi Sabha had been<br \/>\naccepted by the Education Authorities to be lawful<br \/>\nmanagement of the institution and it was because of<br \/>\nthe State action which was found to be illegal that<br \/>\nwrit Court interfered. He submits that the facts of<br \/>\n the said case are clearly distinguishable.<br \/>\nWe examined the record. From the records of writ<br \/>\nno. 29753 of 2010 we find that the State Authorities<br \/>\nnamely D.I.O.S.\/ Joint Director of Education have<br \/>\nnot accepted the constitution of five member<br \/>\ncommittee for holding election nor they have<br \/>\nintervened in the matter with reference to the said<br \/>\norder of the Arya Pratinidhi Sabha till date.<br \/>\nTherefore, the order dated 22.04.2010 continuance<br \/>\nto be an order of a private body which cannot be<br \/>\nsubject matter for consideration under article 226 of<br \/>\nthe Constitution of India, in as much as it has not<br \/>\nbeen passed with reference to any statutory<br \/>\nprovisions. It is needless to clarify that the Scheme<br \/>\nof Administration of an Inter Mediate College<br \/>\ncannot be enforced under Article 226 of the<br \/>\nConstitution of India. Consequently, infraction of<br \/>\nScheme of Administration cannot be the basis for<br \/>\nfiling the writ petition.\n<\/p>\n<p>At this stage of the proceeding sri Prabhakar<br \/>\nAwasthi, learned counsel for the petitioner in writ<br \/>\npetition no. 29753 of 2010 fairly conceded that the<br \/>\nwrit petition itself may be disposed of by hold that<br \/>\nthe petition at this stage is not maintainable. Subject<br \/>\nhowever, to be candidates that in the case the State<br \/>\nauthorities namely D.I.O.S.\/Joint Director of<br \/>\nEducation etc. act upon the order of the Arya<br \/>\nPratinidhi Sabha dated 22.04.2010. It would be<br \/>\nopen to the petitioner to challenge such action of<br \/>\nthe State Authority as well as the order dated<br \/>\n22.04.2010.\n<\/p>\n<p>In view of the stand taken we feel that the writ<br \/>\npetition as well as special appeal be disposed of at<br \/>\nthis stage by providing that the writ petition no.<br \/>\n 29753 of 2010 is not maintainable as on date and<br \/>\nstands dismissed accordingly. However, this order<br \/>\nwill not be prejudiced the rights of the petitioner to<br \/>\nchallenge the order if any, to be passed by the State<br \/>\nauthorities.
