This is a claimants’ appeal directed <\/p>\n
impugned judgment and award dated   <\/p>\n
in MVC No.2\/2005 on the file of the “c*ii;;1″iJu;c1a<\u00a7\u00a2r (sf.Din)hiia  <\/p>\n
JMFC, Add}. MACT, Hunsu:r,_ [heireinaiter ireferredii <\/p>\n
'Tribunal' for brevity].\n<\/p>\n
2. The Tribun\u00e9aiiihibir i\u00e9jv\ufb01\ufb01g\ufb01i\ufb01nt and award,
\nawarded a  of ‘deducting 40%
\ntowards    the part of the
\ndeceasech”‘viifiih’infe1*est.Vgat’E\u00a7%’~~p,.ai as against the claim of
\nthe claimants — on account of the death<\/p>\n
of the deceased late AS1_r\u00bbi.”~\u00a5.;*iarisha, in a road traffic accident.<\/p>\n

 i__aiwjarded._gVE)5}’i’ Tribunal is inadequate and hence, it is<\/p>\n
required.  enhanced by modifying the judgment and<\/p>\n

 3. The brief facts of the case are:\n<\/p>\n

The appellants No.1 and 2 N\u00bb claimants are the wife<\/p>\n
and minor child and appellant No.3 is the m0th.er_l:’0t’the<\/p>\n
deceased. They have filed a claim petitidri  <\/p>\n
compensation against the respondents on’ acce:i;xnt’ 04_f;th.e it<\/p>\n
death of the deceased <\/p>\n
deceased was working as a dri\\_fer_0f gbods.temp~Q”a1idl was”<\/p>\n
earning more than Rs.-31.000′,\/-<* lvmenthllas. salary and
\nRs. 100\/\u00bb per day as   bread earner
\nin the family},  thielll "depended on his

rash and negligent manner with high speed dashed<\/p>\n

6. We have gone’ through the grounds urged in<\/p>\n
the memorandum of appeal and heard the_4vv,iearned<\/p>\n
Counsel appearing for the respondents  <\/p>\n
considerabie length of time.\n<\/p>\n

respondents No. 2 and 3,  outset. that,

 of the oral and documentary evidence has<\/p>\n
  \ufb01xed the contributory negiigence of 40% on the<\/p>\n
part of the deceased. Hence, we uphold the same.<\/p>\n

However, the Tribunal has committed error in taking the
\nnet income of the deceased at the rate of Rs.3,000\/– per
\nmonth. It is inadequate. Hence, it needs reassessment.<\/p>\n
Deceased was a young and energetic driver, drivingiiis<\/p>\n
Tempo. He was aged about 25 years. ffiie <\/p>\n
occurred in the year 2004. We cansafegly assestsi, inco_i:r1e’i’of it ‘<\/p>\n
the deceased at Rs.4,000\/– per  <\/p>\n

10. The Tribunal has failed to award any
\ncompensation towards loss of estate. We deem it \ufb01t to<\/p>\n
award \u00a30,000\/- under this head.\n<\/p>\n
11. The Tribunal has erred in  <\/p>\n
towards loss of love and a\ufb01”ec.tion. “l’he_’v.sari1e __is” <\/p>\n
inadequate. The appellants are the  minor” <\/p>\n
mother of the deceased. V\u00a7l’3:l’\ufb025_’VarC1″ <\/p>\n
loss of love and affection to.–each'”-.appe1lan.t. J\u00a7The total<\/p>\n
compensation towards loss of_V1lor’e affection comes to<\/p>\n
Rs.15,000\/-. he <\/p>\n
   awarded compensation of<\/p>\n

14. The appellants are entitled to a total
\ncompensation of Rs.6,2I,072\/\u00bb\u00ab as against Rs.-$08,000\/–
\nawarded by the Tribunal. Out of this, 40% is deducted<\/p>\n
towards contributory negligence on the part iofrapthe<\/p>\n
deceased. The net total compensation ‘to<\/p>\n
Rs.3,72,6-43\/–.\n<\/p>\n
