\n\tAdvocate Mr.YF Mehta is appearing for opponent Food Corporation of
\n\tIndia. This Court has passed following order in Special Civil
\n\tApplication NO. 327 of 1991 on 10th May, 2010:\n<\/p>\n
 \tHeard
\n\tlearned Advocate Mr. Avinash K.Mankad for petitioner, learned
\n\tAdvocate Mr. YF Mehta for respondent No.1-2, learned Advocate on
\n\tbehalf of M\/s. Thakkar Associate for respondent NO.2 and learned AGP
\n\tMs. Vandana Bhatt for respondent NO.4.\n<\/p>\n
\tLearned
\n\tAdvocate Mr. Mankad submitted that in this matter, by passage of
\n\ttime, number of subsequent  incident has taken place in petitioner
\n\tsociety, therefore, he submitted that this petition has become
\n\tinfructuous by passage of time. Accordingly, considering  his
\n\tstatement, by passage of time and due to subsequent development,
\n\tpresent petition has become infructuous and accordingly this
\n\tpetition is disposed of as having become infructuous. Rule is
\n\tdischarged. Interim relief if any shall stand vacated with no order
\n\tas to costs. However, in case of any difficulty, it is open for
\n\tpetitioner to file appropriate application.\n<\/p>\n
Applicant
\n\thas made following averments in para 2 of this application:\n<\/p>\n
 2.\tApplicant
\n\tsays and submits that present application is filed to recall the
\n\torder dated 10.5.2007 passed in Special Civil Application No.327 of
\n\t1991 and to restore the Special Civil Application No. 327 of 1991 to
\n\tits original file. It is humbly submitted that petitioner is a
\n\tregistered Labour Cooperative Society formed as per the directives
\n\tof Food Corporation of India. It is humbly submitted that petitioner
\n\tsociety was engaged in doing Handling and Transport work for
\n\trespondent NO.1. It is humbly submitted that petition was filed to
\n\tget the various statutory benefits and hence it would have bearing
\n\ton all the members of the petitioner society. It is humbly submitted
\n\tthat petitioner society is still functioning and still it is having
\n\twork with the respondent corporation. In view of this cause of the
\n\tpetition would survive. Hence petition is required to be decided on
\n\tits own merits and it is
\n\tnot infructuous petition. Same is required to
\n\tbe heard on merits and decided on merits. Considering all this
\n\taspect order dated 10.5.2010 may kindly be recalled and Special
\n\tCivil Application NO. 327 of 1991 may be restored to its own file
\n\tand may be heard on merits.\n<\/p>\n
In
\n\tview of above abverments made by applicant in para 2 of application,
\n\taccording to applicant, cause of action is surviving and, therefore,
\n\tpresent application is preferred by applicant with a prayer to
\n\trecall order of this court dated 10.5.2010.\n<\/p>\n
In
\n\tSpecial Civil Application No. 327 of 1991, petitioner Mandali has
\n\tchallenged notification dated 1st November, 1990 Annexure
\n\tD issued by Central Government. Affidavit in reply is filed by one
\n\tMr. KKR Nair, Dy. Manager (Admn) Food Corporation of India dated
\n\t12th March, 1991. Para 11 thereof is quoted as under:\n<\/p>\n
 11.\tWith
\n\treference to para 10 of the petition, I respectfully say and submit
\n\tthat since the petitioner is a Labour Cooperative Society working
\n\tthrough its members and not a Contractor hiring contract labour the
\n\tnotification of the Government of India which prohibits contract
\n\tlabour is not applicable. I respectfully say and submit that the
\n\tpetitioner society is not working in violation or the FCI are not
\n\tworking in violation of the Notification issued by the Central
\n\tGovernment which only prohibits the contract labour.\n<\/p>\n
I
\n\t\trespectfully say and submit that the workers working at the Baroda
\n\t\tDepot are not the employees of any Contractor but they are doing
\n\t\tthe work in their own capacity as members of the Society which is
\n\t\tawarded the handling and transport contract. Here the Society is
\n\t\tthe Contractor and the work is being executed through the members
\n\t\tof the Society who are beneficiaries of the Society and not the
\n\t\tworkers or employees of the Society. Each of the member of the
\n\t\tSociety is, therefore, the owner to the extent of his share in the
\n\t\tSociety. Each member of the Society has a proprietory interest in
\n\t\tthe profit of the Society and does not work as an employee or
\n\t\tlabourer under the Contractor.\n<\/p>\n
\tI
\n\t\trespectfully say and submit that the status of a worker working
\n\t\tunder the Contractor is totally different from that of a member of
\n\t\tthe Cooperative Society.I respectfully say and submit that the
\n\t\tworker is engaged by the Contractor by paying him the wages whereas
\n\t\tthe worker is a member of the Society has a proprietory interest in
\n\t\tthe earning and profit of the Society and gets his share in the
\n\t\tprofit of the Society as his own right.\n<\/p>\n
Thus,
\n\tas per aforesaid averments made by deponent in affidavit in reply
\n\tfiled on behalf of Food Corporation of India, it is made clear that
\n\tnotification dated 1st November, 1990 is not applicable
\n\tto present applicant Mandali because it prohibits only Contractor
\n\tLabour and applicant Mandali is a Labour Cooperative Society working
\n\tthrough its members and not contractor hiring contract labour.
\n\tTherefore, in view of the aforesaid averments made in affidavit in
\n\treply as referred above filed by officer of respondent corporation,
\n\tcause of action for petition does not survive. Therefore,   order of
\n\tthis court dated 10th May, 2010 is not required to be
\n\trecalled because matter has been disposed of by this court on the
\n\tbasis of statement made by learned Advocate Mr. Avinash Mankad for
\n\tpetitioner that by passage of time, petition has become infructuous.
\n\tAccordingly, this Miscellaneous Civil Application is disposed of.\n<\/p>\n
