No.28911\/2008-P\n                    ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n                   Dated this the 14th day of July, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>      The petitioners claim to be working as Sanitary Workers in<\/p>\n<p>Punalur Municipality for the last four years. According to them, the<\/p>\n<p>available Sanitary Workers are much less than the personnel<\/p>\n<p>required for the purpose. Petitioners claim to be fairly experienced in<\/p>\n<p>the work and they claim to be sincere in their work. But now they are<\/p>\n<p>threatened    with   disengagement        for accommodating      persons<\/p>\n<p>recruited through Employment Exchange.             It is in the above<\/p>\n<p>circumstances, the petitioners have filed the writ petition seeking the<\/p>\n<p>following reliefs:-\n<\/p>\n<blockquote><p>      i.    Issue a writ of mandamus or other appropriate writ order<br \/>\n            or direction directing the respondents to continue with<br \/>\n            the service of the petitioners.\n<\/p><\/blockquote>\n<blockquote><p>      ii.   Such other reliefs which this Court deems fit and<br \/>\n            necessary in the circumstances of the case and the<br \/>\n            costs of this case.<\/p><\/blockquote>\n<p>      2.    I have heard the counsel for the petitioner and the<\/p>\n<p>counsel for the respondents.\n<\/p>\n<p>      3.    Admittedly, the petitioners have not undergone any<\/p>\n<p>selection process while being engaged as Sanitary Workers in the<\/p>\n<p>W.P.(C). No.28911\/2008<br \/>\n<span class=\"hidden_text\">                                   -:2:-<\/span><\/p>\n<p>Punalur Municipality. As such, they have no right to continue to be<\/p>\n<p>engaged as a matter of right either provisionally or regularly. In fact,<\/p>\n<p>their continuance itself is a violation of the fundamental rights of<\/p>\n<p>many others who are also equally eligible to be considered for<\/p>\n<p>appointment to the said posts. That being so, it is the duty of the<\/p>\n<p>respondents to make regular selection of Sanitary Workers as<\/p>\n<p>expeditiously as possible, after conducting selection in accordance<\/p>\n<p>with the accepted procedure for the same. It would be open to the<\/p>\n<p>petitioners also to apply pursuant to the same. However, I do not<\/p>\n<p>think that the petitioners can as of now claim to continue to be<\/p>\n<p>engaged as Sanitary Workers as before.
