SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/05\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tPresent<br \/>\nCivil Revision Application under section 115 of the Code of Civil<br \/>\nProcedure has been preferred by the applicant   original respondent<br \/>\nno.1 to quash and set aside impugned order dated 06.09.2001 passed by<br \/>\nthe learned Joint District Judge, Bhavnagar in application below<br \/>\nExh.19 and 30 in Regular Civil Appeal No.70 of 1997.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe outset it is required to be noted that present Civil Revision<br \/>\nApplication arises out of interlocutory \/ interim order passed by the<br \/>\nlearned Joint District Judge, Bhavnagar passed below Exh.19 and 30 in<br \/>\nRegular Civil Appeal No.70 of 1997 issuing certain directions to the<br \/>\napplicant during pendency of Regular Civil Appeal No.70 of 1997.<br \/>\nWhile admitting present Revision Application learned Single Judge has<br \/>\npassed the order directing to maintain status   quo as on<br \/>\n18.10.2001 which has been continued till date. It is reported that<br \/>\nRegular Civil Appeal No.70 of 1997 is still pending for final<br \/>\ndisposal.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of above, present Revision Application can be disposed of by<br \/>\ndirecting learned Appellate Court to decide and dispose of Regular<br \/>\nCivil Appeal No.70 of 1997 at the earliest and within stipulated time<br \/>\nand until then parties be directed to maintain status-quo.  Even<br \/>\notherwise considering directions issued by the learned Appellate<br \/>\nCourt, Bhavnagar below Exh.19 and 30 in  Regular Civil Appeal No.70<br \/>\nof 1997 which has been issued during pendency of appeal, impugned<br \/>\norder cannot be sustained as by issuing such directions, learned<br \/>\nAppellate Court has virtually allowed the appeal.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of above and for the reasons stated above, present Civil<br \/>\nRevision Application is disposed of by directing learned Appellate<br \/>\nCourt i.e. Principal District Judge, Bhavnagar to decide and dispose<br \/>\nof Regular Civil Appeal No.70 of 1997 in accordance with law at the<br \/>\nearliest but not later than 31st December, 2010 and until<br \/>\nthen interim order passed by this Court directing parties to maintain<br \/>\nstatus-quo as on 18.10.2001 is directed to be continued without<br \/>\nprejudice to rights and contentions of respective parties. Learned<br \/>\nPrincipal District Judge, Bhavnagar is hereby directed to see that<br \/>\naforesaid Regular Civil Appeal which is of the year 1997 is decided<br \/>\nand disposed of at the earliest and within stipulated time as stated<br \/>\nabove without fail. All concerned are directed to cooperate learned<br \/>\nAppellate Court in early disposal of Regular Civil Appeal.
