Vijayakumar, learned Special Government Pleader takes notice on<br \/>\nbehalf of the respondents.\n<\/p>\n<p>\t2. Heard the learned counsel appearing for the petitioner and the learned<br \/>\nSpecial Government Pleader, appearing for the respondents. By consent of both<br \/>\nthe counsel, the writ petition itself is taken up for final hearing.\n<\/p>\n<p>\t3. This writ petition is filed for a direction against the respondents to<br \/>\nemploy the petitioner as per the appointment order issued by the first<br \/>\nrespondent. The order of appointment dated 27-02-2006 issued by the first<br \/>\nrespondent shows that the petitioner was appointed as a  temporary driver on<br \/>\ndaily wages basis.  However, the appointment order dated 27-02-2006 directs that<br \/>\nthe petitioner  should join duty in the Government Transport Department office,<br \/>\nTirunelveli on or before 10-03-2006.  The case of the petitioner is that even<br \/>\nthough the petitioner was directed to join duty on or before 10-03-2006 based on<br \/>\nsaid appointment order for the past three days he went to the office at<br \/>\nTirunelveli but he was not allowed to join duty on the basis that the model code<br \/>\nof conduct issued by the Election Commission prevents such order. In these<br \/>\ncircumstances, the petitioner has filed the writ petition.\n<\/p>\n<p>\t4.When the matter came up for hearing on 09-03-2006, this Court directed<br \/>\nthe Special Govoernment Pleader to take notice and find out the reason for not<br \/>\nallowing of the petitioner to join duty.\n<\/p>\n<p>\t5.The learned Special Government  pleader presents the letter of the Chief<br \/>\nElectoral Officer dated 03-03-2006 addressed to the Secretary, Government<br \/>\nTransport Department in which the Chief Electroal Officer has stated that as per<br \/>\nthe Model Code of Conduct the Election Commission has directed that even in<br \/>\ncases where appointment orders have been issued, the State Transport<br \/>\nUndertakings may be instructed that  the candidates should not be allowed to<br \/>\njoin duty before the completion of the process of elections.<br \/>\nTherefore,according to the learned Special Government Pleader, the only reason<br \/>\nfor preventing the petitioner from joining duty is the direction given by the<br \/>\nElection Commission.\n<\/p>\n<p>\t\t6. In view of the same, recording the satement it is made clear that<br \/>\nthe petitioner should be allowed to take up the appointment after the election<br \/>\nis over.\n<\/p>\n<p>\t  \t7. With the above direction, the writ petition is disposed of. There<br \/>\nis no order as to costs.
