JUSTICE GOPAL KRISHAN VYAS\n\n\nMr.Narendra Singh, for the appellant.\nMr.S.G. Ojha               ]\nMr.Sanjay Nahar on behal of]\nMr.P.K. Bhansali           ] for the respondents.\n\n\n\n\n              The application filed under Order 22 Rule\n3     read    with    Section    151          CPC,     so       also,   the\napplication        under    Order        22     Rule        9    alongwith\nSection 5 of the Limitation Act are allowed for\nthe reasons mentioned in the applications.                              The\namended cause title is hereby taken on record.\n\n\n\n              Heard learned counsel for the parties and\nperused the impugned order dated 07th April, 1997.\n\n              The learned trial court vide its order\ndated 07th April, 1997 dismissed the application of\nthe appellant filed under Order 39 Rule 1 and 3\nalongwith Section 94 read with Section 151 CPC.\n\n\n\n              In this appeal on 21st May, 1998 while\npassing       following     order        stay        application        was\n                               !! 2    !!\ndisposed of:-\n\n                    \"The basic objection of learned\n               counsel for the appellant is that\n               respondent-R.F.C. before putting the\n               property to auction, has not got the\n               property valued and in view of the\n               judgment in the case of Mahesh\n               Chandra the property was required to\n               be valued.    Learned counsel for the\n               appellant submits that property is\n               valued to the tune of Rs.50 lacs.\n               The figure appears to be highly\n               inflated.     However, the figure if\n               reduced    by    30    lacs     and    an\n               opportunity     is    given    to     the\n               appellant     that    he    may     bring\n               purchaser for Rs.30 lacs, then the\n               appellant will make an application\n               in this regard.       Counsel for the\n               R.F.C. has no objection if this\n               opportunity    is    granted    to    the\n               appellant. The appellant to make an\n               endeavour that property at the price\n               of Rs.30 lacs may be sold.            One\n               month's time is granted to make an\n               effort to get the property sold at\n               the above price by 20th June, 1998.\n               He must take all necessary steps in\n               this    regard     and     submit     the\n               purchasers and purchase money to\n               R.F.C. as required by R.F.C.           In\n               case, the appellant fails to bring\n               any purchaser then respondent-R.F.C.\n               will be at liberty to deal with the\n               property in any manner as it deems\n               fit and proper.          It will also\n               consider if any other proposal put\n               forward by the appellant.\n                    With these observations,               the\n               stay petition is disposed of.\"\n\n\n               The above order is hereby made absolute\nand this appeal is disposed of with the direction\nto   the   trial      court   to     decide   the   suit    itself\nwithin     a    period   of   six    months   because      suit   is\n                                    !! 3   !!\n           pending since 1997 and this appeal is also pending\n           since 1997.
