DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\nis the third round of litigation filed under Article 226 of the<br \/>\nConstitution of India seeking compassionate appointment by the<br \/>\npetitioner, aged about 37 years on the ground that father of the<br \/>\npetitioner, who was working with the respondent died in harness on<br \/>\n10.09.1995. The application dated 13.10.1995 preferred by the<br \/>\npetitioner came to be rejected by an order dated 21.04.1999.  Special<br \/>\nCivil Application No.14178 of 2007 filed by the petitioner against<br \/>\nthe said decision, came to be disposed of by this Court [Coram :<br \/>\nHon&#8217;ble Mr. Justice H.K.Rathod] [as His Lordship then was]  with<br \/>\ndirections to consider representation of th petitioner in accordance<br \/>\nwith law.\n<\/p>\n<p>2.\tThereafter,<br \/>\nonce again the petitioner approached this Court by filing Special<br \/>\nCivil Application No.22904 of 2007, which was heard and dismissed by<br \/>\nthis Court [Coram : Hon&#8217;ble Mr. Justice K.S.Jhaveri] by order dated<br \/>\n27.01.2009.  This is the third round of litigation with similar<br \/>\nprayers and in addition to above the petitioner has not disclosed the<br \/>\nfact of filing second writ petition being Special Civil Application<br \/>\nNo.22904 of 2007 which came to be rejected on 27.01.2009.  Therefore,<br \/>\nthis petition is not only barred by res judicata but also hit<br \/>\nby suppression of material facts for which ordinarily this Court<br \/>\nwould have imposed heavy costs.  However, considering the fact the<br \/>\npetitioner is seeking compassionate appointment, this Court refrains<br \/>\nfrom imposing impose any costs.\n<\/p>\n<p>\tAccordingly,<br \/>\nthis petition stands dismissed.\n<\/p>\n<p>\tNotice<br \/>\ndischarged.\n<\/p>\n<p>[Anant<br \/>\nS.
