Justice P.K.BALASUBRAMANYAN\n\n Dated :27\/01\/2010\n\n O R D E R\n             Kurian Joseph, Ag.C.J.\n\n                         &amp;\n\n          Thottathil B.Radhakrishnan, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n    W.A.1790 of 2009 &amp; W.P.(C).24240 of 2009-Y\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n      Dated this the 27th day of January, 2010.\n\n                     JUDGMENT\n<\/pre>\n<p>  Kurian Joseph, Ag.C.J.\n<\/p>\n<p>1.The writ petitioners have approached this Court<\/p>\n<p> aggrieved  by  the  order   passed  by   the  Drugs<\/p>\n<p> Controller dated 25th June, 2009. As per the said<\/p>\n<p> order, the licence granted to the petitioners to<\/p>\n<p> run medical shops was cancelled. The learned<\/p>\n<p> single Judge though adverted to some of the<\/p>\n<p> contentions   advanced   by  the  learned   counsel<\/p>\n<p> appearing for the petitioner in WP(C)20714\/2009,<\/p>\n<p> disposed of the said writ petition in view of the<\/p>\n<p> submission of the learned Government Pleader that<\/p>\n<p> the petitioner has alternate remedies before the<\/p>\n<p> Government. Thus, the said writ petitioner was<\/p>\n<p> related to pursue the alternate remedies. Hence,<\/p>\n<p><span class=\"hidden_text\">WA1790\/09 &amp; WPC24240\/09    -: 2 :-<\/span><\/p>\n<p> the writ appeal.\n<\/p>\n<\/p>\n<p>2.The learned senior counsel appearing for the<\/p>\n<p> petitioners inviting our attention to the history<\/p>\n<p> behind     the   case,   submits    that   the appellate<\/p>\n<p> exercise will be in futility since according to<\/p>\n<p> the learned senior counsel, the Government had<\/p>\n<p> taken a stand to harass the petitioners for the<\/p>\n<p> reason that they are the office bearers of AKCDA.<\/p>\n<p> It is further contended that the impugned action<\/p>\n<p> is taken at the instance of a rival organisation<\/p>\n<p> which    is   controlled       by  some  of  the  ruling<\/p>\n<p> political parties. But the fact remains that the<\/p>\n<p> Drugs Controller has adverted to the merits of<\/p>\n<p> the case and has passed an order holding that in<\/p>\n<p> view     of   the     charges    levelled   against  the<\/p>\n<p> petitioners,      their   licence     is  liable  to be<\/p>\n<p> cancelled.      Since    all     allegations  are  those<\/p>\n<p> involved on facts, we do not think that even if<\/p>\n<p> the allegation raised in the writ petitions and<\/p>\n<p><span class=\"hidden_text\">WA1790\/09 &amp; WPC24240\/09   -: 3 :-<\/span><\/p>\n<p> pointed out by the learned senior counsel as<\/p>\n<p> above is on malafides, we will not be justified<\/p>\n<p> in interfering with the findings of facts. True,<\/p>\n<p> the learned senior counsel made an attempt to<\/p>\n<p> establish that even the factual findings are<\/p>\n<p> patently     wrong    and   such  findings  have  been<\/p>\n<p> entered only on the dictate of the Government. In<\/p>\n<p> the above circumstances, we dispose of the writ<\/p>\n<p> appeal and the writ petition as follows:<\/p>\n<blockquote><p>     In the event of the writ petitioners pursuing<\/p>\n<p>     their remedy before the appellate authority<\/p>\n<p>     within one month from today, the matter shall<\/p>\n<p>     be considered by the appellate authority with<\/p>\n<p>     an open mind. The appellate authority shall<\/p>\n<p>     refer to the contentions taken by the writ<\/p>\n<p>     petitioners.       Thereafter,     the   appellate<\/p>\n<p>     authority     will  pass    appropriate orders  in<\/p>\n<p>     accordance with law.
