DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Counsels for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 20.01.2010<br \/>\n\tpassed by the respondent No.3 in exercise of powers conferred under<br \/>\n\tSection 3(2) of the Gujarat Prevention of Anti Social Activities<br \/>\n\tAct, 1985 (for short  the Act ) by detaining the detenue as a<br \/>\n\t bootlegger  as defined under Section 2(b) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue submits that order of detention impugned in<br \/>\n\tthis petition deserves to be quashed and set aside on the ground<br \/>\n\tthat the solitary incident alleged against the detenue is not of<br \/>\n\tsuch a magnitude and intensity as to have the effect of disturbing<br \/>\n\tthe public order so as to pass an order under Section 3(1) of the<br \/>\n\tPASA Act.  She has further submitted that the detaining authority<br \/>\n\thas not applied her mind to the vital facts and there was<br \/>\n\tnon-application of mind before recording the order of detention. In<br \/>\n\tsupport of the above contention, the learned Counsel has relied upon<br \/>\n\tthe following case-laws :\n<\/p>\n<p>a)<br \/>\n\tJudgment and order dated 22.08.2000 of the Division Bench of this<br \/>\n\tCourt (Coram : M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters<br \/>\n\tPatent Appeal No.223 of 2000 in Special Civil Application No.554 of<br \/>\n\t2000 <a href=\"\/doc\/362856\/\">(Ashok Balabhai Makwana V. State of Gujarat).<\/a>\n<\/p>\n<p>b)<br \/>\n\tPiyush Kantilal Mehta V.\n<\/p>\n<p>\tCommission of Police, AIR 1989 Supreme Court 491.\n<\/p>\n<p>c)<br \/>\n\t<a href=\"\/doc\/195612027\/\">Om Prakash V. Commissioner of Police and others<\/a>, JT 1989 (4)<br \/>\n\tSC 177.\n<\/p>\n<p>d)<br \/>\n\t<a href=\"\/doc\/521149\/\">Kanuji S. Zala V. State of Gujarat and others<\/a>, 1992 (2) GLH\n<\/p>\n<p>\t415. <\/p>\n<p>Learned<br \/>\n\tAGP for the respondent   State supported the detention order<br \/>\n\tpassed by the authority and submitted that sufficient material and<br \/>\n\tevidence was found during the course of investigation, which was<br \/>\n\talso supplied to the detenue, indicating that the detenue is in the<br \/>\n\thabit of indulging into activities as defined under Section 2(b) of<br \/>\n\tthe Act and, considering the facts of the case, the detaining<br \/>\n\tauthority has rightly passed the order of detention and the<br \/>\n\tdetention order deserves to be upheld by this Court.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and considering the facts and<br \/>\n\tcircumstance of the case, it appears that the subjective<br \/>\n\tsatisfaction arrived at by the detaining authority cannot be said to<br \/>\n\tbe legal, valid and in accordance with law inasmuch as the offences<br \/>\n\talleged in the solitary FIR cannot have any bearing on the public<br \/>\n\torder since the law of the land, i.e. Indian Penal Code and other<br \/>\n\trelevant penal laws are sufficient enough to take care of the<br \/>\n\tsituation and that the allegations as have been levelled against the<br \/>\n\tdetenue cannot be said to germane for the purpose of bringing the<br \/>\n\tdetenue within the meaning of Section 2(b) of the Act unless and<br \/>\n\tuntil the material is there to make out a case that the person<br \/>\n\tconcerned has become a threat and menace to the society so as to<br \/>\n\tdisturb the whole tempo of the society and that the whole social<br \/>\n\tapparatus is in peril disturbing the public order at the instance of<br \/>\n\tsuch a person.  In view of the ratio laid down by the Hon&#8217;ble<br \/>\n\tSupreme Court in the decisions cited by the learned Counsel for the<br \/>\n\tpetitioner, the Court is of the opinion that the activities of the<br \/>\n\tpetitioner cannot be said to be dangerous to the maintenance of the<br \/>\n\tpublic order and at the most fall under the maintenance of  law<br \/>\n\tand order .\n<\/p>\n<p>In<br \/>\n\tthe result, this Special Civil Application is allowed. The impugned<br \/>\n\torder of detention dated 20.01.2010 passed by respondent No.3<br \/>\n\tPolice Commissioner, Rajkot City is hereby quashed and set aside.<br \/>\n\tThe detenue is ordered to be set at liberty, if not required in any<br \/>\n\tother case.  Rule is made absolute accordingly.  Direct Service is<br \/>\n\tpermitted.\n<\/p>\n<p>(Anant<br \/>\nS.
