The facts are not in dispute and thus we may<br \/>\nnote the same in brief.\n<\/p>\n<p>2.            Joining service under BSF on 7.9.1970, Yadunath<br \/>\nSingh earned a promotion and became an Assistant<br \/>\nCommandant on 6.11.1998. He earned another promotion<br \/>\nwhen he became a Deputy Commandant on 28.6.2005.\n<\/p>\n<p>3.            He    was     taken   on    deputation   in   the   Law<br \/>\nDepartment as a Law Officer Grade II on 13.7.2005 and was<br \/>\npermanently absorbed in the law cadre as Law Officer Grade<br \/>\nII on 19.12.2006.\n<\/p>\n<p><span class=\"hidden_text\">     W.P.(C) No.8640\/2010                                    Page 1 of 5<\/span><\/p>\n<p> 4.            As per BSF (Chief Law Officers and Law Officers<br \/>\nRecruitment and Conditions of Service) Rules 1999, vide<br \/>\nSchedule II, eligibility to be promoted as Law Officer Grade I<br \/>\nwas as under:-\n<\/p>\n<p>        (a)   Law Officer Grade II with 9 years&#8217; regular service<br \/>\nin the grade; failing which\n<\/p>\n<p>        (b) Law Officer Grade II with 4 years&#8217; regular service in<br \/>\nthe grade and having total 9 years&#8217; regular service in the<br \/>\npay scale of `10,000-15,200\/- in the Force with total 9 years<br \/>\nexperience in legal affairs.\n<\/p>\n<p>5.            Yadunath Singh admittedly did not have the<br \/>\nrequisite service either as per sub-para (a) or sub-para (b)<br \/>\nabove. In spite thereof, he and persons junior to him, but<br \/>\nwho were otherwise eligible having requisite service, were<br \/>\nconsidered for promotion at a DPC which met on 12.1.2001.\n<\/p>\n<p>6.            Yadunath Singh was empanelled for promotion<br \/>\nand realizing that he had yet to attain the eligibility in terms<br \/>\nof qualifying       service   matter   was   sent   to the   Cadre<br \/>\nControlling Ministry for relaxation to be granted in favour of<br \/>\nYadunath Singh.\n<\/p>\n<p>7.            We may highlight that the department very<br \/>\nstrongly recommended that relaxation should be granted to<br \/>\nYadunath Singh.\n<\/p>\n<p>8.            The Cadre Controlling Ministry took a stand that<br \/>\nin terms of OM dated 25.3.1996, relaxation could not be<br \/>\ngranted. The undernoted extract of the office memorandum<br \/>\nwas held against the petitioner:-\n<\/p>\n<blockquote><p>        &#8220;Where juniors who have completed their<br \/>\n        qualifying\/eligibility service are being considered<br \/>\n        for promotion, their seniors would also be<\/p>\n<p><span class=\"hidden_text\">     W.P.(C) No.8640\/2010                                Page 2 of 5<\/span><br \/>\n         considered provided they are not short of the<br \/>\n        requisite qualifying\/eligibility service by more<br \/>\n        than half of such qualifying\/eligibility service or<br \/>\n        two years, whichever is less, and have<br \/>\n        successfully completed their probation period for<br \/>\n        promotion to the next higher grade alongwith<br \/>\n        their juniors who have already completed such<br \/>\n        qualifying\/eligibility service.&#8221;\n<\/p><\/blockquote>\n<p>9.            The Recruitment Rules in question i.e. BSF (Chief<br \/>\nLaw Officers and Law Officers Recruitment and Conditions of<br \/>\nService) Rules 1999, vide Rule 7 thereof, contains a power<br \/>\nto relax the rules.\n<\/p>\n<p>10.           Rule 7 reads as under:\n<\/p>\n<blockquote><p>        &#8220;7. Power to relax &#8211; Where the Central<br \/>\n        Government is of the opinion that it is necessary<br \/>\n        or expedient so to do, it may, by order, and for<br \/>\n        reasons to be recorded in writing, relax any of<br \/>\n        the provisions of these rules with respect to any<br \/>\n        class or category of persons.&#8221;\n<\/p><\/blockquote>\n<p>11.           It is apparent that the power under Rule 7 is to<br \/>\naccord relaxation from any of the provisions of the rules<br \/>\nwith respect to any class or category or persons where the<br \/>\nCentral Government is of the opinion that it is necessary or<br \/>\nexpedient so to do.\n<\/p>\n<p>12.           This    power   is   quite   independent   of    the<br \/>\nrequirement of OM dated 25.3.1996 which simply states<br \/>\nthat where juniors have completed the qualifying\/eligibility<br \/>\nservice and are being considered for promotion, persons<br \/>\nsenior to them would also be considered provided the<br \/>\nseniors are not short of the requisite qualifying\/eligibility<br \/>\nservice by more than half of such qualifying\/eligibility<br \/>\nservice or 2 years; whichever is less.\n<\/p>\n<p><span class=\"hidden_text\">     W.P.(C) No.8640\/2010                                Page 3 of 5<\/span><\/p>\n<p> 13.        We clarify. The OM would come into play where<br \/>\npersons junior, having attained the qualifying service, are<br \/>\nconsidered for promotion and it is found that a person<br \/>\nsenior has not achieved or attained the qualifying service.<br \/>\nSaid person would become eligible to be considered for<br \/>\npromotion, if as per the OM, the person concerned has a<br \/>\nshortfall in service being not more than half the qualifying<br \/>\nservice or 2 years; whichever is less.      The OM does not<br \/>\nenvisage a situation where the eligibility condition has to be<br \/>\nrelaxed.\n<\/p>\n<p>14.        Power under Rule 7 is an entirely different power<br \/>\nand operates in a totally different area.\n<\/p>\n<p>15.        Power to relax the rule operates in an area where<br \/>\nthe facts warrant, either due to necessity or expediency,<br \/>\nrelaxation being accorded from the provisions of the rules.\n<\/p>\n<p>16.        Since    the   Cadre   Controlling   Ministry   has<br \/>\nmisdirected the inquiry and has treated the case as if OM<br \/>\ndated 25.3.1996      was attracted; neither BSF nor the<br \/>\npetitioner was wanting a benefit under the said OM; what<br \/>\nwas sought from the Cadre Controlling Ministry was the<br \/>\nCentral Government&#8217;s power of relaxation under Rule 7 to<br \/>\nbe exercised, we dispose of the writ petition quashing the<br \/>\norder dated 28.4.2010 rejecting the request that power be<br \/>\nexercised under Rule 7 of the Rules: We issue a mandamus<br \/>\nto the Cadre Controlling Ministry to re-consider the matter<br \/>\nwith reference to the power of the Central Government<br \/>\nunder Rule 7 of the BSF (Chief Law Officers and Law Officers<br \/>\nRecruitment and Conditions of Service) Rules 1999.\n<\/p>\n<p><span class=\"hidden_text\">  W.P.(C) No.8640\/2010                               Page 4 of 5<\/span><\/p>\n<p> 17.
