It is alleged that he had made some wrong<br \/>\nentries in the diary, made false TA Bills and because of his<br \/>\ncarelessness in work, there was loss in sprouting seedlings.<br \/>\nTherefore a show cause notice was issued to him on 5.11.1998 calling<br \/>\nupon him to give explanation.\n<\/p>\n<p>2.1\tIt<br \/>\nis alleged that thereafter, after considering all the relevant<br \/>\nrecords, charge sheet was issued to respondent on 2.5.2000 for the<br \/>\noffences committed by him.  Thereafter Special Inquiry Officer was<br \/>\nappointed  who issued notice to the respondent and the respondent<br \/>\nfiled his reply on 2.10.2004. The Special Inquiry Officer, after<br \/>\nhearing the respondent and after considering all the relevant records<br \/>\ncame to the conclusion that charge Nos.(i) and (ii) were not proved<br \/>\nand charge Nos.(iii) and (iv) were partly proved and the said report<br \/>\nwas given by the Special Inquiry Officer on 30.11.2004.\n<\/p>\n<p>2.2\tThe<br \/>\ndisciplinary authority did not agree with the findings\/report given<br \/>\nby the Special Inquiry Officer and therefore, further show cause<br \/>\nnotice was given by the said authority to the respondent on<br \/>\n16.8.2005. The respondent filed reply to the show cause notice on<br \/>\n27.9.2005.  Thereafter the disciplinary authority recorded the oral<br \/>\nevidence  of the respondent on 16.1.2006.\n<\/p>\n<p>2.3\tThereafter<br \/>\nthe disciplinary authority, after considering all the documentary<br \/>\nevidence, oral evidence as well as the submissions made by the<br \/>\nrespondent, vide order dated 27.2.2006 imposed punishment on the<br \/>\nrespondent of stoppage of one increment with future effect.\n<\/p>\n<p>2.4<br \/>\n\tFeeling aggrieved by the aforesaid order, the respondent preferred<br \/>\nAppeal No.140 of 2006 before the Gujarat Civil Services Tribunal. The<br \/>\nTribunal, after hearing the parties, vide order dated 3.6.2009<br \/>\nallowed the appeal of the respondent and quashed and set aside the<br \/>\norder passed by the Principal Chief Conservator of Forests dated<br \/>\n27.2.2006.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned advocates for the petitioner and perused the relevant<br \/>\nrecords. It is required to be noted that the Gujarat Civil Services<br \/>\nTribunal, while setting aside the order of the Principal Chief<br \/>\nConservator of Forests dated 27.2.2006, imposing punishment of<br \/>\nstoppage of one increment with future effect, has elaborately<br \/>\ndiscussed in detail the reasons in this behalf in paragraphs Nos.8, 9<br \/>\nand 10 of the judgment and order.\n<\/p>\n<p>4.\tPara<br \/>\n10 of the order reads as under :\n<\/p>\n<p>&#8220;10.\n<\/p>\n<p>All the five conclusions of the disciplinary authority in the order<br \/>\nof 27\/02\/2006 are not reasoned properly.  They are either distorted<br \/>\nas in the case of TA Bill or superficial as in the case of seeds<br \/>\nfailure. It would appear as if the disciplinary authority wanted only<br \/>\ncertain excuses to fix the appellant rather than arriving at the<br \/>\ntruth of the charges made against him in an objective, unbiased<br \/>\nmanner, upholding the principles of natural justice, discipline and<br \/>\naccountability transparency and proactiveness in the department. The<br \/>\nappellant had just been promoted as R.F.O. From the cadre of<br \/>\nForester. He was to be guided properly in discharging his functions<br \/>\nby the Dy.Conservator of Forests. It is stated by the appellant that<br \/>\nhe was advised by his superior to indulge in certain unfair practices<br \/>\nwhich he did not.  It cannot be discounted that the bias against the<br \/>\nappellant is his superior officers must have originated in the<br \/>\nfailure of the appellant to carry out unfair practices. The net<br \/>\nresult is the order of 27\/02\/2006 suffering irredeemably from<br \/>\ndistortion, bias, and lack of impartiality and objectivity.<br \/>\nTherefore, in the interest of justice, it needs to be quashed.&#8221;\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate for the petitioner is not in a position to point out<br \/>\nanything from the record  to take a contrary view.\n<\/p>\n<p>6.\tThis<br \/>\npetition is therefore dismissed.
