No.12322 of 2011\n                                      BANTI KUMAR\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2   28.04.2011             Heard learned counsel for the petitioner as well<\/p>\n<p>                 as learned Additional Public Prosecutor for the State.<\/p>\n<p>                           Petitioner is languishing in jail custody since<\/p>\n<p>                 04.02.2011 in connection with Jakkanpur P.S. Case<\/p>\n<p>                 No.122 of 2011 registered under Sections 147, 148, 149,<\/p>\n<p>                 323, 307, 379, 384 of the I.P.C.\n<\/p>\n<p>                           It appears from perusal of the First Information<\/p>\n<p>                 Report that an omnibus allegation of assault has been<\/p>\n<p>                 levelled against the petitioner and other accused. It is<\/p>\n<p>                 stated that petitioner and co-accused Bhim Singh along<\/p>\n<p>                 with 3 to 4 unknown persons assaulted the informant<\/p>\n<p>                 with lathi and rod causing injury to him on various parts<\/p>\n<p>                 of his body. The contention on behalf of the petitioner is<\/p>\n<p>                 that it is not specific as to who assaulted on which part of<\/p>\n<p>                 the body of the informant, and it is further contended by<\/p>\n<p>                 learned counsel for the petitioner that the informant was<\/p>\n<p>                 examined in Gardanibagh Hospital and altogether nine<\/p>\n<p>                 injuries were found, and subsequently he was referred to<\/p>\n<p>                 PMCH, Patna for better treatment, but on the same day<\/p>\n<p>                 the informant left PMCH and got treated himself in private<\/p>\n<p>                 hospital and as a matter of fact for procuring the false<\/p>\n<p>                 injury report the informant did the above stated act.<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>              Taking into consideration the above stated facts<\/p>\n<p>     and circumstances as well as submissions of the parties,<\/p>\n<p>     particularly, keeping in mind that omnibus allegation of<\/p>\n<p>     assault has been levelled against the petitioner, let the<\/p>\n<p>     petitioner, namely, Banti Kumar be released on bail on<\/p>\n<p>     furnishing bail bonds of Rs.10,000\/-(ten thousand) each<\/p>\n<p>     with two sureties of the like amount each to the<\/p>\n<p>     satisfaction of learned C.J.M., Patna in connection with<\/p>\n<p>     Jakkanpur P.S.
