Justice P.BHAVADASAN\n\n Dated :11\/08\/2010\n\n O R D E R\n                       P.BHAVADASAN, J.\n                       -------------------------\n                    R.S.A No. 772 of 2010\n                       --------------------------\n              Dated this the 11th August, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>     Plaintiff who has been non-suited by the courts below<\/p>\n<p>is the appellant before this Court.\n<\/p>\n<p>     2.    O.S No.50\/2005 was instituted by the plaintiff<\/p>\n<p>for perpetual injunction restraining the defendants from<\/p>\n<p>interfering with the possession of the plaintiffs over plaint<\/p>\n<p>schedule property. According to the plaintiff, he obtained<\/p>\n<p>the plaint schedule property as per Ext.A2 dated<\/p>\n<p>23.6.1994. Ever since then he claimed to be in absolute<\/p>\n<p>possession and enjoyment of the same. Defendants have<\/p>\n<p>no manner of right over the plaint schedule property.<\/p>\n<p>They attempted to trespass into the plaint schedule<\/p>\n<p>property.    They claimed to be the owners of plaint<\/p>\n<p>schedule property and attempted to put up a compound<\/p>\n<p>wall in the said property claiming that it is a cremation<\/p>\n<p>ground. They have no right to do so.             Apprehending<\/p>\n<p>trouble, the suit was laid.\n<\/p>\n<p>     3.    The suit was resisted by the defendants. It is<\/p>\n<p>pointed out by them that property originally belonged to<\/p>\n<p>R.S.A No. 772 of 2010<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Puthenveedu Tarward of which defendants are members.<\/p>\n<p>Traditionally the south eastern portion of the property was<\/p>\n<p>used for cremating the dead bodies of members of the<\/p>\n<p>tharwad. There was no objection or interference from any<\/p>\n<p>one for doing so.      In the written statement, names of<\/p>\n<p>some of members of the tarwad whose dead bodies were<\/p>\n<p>cremated in that place is mentioned. It is pointed out that<\/p>\n<p>plaintiff cannot claim absolute right over that portion of the<\/p>\n<p>land which is being used as a cremation ground. On the<\/p>\n<p>basis of the above contention, they prayed for dismissal of<\/p>\n<p>the suit.\n<\/p>\n<p>      4.    The trial court raised necessary issues for<\/p>\n<p>consideration. The evidence consists of the testimony of<\/p>\n<p>PW1 and Exts.A1 to A6 were marked from the side of the<\/p>\n<p>plaintiff.  Defendants had examined DW1 and DW2 and<\/p>\n<p>Exts.B1 and B2 were marked. Commissioner was examined<\/p>\n<p>as CW1. Exts.C1 to C3 (a) are the are the commissioner&#8217;s<\/p>\n<p>report and plan.\n<\/p>\n<p>      5.    On evaluation of the evidence in the case, the<\/p>\n<p>trial court came to conclusion that the claim made by the<\/p>\n<p>R.S.A No. 772 of 2010<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>defendants is true and accordingly dismissed the suit.<\/p>\n<p>     6.     Plaintiff carried the matter in appeal as<\/p>\n<p>A.S.No.86\/2000 before the Sub Court, Thalassery.        The<\/p>\n<p>lower appellate court on an independent evaluation of the<\/p>\n<p>evidence in the case found that the findings of the trial<\/p>\n<p>court are just and proper and accordingly dismissed the<\/p>\n<p>appeal.\n<\/p>\n<p>     7.        Against the concurrent findings of the court<\/p>\n<p>below, this appeal has been preferred before this Court.<\/p>\n<p>     8.     Learned counsel appearing for the appellant<\/p>\n<p>pointed out that defendants have no title or possession over<\/p>\n<p>the plaint schedule property. There is nothing to show that<\/p>\n<p>they had any right to use     any   portion   in the plaint<\/p>\n<p>schedule property as a burial ground. Merely saying that a<\/p>\n<p>portion of the plaint schedule property was used as a<\/p>\n<p>cremation ground will not suffice. The title to the property<\/p>\n<p>rests with the plaintiff and defendants have no manner of<\/p>\n<p>right over suit property.\n<\/p>\n<p>     9.     Respondents had lodged caveat      Respondents<\/p>\n<p>pointed out that the commission report as well as the<\/p>\n<p>R.S.A No. 772 of 2010<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>evidence of DW2 is sufficient to show that a portion of the<\/p>\n<p>plaint schedule property is being used as a cremation i.e for<\/p>\n<p>burial of the members of the Puthenveedu Tarwad. It is to<\/p>\n<p>be noticed that even though plaintiff    had claim to 32 1\/2<\/p>\n<p>cents of land, the tax receipts produced by him cover only<\/p>\n<p>29.825 cents leaving 2.625 cents. That is being used as<\/p>\n<p>the cremation ground.      This was one of the factors which<\/p>\n<p>weighed with the courts below.\n<\/p>\n<p>      10. The       courts  below    have   considered   the<\/p>\n<p>commission reports in       considerable detail. There were<\/p>\n<p>three reports and sketches. The courts below have noticed<\/p>\n<p>that the Commissioner has specifically stated that there is<\/p>\n<p>difference in the nature of property between 2.625 cents<\/p>\n<p>and rest of the property in the possession of the plaintiff.<\/p>\n<p>It is also stated by the the commissioner that there are<\/p>\n<p>indications at the site to show that portion was being used<\/p>\n<p>as cremation ground. The evidence of DW2, supports the<\/p>\n<p>case of the defendants. It is seen that his evidence remains<\/p>\n<p>unimpeached though he was subjected to severe cross-<\/p>\n<p>examinations.        Both the courts below have concurrently<\/p>\n<p>R.S.A No. 772 of 2010<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>held that plaintiff is not in absolute possession of 32 1\/2<\/p>\n<p>cents of land.      The lower court also noticed that only the<\/p>\n<p>power of attorney holder has been examined on behalf of<\/p>\n<p>the plaintiff and he was unable to give several details<\/p>\n<p>regarding various aspects of the case.<\/p>\n<p>     The findings of the courts below are based on the<\/p>\n<p>evidence      of facts.   No questions of law       arise for<\/p>\n<p>consideration in this appeal. No interference is called for<\/p>\n<p>required under Section 100 C.P.C.
