The Oriental Insurance 1 Company Limited;~.V_::’b’e’ing<\/p>\n
aggrieved by the award dated 27-2-2006 made  ~<\/p>\n
53 \/ 2004 by the Commissioner for Work.rn_en’s’  if V’<\/p>\n
Kolar filed this appeal.\n<\/p>\n
2. The brief facts of the case  foil’0’\u00a2ffS:~   <\/p>\n
The first respondent, filed petition. before the
\nCommissioner for Wori{nienis..V.\u00a7’:’\u00bbV seeking
\ncompensation contending     as a collie
\nin the Goods  No.KA~07\/4354
\nbelonging   The second respondent
\nwas paying h\u00e9rg: ~p.m. and Rs.40\/~ per
\ndayas  Q11′-‘i%#A’-T2004′ while taking a load of tomato<\/p>\n
from iiingapura.ivtofvaddarahalli, due to the rash and negligent<\/p>\n
 iof\u00e9the  of the said vehicle, the goods auto fell<\/p>\n
_i”n4f0_g\u00a3l ditchvfon the left side of the road. Due to the accident,<\/p>\n
‘C_’_”‘the\u00abi_clairnant sustained serious injuries. She was shifted to<\/p>\n
,,  Hospital for the tre\/gtnent. However, her left leg was<\/p>\n
amputated to the extent of 1\/3 portion. The Poiice have<\/p>\n
registered a case against the said driver under Secti_ons.2~’Z9,<\/p>\n
337 and 338 of IPC. In View of the accident, the   .<\/p>\n
become permanently disabled to do _any4coo1ie” Tile ll”<\/p>\n
accident took place during the course *<\/p>\n
hence, she sought for compensation uA1’ider~  \\KIor1m’ien’s’-it<\/p>\n
Compensation Act.\n<\/p>\n
3. In pursuance to the  Commissioner
\nfor Workmerfs Cops  -sQ.%{inpd”resVpondent–Insurer
\n\ufb01led ob3’ections=7   made in the claim
\npetition. that-l the said vehicle is covered
\nby insurance\u00e9.”‘–,g\u00a3’_p\\s   of the Policy, the Policy
\nissued  covers\ufb01tieprisk of owner, driver and one coolie<\/p>\n
   Goods Auto did not possess the valid<\/p>\n
 vlicenuseplihas’ onV’i.1:he’,::.date of the accident. Hence. sought for<\/p>\n
 dismissai ofhthe. claim petition as against the insurer. The<\/p>\n
resp.ondent owner of the vehicle remained exparte before<\/p>\n
it hf    below.\n<\/p>\n

4. On the basis of the pleadings of the parties”, the
\nCommissioner for Workmen’s Compensation <\/p>\n
necessary issues.\n<\/p>\n
5. In order to prove the case, the \u00bb-c1airnar1t”c-Viexamiineid V<\/p>\n
herself as P.W1 and got marked the  <\/p>\n
Ex.P.6 and she has examined <\/p>\n
The Insurer cross-examined.}ooth..P;W}:1\n<\/p>\n
6. In the cross–examination1,’ I  that she was<\/p>\n
working as a coo1ie”rT.1nder:_the..’secontifrespondent since two<\/p>\n
years. While,   of tomato to Vaddarahalli
\nmarket, the  ‘vehic_1e’ an accident. The owner of<\/p>\n
the vehicileivwas  her a salary of Rs.3,000\/– p.m. and<\/p>\n
   batta. The accident has taken place<\/p>\n
 Vduringiithe  employment. Due to the accident, her<\/p>\n
_w’7e.._Q’1eftV}.eg was sinpntated to the extent of 1\/3 portion and she is<\/p>\n

7. The Doctor who examined her was also cross–examined<\/p>\n
by the Insurer. In the cross–examination. the Doctorthas<\/p>\n
deposed that due to the Gangrene, the left leg of  <\/p>\n
was amputated and the disability was_a..Ssessed”a’t  it ”<\/p>\n
the Commissioner for Workmen’s~. C_’oa’1pens’ati’ori <\/p>\n
considering the oral and documentary evidence -vparties; . C’<\/p>\n
taking into consideration the  by the
\nclaimant as Rs.3,000\/~  getpplying relevant
\nfactor, awarded compe.nsaftilon  — with interest
\nat the rate of 12.3\/0   petition.\n<\/p>\n
8. The  by the award passed by
\nthe Commislsiojnerl  Compensation \ufb01led the
\nab\u00e9ve appear.\n<\/p>\n
 \u00bb  learned counsel appearing for the<\/p>\n
  that the compensation awarded by the<\/p>\n
 Commisslioner for Workmen’s Compensation is contrary to<\/p>\n
  also contends that though the Doctor has<\/p>\n
Aw<\/p>\n
assessed the disability at 50%, the Commissioner had taken<\/p>\n
the disability at 100% and awarded compensation, which is<\/p>\n
contrary to law. Further contended that awarding -.\ufb021.Q9’b<\/p>\n
interest from the date of \ufb01ling of the claim   <\/p>\n
contrary to the law laid down by the ;vHMo:ri’ble<\/p>\n
and sought for setting aside. the   <\/p>\n
Commissioner.\n<\/p>\n

\nCommissioner  contending that
\nsince the  leg  has been amputated, she has
\nsuffered disability to  Work. Hence, she is entitled
\nfor ggcompeinsatiou  by the Commissioner and sought<\/p>\n
for_Vdismissab.i  appeai.\n<\/p>\n

12. It is not in dispute that the claimant was injured in a<\/p>\n
motor accident that occurred on 19–4–2004~ while _a<\/p>\n
load of tomato to Vaddarahalli market.  _<\/p>\n
accident, the claimant was admitted;  it<\/p>\n
Since, the Gangrene has developed in:l”hei5,’_’left leg <\/p>\n
leg was amputated to the extent.,:Vpoi7,_%i portion, ~b’odiIy*ll<\/p>\n
disability was assessed at 5.90\/0, pti1’el:..fi:nctional’disability was
\nassessed at 100% by the  is an illiterate
\nwoman, doing coolie\u00bb  amputated, she
\ncannot do any   thew.-Commissioner taking
\ninto consid.’ei*atio.nvf,  suffered by the
\nclaimant, age,V’the  her and also applying the
\nrelevant factonhas “the compensation, which is in
\n  illiloiwever, while assessing the income,<\/p>\n
the Corninis:siorier._hjas not taken into consideration the batta<\/p>\n
of Rs.-41}\/_V- per claimed by the claimant, since the coolie is<\/p>\n
” “eij1tit1ezd’v.for any batta. Taking into consideration 60% of<\/p>\n
  drawn by ti\ufb01enclaimant, age and also applying the<\/p>\n
relevant factor. the Commissioner has awarded
\ncompensation. We \ufb01nd there is no in\ufb01rmity or irregularity in<\/p>\n
the said order. Hence, We con\ufb01rm the said order.<\/p>\n
13. The contention of the appellant’s cot_1Hr__1se~.l.  <\/p>\n
interest awarded by the Commissioner  ‘rate  <\/p>\n

the claimant is entitled for interest at the rate of<\/p>\n

7.5% p.a. from the date of claim petition till the date of
\npassing the award and at the rate of 12% p.21. from the<\/p>\n
