In the said suit,<br \/>\nthe petitioners filed its written statement at Exhibit-19.\n<\/p>\n<p>3.\tIt<br \/>\nis the case of the petitioners that on account of certain unavoidable<br \/>\ncircumstances, the petitioners could not cross-examine the respondent<br \/>\nand lead evidence in its defence. Consequently, the trial Court<br \/>\nclosed both the rights of the petitioners. Subsequently, the<br \/>\npetitioners preferred application Exhibit-83 for leading evidence in<br \/>\ntheir defence. However, by impugned order dated 22.06.2009, the said<br \/>\napplication came to be rejected. Hence, this petition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It appears from the record that the case of the<br \/>\npetitioners was not defended properly before the trial Court.<br \/>\nTherefore, the trial Court closed the right of the petitioners to<br \/>\ncross-examine the respondent. In my view, the trial Court ought to<br \/>\nhave taken a lenient view since the petitioner is a public authority.<br \/>\nApart from that the application filed by the petitioners u\/s.24 of<br \/>\nthe C.P.C. has been rejected by way of order 26.02.2010. Therefore,<br \/>\nin the fitness of things, it would be appropriate that the trial<br \/>\nCourt concerned decides the suit after giving proper opportunity to<br \/>\nthe petitioners to cross-examine the respondent.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, the petition is partly allowed. The impugned order<br \/>\npassed by the trial Court is quashed and set aside. The trial Court<br \/>\nconcerned is directed to allow the petitioners to lead evidence in<br \/>\ntheir evidence subject to the condition that before allowing the<br \/>\nsame, the petitioners deposit an amount of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] by way of costs before the trial Court concerned,<br \/>\nwithin a period of four weeks from today. On such deposit being made,<br \/>\nthe trial Court concerned shall proceed with the hearing of the suit.<br \/>\nRespondent, original plaintiff, shall be permitted to withdraw the<br \/>\nsaid amount after necessary verification.\n<\/p>\n<p>\tWith<br \/>\nthe above directions, the petition stands disposed of. R &amp; P, if<br \/>\nlying with this Court, be sent to the trial Court concerned<br \/>\nforthwith.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
