J.<\/p><\/blockquote>\n<p>     This appeal  is directed  against\tthe  judgment  dated<br \/>\nFebruary 3,  1994 passed  by Patna High Court (Ranchi Bench)<br \/>\nin Election Petition No. 3 of 1990. The appellant challenged<br \/>\nthe  result   of  the\telection  of   285  Nirsa   Assembly<br \/>\nConstituency in\t the State of Bihar held in February 1990 by<br \/>\npresenting an  election petition before the High Court under<br \/>\nthe Representation  of People Act 1951 (hereinafter referred<br \/>\nto as  the Representation  Act).  The  appellant  Sri  Kripa<br \/>\nShankar Chatterjee  was a  candidate for  the said  election<br \/>\nfrom Nirsa  Constituency. He,  however, lost to the returned<br \/>\ncandidate namely  Respondent no.1  Gurudas Chatterjee  by  a<br \/>\nmargin\tof  1450  votes.  There\t were  22  other  candidates<br \/>\ncontesting for the said Nirsa Constituency. It may be stated<br \/>\nhere that  during the  pendency\t of  the  Election  petition<br \/>\nbefore the  Ranchi, Bench,  the election petitioner moved an<br \/>\napplication in\tthe High  Court\t for  inspection  of  ballet<br \/>\npapers but  such application  being dismissed the petitioner<br \/>\nmoved a\t Special Leave Application before this Court out the<br \/>\nsaid petition  was also\t dismissed by  this Court  with\t the<br \/>\nobservation that  dismissal of\tspecial leave petition would<br \/>\nnot preclude  the High\tCourt  from  inspecting\t the  ballot<br \/>\npapers\tif  it\tdeemed\tnecessary  to  satisfy\tthe  court&#8217;s<br \/>\nconscience. Although  the petitioner  thereafter maoe prayer<br \/>\nfor such  inspection but  the High  Court did  not accede to<br \/>\nsuch prayer.\n<\/p>\n<p>     The election  result was  challenged inter\t alia on the<br \/>\nprounds of (1) improper rejection of the nomination paper of<br \/>\none of\tthe candidates\tSri Chunmun  Singh although  he\t was<br \/>\nabove 25 years of age, (2) improper acceptance of nomination<br \/>\npapers of  two candidates  namely Sri  Sanjib Baxi  and\t Sri<br \/>\nShival Mahajni\twho were  not voters  in the  Nirsa Assembly<br \/>\nConstituency, (3)  the returned\t candidates  and  two  other<br \/>\ncandidates namely  Respondent No.20  and 21 were at the time<br \/>\nof election  employees of  Eastern  Coal  Field\t Limited,  a<br \/>\nsubsidiary of  Coal India  Ltd. which  was a  Government  of<br \/>\nIndia Undertaking  and as such public servants under Section<br \/>\n21 of Indian penal Code and accordingly were disqualified to<br \/>\ncontest the  said election  and (4) the election of returned<br \/>\ncandidate  was\tinvalid\t on  account  of  irregularities  in<br \/>\ncounting ballot\t papers, particulars  of such irregularities<br \/>\nbeing mentioned in paragraph 30 of Election petition.\n<\/p>\n<p>     The Respondent  No.1 Sri  Gurudas Chatterjee  contested<br \/>\nthe Election  petition and denied all the contentions of the<br \/>\nElection petitioner  by\t filing\t a  written  statement.\t The<br \/>\nlearned\t Judge\t by  the  impugned  judgment  dismissed\t the<br \/>\nelection petition  by rejecting\t all the said contentions of<br \/>\nthe election  petitioner. Coming to the question of improper<br \/>\nrejection of  the nomination paper of Sri chunman Singh, the<br \/>\nlearned Judge  inter alia came to the finding that there was<br \/>\nno evidence  from the  side of\tElection petitioner that Sri<br \/>\nChunmun Singh  was not\tless than  25 years  at the  time of<br \/>\nscrutiny.  The\t election  petitioner\tfiled  an  affidavit<br \/>\naffirmed by  Sri Chunman  Singh stating that he was above 25<br \/>\nyears at  the time  of scrutiny of nomination papers. In the<br \/>\nabsence of  oral deposition, the High Court was not inclined<br \/>\nto accept  the said  affidavit. Mr.  Mukhoty learned  senior<br \/>\ncounsel appearing  for the  appellant has  contended at\t the<br \/>\nhearing of  the appeal\tthat the  said Sri Chunman Singh was<br \/>\nsummoned but  he failed to appear in court. Sri Chuman Singh<br \/>\nfiled an  affidavit stating  therein that  his date of birth<br \/>\nwas  March  5,1962.  Mr.  Mukhoty  has\tcontended  that\t the<br \/>\nappellant was  keen in\texamining the said Sri Chunman Singh<br \/>\nbut as\the did not appear despite summons issued to him, his<br \/>\naffidavit filed\t by him in court answer to the summons ought<br \/>\nto have\t been accepted\tby the\tCourt. We  are, however, not<br \/>\ninclined to  accept the\t said submission  of Mr. Mukhoty. It<br \/>\nwas open  to the  election petitioner  to move the court for<br \/>\ntaking appropriate steps to ensure appearance of Sri Chunmun<br \/>\nSingh. The  ex parte affidavit without affording opportunity<br \/>\nto the\tRespondent  No.\t 1  to\ttest  the  veracity  of\t the<br \/>\nstatements made\t in the\t affidavit by  cross  examining\t him<br \/>\ncannot be  held to be sufficient proof of the correct age of<br \/>\nSri Chunmun  Singh. We, therefore, do not find any reason to<br \/>\ninterfere with the finding of the High Court on the question<br \/>\nof rejection of nomination paper of Sri Chunmun Singh.\n<\/p>\n<p>     Coming  to\t the  question\tof  improper  acceptance  of<br \/>\nnomination papers of Sri Sanjib Baxi and Sri Shiv lal Manjhi<br \/>\nthe High Court has held that the election cetitioner did not<br \/>\nfile  the   certified  copy   of  the  voters  list  of\t the<br \/>\nconstituency from  which he  was an  slector. The Respondent<br \/>\nNo.1 in\t his deposition\t has categorically  stated that both<br \/>\nSri  Baxi   and\t Sri   Manjhi  were   voters  in  the  Nirsa<br \/>\nConstituency. He  has also stated that both Sri Baxi and Sri<br \/>\nManjhi has shown the relevant entries showing their names in<br \/>\nthe voters  list to  the Returning  Officer at\tthe time  of<br \/>\nscrutiny. It  has been\theld by the learned Judge that there<br \/>\nis no documentry evidence from the side of the petitioner to<br \/>\nestablish that\tthe certified copies of the relevant entries<br \/>\nin the\tvoters list  were not  filed by\t the said candidates<br \/>\nwith their  nomination papers  or at  the time\tof scrutiny.<br \/>\nThere  is  also\t no  evidence  that  any  objection  against<br \/>\nacceptance of  nomination papers  of the said candidates was<br \/>\nraised by  election petitioner\tor by any other candidate at<br \/>\nthe time  of scrutiny.\tThe learned  Judge  has\t not  placed<br \/>\nreliance on  the deposition  of\t P.W  2\t Srilal\t because  of<br \/>\ncontradication in  his statement in examination in chief and<br \/>\ncross examination  about examination  of relevant entries in<br \/>\nthe voters  list at the time of acceptance of his nomination<br \/>\npaper for  Sindri Constituency. The High Court has inqicated<br \/>\nthat there  is evidence\t on the\t side of the Respondent No.1<br \/>\nvide deposition\t of RW\t1, RW  10. RW  14 and RW 15 that Sri<br \/>\nBaxi and  Sri Manjhi  had produced and shown the voters list<br \/>\nto the\tReturning Officer.  The learned\t Judge has also held<br \/>\nthat the  presumption of  proper performance  of  duties  by<br \/>\nReturning Officer in accepting nomination papers on scrutiny<br \/>\nof relevant  records has not been rebutted by any convincing<br \/>\nevidence adduced  by the  election petitioner.\tIt has\talso<br \/>\nbeen held  by the High Court that even if it is assumed that<br \/>\nthe said nomination papers were improperly accepted, in view<br \/>\nof Section  100(d) of  the Representation  Act,\t unless\t the<br \/>\npetitioner  was\t  able\tto   establish\tthat  such  improper<br \/>\nacceptance of  nomination papers  had materilly affected the<br \/>\nelection result,  the same  is not liable to be quasned. The<br \/>\nHigh Court  has come  to the  findingh by indicating reasons<br \/>\nthat the  election petitioner has failed to establish by any<br \/>\nconvincing evidence  that in view of contest of the election<br \/>\nby Sri\tBaxi and  Sri Manjhi,  the polling  prospect of\t the<br \/>\nelection petitioner  was materially  affected. We agree with<br \/>\nthe said finding of the High Court. It may be indicated here<br \/>\nthat although  an appeal  lies to this Court from a decision<br \/>\nof the\tHigh Court  in an  election petition filed under the<br \/>\nRepresentation Act  and although  in such  appeal this Court<br \/>\ncan interferer\twith the  finding of  fact by making its own<br \/>\nassessment of evidence, as a rule of prudence this court has<br \/>\nshown disinclination  to interfere  with the finding of fact<br \/>\nunless it  can be  established\tby  cogent,  convincing\t and<br \/>\nunimpeachable evidence\tthat the finding of fact by the High<br \/>\nCourt is unjustified and against the weight of the evidence.<br \/>\nIn this\t connection reference my be made to the decisions of<br \/>\nthis court  in N.I.  Singh versus  L.O. Singh  (1977 (1) SCR\n<\/p>\n<p>573) and  Mohd.\t      Yunus  versus Shiv Kumar (1974 (3) SCR\n<\/p>\n<p>738).\n<\/p>\n<p>     So far  as the  question  of  disqualification  of\t the<br \/>\nreturned candidate  to contest\tthe election  in view of the<br \/>\nfact that  at the  relevant time  he held  office of  profit<br \/>\nbeing employee of Eastern Coal Fields Ltd. is concerned, the<br \/>\nHigh Court  has held  that there  is  satisfactory  evidence<br \/>\nadduced on  behalf of  Respondent No.1\tthat he had resigned<br \/>\nfrom service at the relevant period and such resignation was<br \/>\nacceped. The High Court however, held that as the Respondent<br \/>\nNo.1 did  not hold  any &#8220;office\t of profit&#8221;  as contemplated<br \/>\nunder the  Representation Act,\tthe other question about his<br \/>\nresignation was\t immaterial. In our view, the question as to<br \/>\nwhether an  employee of Eastern Coal Fields Ltd. was holding<br \/>\nan &#8220;office  of profit&#8221;\tso as  to be disoualified to contest<br \/>\nelection under the Representation Act need not be gone into,<br \/>\nin view\t of the finding that the Respondent No.1 had in fact<br \/>\nresigned from  his service  at the  relevant period  and his<br \/>\nresignation was\t accepted by  the concerned  authority. Such<br \/>\nfinding, in  our view,\tin the\tfacts and circumstances does<br \/>\nnot warrant  any interference. We may indicate here that the<br \/>\nhearing of  this appeal\t was concluded\tshortly\t before\t the<br \/>\ngeneral election of Bihar State Assembly in 1995 and general<br \/>\nelection having\t been held  in the meantime, this appeal for<br \/>\nall practical purpose has lost its importance and has become<br \/>\ninfructuous.
