Block Development Officer, namely, Ashok Kumar, son of name not\n                known to the petitioner                 .....Opposite Parties\n\n                                                -----------\n<\/pre>\n<p>3      26-10-2010                       Heard      learned         counsel      for   the<\/p>\n<p>                           petitioner and learned counsel for the State.<\/p>\n<p>                                        We have no reasons to doubt the<\/p>\n<p>                           statement made in the show cause supported by<\/p>\n<p>                           affidavit of Opposite Party no.6, Additional<\/p>\n<p>                           Collector,     Nawadah             to   the       effect   that<\/p>\n<p>                           encroachment by way of cultivation in the river<\/p>\n<p>                           Dakhtari has been removed on a particular date.<\/p>\n<p>                                        The     petitioner         insists     that   the<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>        encroachment is still subsisting. It may be a case<\/p>\n<p>        of renewed encroachment by the neighboring<\/p>\n<p>        farmers. The petitioner would be at liberty to<\/p>\n<p>        approach the District Magistrate or the Collector<\/p>\n<p>        under the Act for taking further steps in the<\/p>\n<p>        matter in accordance with law. If so advised, the<\/p>\n<p>        petitioner   may     also   approach   the   higher<\/p>\n<p>        authorities for desilting or widening the river<\/p>\n<p>        Dakhtari. If such a representation is filed, the<\/p>\n<p>        same shall be considered on its own merit by the<\/p>\n<p>        concerned authorities.
