           Petitioner is the counter petitioner and<\/p>\n
first respondent the petitioner in                M.C.55\/1998 on the<\/p>\n
file of Judicial First Class Magistrate-II, Kannur.<\/p>\n
First respondent filed petition before the learned<\/p>\n
Magistrate claiming maintenance under Section 125 of<\/p>\n
Code of Criminal Procedure contending that his                mother<\/p>\n
had married one Haridasan, but they separated in 1995<\/p>\n
and petitioner was      immediate neighbour of the mother<\/p>\n
of first respondent and        petitioner assured the mother<\/p>\n
of first respondent that he                would marry her      the<\/p>\n
moment she gets divorce and on the inducement and<\/p>\n
believing   the said representation, petitioner had<\/p>\n
continuous sexual      intercourse with the               mother of<\/p>\n
first respondent which lead to the birth of first<\/p>\n
respondent on 23\/8\/1997. When the pregnancy of first<\/p>\n
respondent was revealed        to the family members,          there<\/p>\n
was  a  mediation      organised          at     Kattiattoor   Grama<\/p>\n
Panchayat Hall in the presence of panchayat member<\/p>\n

Sri.K.Nanu and in the mediation, petitioner had<\/p>\n
acknowledged paternity of the child and expressed<\/p>\n
his willingness to maintain  him and   an agreement<\/p>\n
was also entered into in the presence of the<\/p>\n
mediators and later petitioner failed to take care<\/p>\n
of the     mother or marry her and even refused to<\/p>\n
pay maintenance. In such circumstances, minor child<\/p>\n
had   sought maintenance at the rate of Rs.10,000\/-<\/p>\n
per month.\n<\/p>\n
            2.  Petitioner  resisted   the    claim<\/p>\n
contending that he is not the father of first<\/p>\n
respondent and he never assured the mother of the<\/p>\n
first respondent that he will    marry her and he<\/p>\n
never had sexual intercourse   with her and he is<\/p>\n
not liable to pay any maintenance. It is contended<\/p>\n
that first respondent was born to her in her<\/p>\n
wedlock     with  Haridasan and petitioner    is a<\/p>\n
married man and his marriage was solemnised on<\/p>\n
24\/5\/1998 and hence, he is not liable to pay<\/p>\n
maintenance.\n<\/p>\n
            3.  Before the learned Magistrate four<\/p>\n
witnesses including mother and previous husband of<\/p>\n
the mother were examined and two exhibits were<\/p>\n

marked. On the side of the petitioner, he was<\/p>\n
examined    as  CPW1.   Learned  Magistrate  on  the<\/p>\n
evidence found that though PW4 was the former<\/p>\n
husband of the mother of first respondent, from<\/p>\n
1995 onwards they were living separately and     non<\/p>\n
access of     PW4  to  the  mother  was conclusively<\/p>\n
established and therefore, the bar provided under<\/p>\n
Section 112 of the Indian Evidence Act is not<\/p>\n
applicable. Accepting the evidence of      mother as<\/p>\n
PW1 and as well as her brother PW2 and panchayat<\/p>\n
member, who was examined as PW3 and taking note of<\/p>\n
the refusal of the petitioner to undergo DNA test,<\/p>\n
learned Magistrate found that petitioner is the<\/p>\n
father of the minor child. He was directed to pay<\/p>\n
monthly     maintenance   of   Rs.400\/-.  Petitioner<\/p>\n
challenged that order before the Sessions court,<\/p>\n
Thalassery in Crl.R.P.15\/2002. Learned    Additional<\/p>\n
Sessions Judge re-appreciated the entire evidence<\/p>\n
and   confirmed    the  findings   of   the  learned<\/p>\n
Magistrate and dismissed the revision. As no second<\/p>\n
revision is permissible, this petition is filed<\/p>\n
under Section 482 of Code of Criminal Procedure<\/p>\n
challenging Annexure-A4 order of learned Magistrate<\/p>\n

\n                               4<\/span><\/p>\n
and Annexure-A5 order of learned Sessions Judge.<\/p>\n
            4.   Learned counsel appearing for the<\/p>\n
petitioner was heard. Learned counsel argued that<\/p>\n
evidence of PW1, mother of the child establishes<\/p>\n
that   she used to meet PW4, her former husband and<\/p>\n
in such circumstances, finding about non access is<\/p>\n
not sustainable. It is found that when there was a<\/p>\n
subsisting legal marriage and non access was not<\/p>\n
proved, courts below should have found that first<\/p>\n
respondent is the son of PW4    born to PW1. Learned<\/p>\n
counsel    also  argued  that  additional  documents<\/p>\n
produced before this court namely, copy of the<\/p>\n
admission form of first respondent submitted to the<\/p>\n
school dated 2\/6\/2003 does not show petitioner as<\/p>\n
the father of the child and in such circumstances,<\/p>\n
it is to be found that petitioner is not the<\/p>\n
father.\n<\/p>\n
            5.   On hearing the learned counsel and<\/p>\n
going through Annexures-A4 and A5 judgments of the<\/p>\n
learned Magistrate and learned Sessions Judge, I<\/p>\n
find no reason to interfere with the orders passed<\/p>\n
by   the    learned  Magistrate or  the   Additional<\/p>\n
Sessions Judge, invoking extra ordinary powers of<\/p>\n

this court under Section 482 of Code of Criminal<\/p>\n
Procedure. True,    so long as   a legal  marriage<\/p>\n
subsists, in view of Section 112 of Evidence Act,<\/p>\n
first respondent mother cannot claim that father of<\/p>\n
the child is not her    husband but somebody else.<\/p>\n
But, if non access is proved, Section 112 will not<\/p>\n
be a bar. That exactly is the case herein. Learned<\/p>\n
Magistrate and learned Sessions Judge accepted the<\/p>\n
evidence of the mother who was examined as PW1 and<\/p>\n
her previous husband who was examined as PW4 and<\/p>\n
found that   there was no connection between   them<\/p>\n
during the period when first respondent was born or<\/p>\n
begotten and evidence establish that there was<\/p>\n
complete non access.     Accepting the evidence of<\/p>\n
Pws.1 and 2, it was found that during that period<\/p>\n
petitioner was having sexual relationship with the<\/p>\n
mother of first respondent and first respondent was<\/p>\n
born in that relationship.     Additional documents<\/p>\n
sought to be produced by the petitioner does not<\/p>\n
establish that petitioner is not     father of the<\/p>\n
child. At best, it could be said that in the<\/p>\n
columns where    details of the parents are to be<\/p>\n
shown,    for getting admission to first respondent<\/p>\n

\n                               6<\/span><\/p>\n
to   the   school,  mother     who had   signed the<\/p>\n
application form did not show the name of the<\/p>\n
petitioner    as father. But she has not shown any<\/p>\n
other name as the father. Therefore, failure to<\/p>\n
show name of the father in the application form by<\/p>\n
itself is not a ground to hold that child has no<\/p>\n
father or that petitioner is not the father of<\/p>\n
first    respondent.   Both  trial   Magistrate and<\/p>\n
Additional Sessions Judge appreciated the evidence<\/p>\n
in the proper perspective and correctly found that<\/p>\n
petitioner is the father of first respondent. I<\/p>\n
find no reason to differ with the findings or the<\/p>\n
orders of the learned Sessions Judge.<\/p>\n
            Petition is dismissed.\n<\/p>\n<\/p>\n
