{"id":12203,"date":"2004-12-01T00:00:00","date_gmt":"2004-11-30T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/sarjas-rai-ors-vs-bakshi-inderjit-singh-on-1-december-2004"},"modified":"2018-12-12T21:13:09","modified_gmt":"2018-12-12T15:43:09","slug":"sarjas-rai-ors-vs-bakshi-inderjit-singh-on-1-december-2004","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/sarjas-rai-ors-vs-bakshi-inderjit-singh-on-1-december-2004","title":{"rendered":"Sarjas Rai &amp; Ors vs Bakshi Inderjit Singh on 1 December, 2004"},"content":{"rendered":"<div class=\"docsource_main\">Supreme Court of India<\/div>\n<div class=\"doc_title\">Sarjas Rai &amp; Ors vs Bakshi Inderjit Singh on 1 December, 2004<\/div>\n<div class=\"doc_bench\">Bench: B.P.Singh, Arun Kumar<\/div>\n<pre>           CASE NO.:\nAppeal (civil)  6558 of 1999\n\nPETITIONER:\nSARJAS RAI &amp; ORS\n\nRESPONDENT:\nBAKSHI INDERJIT SINGH\n\nDATE OF JUDGMENT: 01\/12\/2004\n\nBENCH:\nB.P.SINGH &amp; ARUN KUMAR\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T\t\t\t<\/p>\n<p>\tWe have heard counsel for the parties.\n<\/p>\n<p>\tThis appeal by special leave is directed against the order of High Court of<br \/>\nDelhi in Regular Second Appeal No.12 of 1999 dated 12th April, 1999 whereby the<br \/>\nHigh Court dismissed the Second Appeal preferred by the appellant on a finding that<br \/>\nthere was no substantial question of law involved in the Second Appeal.\n<\/p>\n<p>\tThe Second Appeal arose from a suit filed by landlord-respondent for<br \/>\nperpetual and mandatory injunction against the appellants alleging that they had<br \/>\ncarried out certain structural changes in the premises let out to the<br \/>\n\t\t\t\t\t\t&#8230;2\/-\n<\/p>\n<p><span class=\"hidden_text\">\t\t\t-2-<\/span><\/p>\n<p>appellant whereby the premises were substantially damaged and some parts of the<br \/>\nbuilding developed cracks, it being an old building. It is not necessary for us to refer<br \/>\nin detail to the allegations made in the plaint. After examining the evidence the Trial<br \/>\nCourt came to the conclusion that the plaintiff had proved his case and this was a fit<br \/>\ncase for grant of permanent injunction. Accordingly, on 31.3.1998, the learned Civil<br \/>\nJudge passed a decree of mandatory injunction.\n<\/p>\n<p>\tAgainst the decree passed by the Trial Court an appeal was preferred<br \/>\nbefore the learned Senior Civil Judge, Tis Hazari, Delhi. By judgment and order dated<br \/>\n19.12.1998 the said appeal was dismissed.\n<\/p>\n<p>\tThe appellant then preferred a Second Appeal before the High Court of<br \/>\nDelhi being Regular Second Appeal  No.12 of 1999 which, as earlier noticed, was<br \/>\ndismissed by the High Court on a finding that no substantial question of law was<br \/>\ninvolved in the Second Appeal. Thereafter the petitioner preferred a special leave<br \/>\npetition and after<br \/>\n\t\t\t\t\t\t&#8230;3\/-\n<\/p>\n<p><span class=\"hidden_text\">\t\t\t-3-<\/span><\/p>\n<p>grant of special leave this appeal has been placed before us for disposal.\n<\/p>\n<p>\tAfter hearing the parties and going through the material placed before us<br \/>\nwe concur with the finding of the<br \/>\nHigh Court that this case does not involve any substantial question of law which<br \/>\ndeserved consideration under Section 100 CPC. All the findings recorded by the<br \/>\nCourts below are either pure findings of fact or at best mixed question of law and fact.<br \/>\nIt has been found as a fact by the Courts below that the floor of the shop was sought<br \/>\nto be changed and in that process the level of the floor has been brought down one<br \/>\nfeet below the road level. Similarly certain alterations were made in the structure by<br \/>\nremoving pillars with a view to give a wider frontage to suit the convenience of the<br \/>\nappellant. On the findings arrived at by the Courts below, no substantial question of<br \/>\nlaw arises. The High Court was therefore, justified in dismissing the Second Appeal.\n<\/p>\n<p>\tWe, therefore, find no merit in this appeal and the same is accordingly,<br \/>\ndismissed.\n<\/p>\n<p>\t\t\t\t\t\t&#8230;4\/-\n<\/p>\n<p><span class=\"hidden_text\">\t\t\t-4-<\/span><\/p>\n<p>\tCounsel for the appellants submitted before us that he is willing to obey<br \/>\nthe decree of the Courts below and comply with the directions contained therein. He<br \/>\nsubmitted that since execution has been laid he is under constant threat and warrant of<br \/>\nattachment has been issued. We have no doubt that if the appellant takes steps<br \/>\nforthwith to comply with the decree passed against him, the executing Court on being<br \/>\nsatisfied about his bona fide and genuineness, may grant him time to complete the<br \/>\nwork and permit the decree to be executed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sarjas Rai &amp;
