Justice K.SURENDRA MOHAN\n\n Dated :28\/01\/2011\n\n O R D E R\n<\/pre>\n<p>            R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n<\/p>\n<p>        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                  W.P.(Civil) No.1325 of 2011\n<\/p>\n<p>        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n         Dated this the 28th day of January, 2011<\/p>\n<p>                             Judgment<\/p>\n<p>Basant, J.\n<\/p>\n<p>      The petitioners are crusher operators and according to<\/p>\n<p>them, they are carrying on their business activity in due<\/p>\n<p>compliance of all the provisions of law. The raw materials are to<\/p>\n<p>be carried to the units and the products have to be removed from<\/p>\n<p>the units. This has been done in vehicles. The condition of the<\/p>\n<p>local road is not satisfactory. It is a P.W.D. road. The local people<\/p>\n<p>led by respondents 5 to 7 are causing illegal obstruction to the<\/p>\n<p>movement of the petitioners vehicles through the road. This,<\/p>\n<p>according to them, creates difficulties. They are unable to<\/p>\n<p>transact their business. Complaints before the police have not<\/p>\n<p>evoked any useful response. It is, in these circumstances, that<\/p>\n<p>the petitioners have come to this court. According to the<\/p>\n<p>petitioners, they had earlier contributed to the repair and<\/p>\n<p>improvement of the road. They are willing to co-operate with the<\/p>\n<p>authorities to further improve the road. But, at any rate, because<\/p>\n<p><span class=\"hidden_text\">WPC 1325\/2011                     2<\/span><\/p>\n<p>the condition of the road is bad, the petitioners alone cannot be<\/p>\n<p>discriminated and barred from using the road by people of the<\/p>\n<p>locality without any legal authority. It is in these circumstances<\/p>\n<p>prayed that appropriate directions may be issued.<\/p>\n<p>       2. Respondents 5 to 7 have entered appearance. They deny<\/p>\n<p>all allegations of malafide against them. According to them, it is a<\/p>\n<p>genuine case of the local public raising objection to the<\/p>\n<p>movement of the petitioners vehicles through the public road<\/p>\n<p>which leads to damage and deterioration of the roads. Because of<\/p>\n<p>the damage and deterioration of the roads, vehicular traffic<\/p>\n<p>through the road has practically become impossible. Passenger<\/p>\n<p>vehicles are not being plied along the road. Vehicles belonging to<\/p>\n<p>the petitioners alone are moving along the road leading to further<\/p>\n<p>damage and deterioration of the road. In these circumstances,<\/p>\n<p>the local people are only peacefully demonstrating against the<\/p>\n<p>possibility of further damage and deterioration of the road and<\/p>\n<p>highlighting the need to repair and improve the road, contends<\/p>\n<p>the learned counsel.\n<\/p>\n<p>       3. The learned Government Pleader submits that according<\/p>\n<p>to respondents 1 to 3, the condition of the road is bad. It<\/p>\n<p><span class=\"hidden_text\">WPC 1325\/2011                   3<\/span><\/p>\n<p>deserves to be repaired and improved. But respondents 5 to 7<\/p>\n<p>cannot be permitted to take law into their hands and prevent the<\/p>\n<p>operation of the petitioners vehicles. Needful shall be done if<\/p>\n<p>there is any illegal obstruction to the movement of vehicles,<\/p>\n<p>submits the learned Government Pleader.\n<\/p>\n<p>     4. We have considered all the relevant inputs. The right of<\/p>\n<p>respondents 5 to 7 to peacefully demonstrate and lead an<\/p>\n<p>agitation for the proper improvement and maintenance of the<\/p>\n<p>road cannot be disputed. At the same time, they cannot be<\/p>\n<p>permitted to take law into their hands and obstruct traffic along<\/p>\n<p>the road in their discretion. We accept the submission of the<\/p>\n<p>learned Government Pleader on behalf of respondents 1 to 3 that<\/p>\n<p>necessary action shall be taken to abate any such unlawful<\/p>\n<p>objection.\n<\/p>\n<p>     5. We should think that ideally the authorities concerned<\/p>\n<p>must immediately take action to repair and improve the road. If<\/p>\n<p>the same is not immediately possible, for a limited period of time,<\/p>\n<p>barring heavy vehicular traffic through the road can be<\/p>\n<p>considered in accordance with law. At any rate, the members of<\/p>\n<p>the local public cannot be permitted to illegally obstruct<\/p>\n<p><span class=\"hidden_text\">WPC 1325\/2011                     4<\/span><\/p>\n<p>movement of the vehicles along with the public road. We accept<\/p>\n<p>the submissions of the learned Government Pleader that<\/p>\n<p>necessary police protection shall be afforded for movement of the<\/p>\n<p>vehicles belonging to the petitioners. No further orders are<\/p>\n<p>necessary in this petition in the light of the stand taken by the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p>     6.
