In view of the fact that the usage of sonography<br \/>\n\tmachine is expressly restricted and in that view of the matter,<br \/>\n\tlearned advocate has submitted that accused may not insist for<br \/>\n\treleasing of the machine in question but let there be appropriate<br \/>\n\tdirection for preserving the machine in appropriate condition and<br \/>\n\tthe criminal case be ordered to be decided within stipulated time as<br \/>\n\tit is pending since 2006. He further submitted that if such<br \/>\n\tdirection is issued, the accused and advocate representing him would<br \/>\n\tcooperate and would avoid unnecessary adjournments.\n<\/p>\n<p>In<br \/>\n\tview of this, the Criminal Misc. Application as well as Criminal<br \/>\n\tRevision Application are disposed of with following directions:\n<\/p>\n<p>The<br \/>\n\torders impugned in Criminal Revision Application are quashed and set<br \/>\n\taside and the order of learned Magistrate would also now not survive<br \/>\n\tin view of the express concession of learned advocate given for the<br \/>\n\taccused. The authority in whose custody the machine is lying shall<br \/>\n\ttake all due precaution for keeping it and shall take all precaution<br \/>\n\tso it may not be subjected to undue wear and tear and may not be<br \/>\n\tsubjected to any hazardous handling.\n<\/p>\n<p>The<br \/>\n\tcriminal case is of the year 2006 and therefore, it is in the<br \/>\n\tfitness of thing to give direction to dispose of the same as early<br \/>\n\tas possible preferable within 6 months from the date of receipt of<br \/>\n\twrit.\n<\/p>\n<p>With<br \/>\n\tthese observations, Criminal Misc. Application as well as Criminal<br \/>\n\tRevision Application are disposed of. Rule is made absolute in<br \/>\n\tCriminal Revision Application No. 545 of 2008. Liberty to approach<br \/>\n\tthe Court in case of difficulties.
