KOSHY, Ag.C.J. &amp;\n                          V.GIRI, J.\n             -----------------------------------------\n                   W.A.No.476 of 2009\n             -----------------------------------------\n           Dated this the 3rd day of March, 2009.\n\n                        JUDGMENT\n<\/pre>\n<p>GIRI, J.\n<\/p>\n<p>         The petitioner, the Managing Director of a Private<\/p>\n<p>Limited Company, filed the writ petition challenging Ext.P3,<\/p>\n<p>insofar as it contained a demand for surcharge.         He also<\/p>\n<p>sought for a declaration that the Electricity Board which had<\/p>\n<p>issued Ext.P3 is not entitled to recover the said amount in<\/p>\n<p>view of Section 56(2) of the Electricity Act {for short &#8220;the<\/p>\n<p>Act&#8221;}. There was an alternative prayer for permission to pay<\/p>\n<p>the amount as shown in Ext.P2 in 50 instalments excluding<\/p>\n<p>surcharge. Learned single Judge repelled the contention and<\/p>\n<p>dismissed the writ petition. Hence this writ appeal.<\/p>\n<p>         2. The appellant\/petitioner is Managing Director of<\/p>\n<p>Cannanore Roller Flour Mills Private Limited, Kannur. It has<\/p>\n<p>an LT IV connection. The multiplication factor adopted by<\/p>\n<p>W.A.No.476 of 2009<\/p>\n<p>                              :: 2 ::\n<\/p>\n<p>\nthe Board in relation to the consumer is 40. But for some<\/p>\n<p>reason, during the period from September, 2005 to October,<\/p>\n<p>2008, 20 was adopted as the multiplication factor instead of<\/p>\n<p>40. It naturally resulted in short levy of charges actually due<\/p>\n<p>from the consumer.        On realising the mistake, Ext.P2<\/p>\n<p>additional invoice was issued. The petitioner did not have any<\/p>\n<p>dispute as regards the actual charges payable under Ext.P2.<\/p>\n<p>But, the petitioner prayed for facility to pay the said amount<\/p>\n<p>in instalments. Though the petitioner requested for 50<\/p>\n<p>instalments, the Board granted only 24 instalments as<\/p>\n<p>evidenced by Ext.P3. But, since the instalment facility was<\/p>\n<p>granted, the Board also levied surcharge on such charges,<\/p>\n<p>commencing from the second instalment. The writ petition<\/p>\n<p>was filed essentially challenging the levy of surcharge on the<\/p>\n<p>instalments so levied under Ext.P2.      Learned single Judge<\/p>\n<p>repelled the contention and hence this appeal.<\/p>\n<p>         3. The only point that has been urged in this appeal<\/p>\n<p>is that the additional invoice came to be issued, not on<\/p>\n<p>W.A.No.476 of 2009<\/p>\n<p>                               :: 3 ::\n<\/p>\n<p>\naccount of the fault of the consumer, but on account of the<\/p>\n<p>fault committed by the Board.        Therefore, surcharge ought<\/p>\n<p>not to have been levied thereon. It is true that adoption of<\/p>\n<p>20 as a multiplication factor instead of 40, was not on account<\/p>\n<p>of the mistake that can be attributed to the consumer and<\/p>\n<p>therefore, if surcharge has been levied for the period up to<\/p>\n<p>the detection of the mistake, then as rightly noted by the<\/p>\n<p>learned single Judge, the contention raised by the consumer<\/p>\n<p>in that regard would have merited acceptance, but what<\/p>\n<p>happened in the instant case is that on realising the mistake,<\/p>\n<p>an additional invoice is issued. The said additional invoice, as<\/p>\n<p>evidenced by Ext.P2 was comprised only of the short<\/p>\n<p>collection of current charges along with the leviable duty<\/p>\n<p>thereon.    Had the petitioner, on realising the mistake,<\/p>\n<p>remitted the amount due under Ext.P2, then he would not<\/p>\n<p>have faced the demand for surcharge which is actually<\/p>\n<p>interest on belated payment. But such surcharge is imposed<\/p>\n<p>under Ext.P3 only because the appellant requested for<\/p>\n<p>W.A.No.476 of 2009<\/p>\n<p>                              :: 4 ::\n<\/p>\n<p>\ninstalments. Therefore, though the amount became payable,<\/p>\n<p>at least, on the service of demand under Ext.P2, the<\/p>\n<p>appellant was granted the facility to pay the same in 24<\/p>\n<p>instalments. Such a facility obviously could be availed, only if<\/p>\n<p>the consumer was ready to pay interest on such belated<\/p>\n<p>payments. Interest is levied only for the period subsequent to<\/p>\n<p>the service of the demand notice and not for the period prior<\/p>\n<p>thereto.   If that be so, the imposition of surcharge under<\/p>\n<p>Ext.P3, which is only another name for interest on belated<\/p>\n<p>payments is perfectly justified.\n<\/p>\n<p>          4. The other contention raised before the learned<\/p>\n<p>single Judge under Section 56(2) of the Act really does not<\/p>\n<p>arise for consideration in the facts and circumstances of the<\/p>\n<p>case. The contention regarding the bar of limitation arising<\/p>\n<p>under Section 56(2) of the Act was raised only in relation to<\/p>\n<p>the imposition of surcharge.      The surcharge came to be<\/p>\n<p>imposed only on acceptance of the appellant&#8217;s demand for<\/p>\n<p>facility to pay the amount due under Ext.P2 in instalments.<\/p>\n<p>W.A.No.476 of 2009<\/p>\n<p>                               :: 5 ::\n<\/p>\n<p>\nThe appellant had not disputed his liability to pay the<\/p>\n<p>amounts due under Ext.P2.\n<\/p>\n<p>          We are in complete agreement with the findings of<\/p>\n<p>the learned single Judge. We see no merit in this appeal and<\/p>\n<p>accordingly, the same is dismissed. The appellant is granted<\/p>\n<p>time upto 15.03.2009 to pay the 3rd instalment.
