With the consent of learned advocates<br \/>\nappearing on behalf of the respective parties, the matter is taken up<br \/>\nfor final hearing today.\n<\/p>\n<p>\tIn<br \/>\nthis petition, the petitioner has challenged order dated 17.9.2007<br \/>\nwhereby, the appropriate Government i.e. respondent No.1 declined to<br \/>\nrefer the petitioner&#8217;s dispute for adjudication on the ground that<br \/>\nthe dispute was raised belatedly after almost 11 years.\n<\/p>\n<p>\tIt<br \/>\nis the case of the petitioner that his service came to be terminated<br \/>\nw.e.f. 1.11.1994 without following procedure prescribed by law.<br \/>\nAggrieved by the said action, the petitioner approached the<br \/>\nauthorities under the Industrial Dispute Act, 1947 and conciliation<br \/>\nproceedings resulted into failure. As per the submission of the<br \/>\npetitioner, the conciliation officer forwarded the failure report to<br \/>\nthe appropriate Government pursuant to which, the appropriate<br \/>\nGovernment was expected to take decision about the request for<br \/>\nreferring the dispute for adjudication to the labour court or<br \/>\ntribunal as the case may be. However, the respondent No.1 declined to<br \/>\nmake Order of reference citing the ground of delay in raising<br \/>\nindustrial dispute.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Pathak appears for the petitioner and Ms. Dawawala appears for the<br \/>\nrespondents.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Pathak submitted that it is not within the jurisdiction of the<br \/>\nrespondent No.1 to decide as to whether the dispute should be<br \/>\nrejected on the ground of delay or not inasmuch as such decision<br \/>\nwould fall within the jurisdiction of the labour court or tribunal<br \/>\nand considering the facts and circumstances, the labour court or the<br \/>\ntribunal may  instead of rejecting the reference on any ground<br \/>\nincluding the ground of delay, even appropriately mould the relief<br \/>\nwhile taking decision regarding the relief that may be prayed for by<br \/>\nthe petitioner in reference proceedings. Mr. Pathak submitted that<br \/>\nthe law in this regard is well settled since the judgment of the<br \/>\nHon&#8217;ble Apex Court in case of Telco Convoy Drivers Mazdoor Sangh &amp;<br \/>\nAnother V\/s. State of Bihar &amp; Others reported in AIR 1989<br \/>\nSC 1565. Mr. Pathak also relied upon the judgment reported in<br \/>\n2006 (3) GLR 2591.\n<\/p>\n<p>\tMs.\n<\/p>\n<p>Dawawala  submitted    that   the petitioner   has raised a  stale<br \/>\ndispute  after   almost  11 years since    the  alleged  termination<br \/>\nand the respondent No.1 therefore, cannot be said to have made any<br \/>\nerror in declining to refer such stale dispute.\n<\/p>\n<p>\tThe<br \/>\nsaid submission of Ms. Dawawala is not in consonance with the<br \/>\nposition settled by the judgment of the Hon&#8217;ble Apex Court and also<br \/>\nof this court. It may be that after considering the relevant facts<br \/>\nand circumstances involved in the matter, the labour court also may<br \/>\ntake the same view or the labour court may mould the relief while<br \/>\npassing award in the reference but it is a matter of labour court&#8217;s<br \/>\njurisdiction to take decision on this count and it is not within the<br \/>\njurisdiction of the respondent No.1 to decide such issue. In this<br \/>\nregard, it is relevant to take note of the below mentioned<br \/>\nobservations of the Hon&#8217;ble Apex Court :-\n<\/p>\n<p>\t AIR<br \/>\n1989 SC 1565<\/p>\n<p>?S11.\t\tIt<br \/>\nis true that in considering the question of making a reference under<br \/>\nSection 10(1), the Government is entitled to form an opinion as to<br \/>\nwhether an industrial dispute ?Sexists or is apprehended??, as<br \/>\nurged by Mr. Shanti Bhusan. The formation of opinion as to whether an<br \/>\nindustrial dispute ?Sexists or is apprehended?? is not the same<br \/>\nthing as to adjudicate the dispute itself on its merits. In the<br \/>\ninstant case, as already stated, the dispute is as to whether the<br \/>\nconvoy drivers are employees or workmen of TELCO, that is to say,<br \/>\nwhether there is relationship of employer and employees between TELCO<br \/>\nand the convoy drivers. In considering the question whether a<br \/>\nreference should be made or not, the Deputy Labour Commissioner<br \/>\nand\/or the Government have held that the convoy drivers are not<br \/>\nworkmen and, accordingly, no reference can be made. Thus, the dispute<br \/>\nhas been decided by the Government which is, undoubtedly not<br \/>\npermissible.\n<\/p>\n<p>12.\t\tIt<br \/>\nis, however, submitted on behalf of TELCO that unless there is<br \/>\nrelationship of employer and employees or, in other words, unless<br \/>\nthose who are raising the disputes are workmen, there cannot be any<br \/>\nexistence of industrial dispute within the meaning of the term as<br \/>\ndefined in Section 2(k) of the Act. It is urged that in order to form<br \/>\nan opinion as to whether an industrial dispute exists or is<br \/>\napprehended, one of the factors that has to be considered by the<br \/>\nGovernment is whether the persons who are raising the disputes are<br \/>\nworkmen or not within the meaning of the definition as continued in<br \/>\nSection 2(k) of the Act.\n<\/p>\n<p>13.\t\tAttractive<br \/>\nthough the contention is, we regret, we are unable to accept the<br \/>\nsame. It is now well settled that, while exercising power under<br \/>\nSection 10(1) of the Act, the function of the appropriate Government<br \/>\nis an administrative function and not a judicial or quasi judicial<br \/>\nfunction, and that in performing this administrative function the<br \/>\nGovernment cannot delve into the merits of the dispute and take upon<br \/>\nitself the determination of the lis, which would certainly be excess<br \/>\nof the power conferred on it by Section 10 of the Act.??\n<\/p>\n<p><span class=\"hidden_text\">\t 1999<\/span><\/p>\n<p>(6) SCC 82<\/p>\n<p>?S10.\t\tIt<br \/>\nfollows, therefore, that the provisions of Article 137 of the<br \/>\nSchedule to the Limitation Act, 1963 are not applicable to the<br \/>\nproceedings under the Act and that the relief under it cannot be<br \/>\ndenied to the workman merely on the ground of delay. The plea of<br \/>\ndelay if raised by the employer is required to be proved as a matter<br \/>\nof fact by showing the real prejudice and not as a merely<br \/>\nhypothetical defence. No reference to the Labour Court can be<br \/>\ngenerally questioned on the ground of delay alone. Even in a case<br \/>\nwhere the delay is shown to be existing, the tribunal, labour court<br \/>\nor board, dealing with the case can appropriately mould the relief by<br \/>\ndeclinning to grant back wages to the workman till the date he raised<br \/>\nthe demand regarding his illegal retrenchment \/ termination or<br \/>\ndismissal. The court may also in appropriate cases direct the payment<br \/>\nof part of the back wages instead of full back wages.??\n<\/p>\n<p>\tConsidering<br \/>\nthe aforesaid aspects, the petition is partly allowed. The order<br \/>\ndated 17.9.2007 (Annexure ?  C) is set aside and the matter is<br \/>\nremanded to the respondent No.1 for taking appropriate decision in<br \/>\naccordance with settled legal position by keeping in focus the<br \/>\njudgments of the Hon&#8217;ble Apex Court. It is expected that the<br \/>\nrespondent No.1 shall take necessary decision, after hearing the<br \/>\npetitioner and concerned respondents, as early as possible.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid observations and direction, present petition is partly<br \/>\nallowed. Rule made absolute to the aforesaid extent.
