The present revision petition has been filed by<br \/>\nthe petitioner Vinod Kumar challenging the order dated<br \/>\nSeptember 16, 1992 passed by the learned Additional<br \/>\nSessions Judge, Hisar whereby the summoning order dated<br \/>\nAugust 14, 1991 passed by the learned Judicial Magistrate<br \/>\nIst Class, Hisar in a complaint filed under Sections<br \/>\n323, 504, 506, 403, 406, 34 IPC has been set aside.\n<\/p>\n<p>2. The petitioner Vinod Kumar had filed a<br \/>\ncomplaint against the respondents, namely, M.R. Sapra and<br \/>\nDaya Nand under the aforesaid sections. As per the<br \/>\ncomplainant, he is a partner of M\/s. Prema &amp; Sons, Hisar<br \/>\nand carrying on the business of the plywood, glasses etc.<br \/>\nAccording to the complainant, he had supplied some<br \/>\nbuilding material, namely, the glasses, plywood etc. for<br \/>\na new building to the respondent Sapra Hospital, Hisar.<br \/>\nThe aforesaid goods were worth Rs. 45,000\/- and out of this<br \/>\nhe had been paid an amount of Rs. 22,000\/- and the<br \/>\nremaining amount was still due. On July 12, 1990, the<br \/>\ncomplainant went to the hospital of respondent No. 1 where<br \/>\nrespondent No. 1 was present and the complainant demanded<br \/>\nmoney and thereupon respondent No. 1 told him as to why he<br \/>\nhad come to demand the money. The complainant told him<br \/>\nthat he is a small shopkeeper, therefore, he had to demand<br \/>\nmoney in order to run his business. Upon this, respondent<br \/>\nNo. 1 felt annoyed and told the complainant that he would<br \/>\nget him arrested. It is also alleged by the complainant<br \/>\nthat respondent No. 1 abused him and also summoned Daya<br \/>\nNand and both of them thereafter gave fist and leg blows<br \/>\nto him. Accordingly, the complaint in question was filed.<br \/>\nAfter the preliminary inquiry, the respondents were<br \/>\nsummoned by the learned Judicial Magistrate Ist Class vide<br \/>\norder dated August 14, 1991 under Sections 323\/504\/506 read<br \/>\nwith Section 34 IPC. The aforesaid summoning order was<br \/>\nchallenged by the respondents by filing a revision<br \/>\npetition before the learned Sessions Judge. Vide order<br \/>\ndated September 16, 1992, the learned Additional Sessions<br \/>\nJudge, Hisar set aside the aforesaid summoning order. The<br \/>\npetitioner is now aggrieved against the aforesaid order<br \/>\npassed by the learned Additional Sessions Judge and has<br \/>\napproached this court through the present revision<br \/>\npetition.\n<\/p>\n<p>3. I have heard Shri Ashok Aggarwal, the learned<br \/>\nsenior counsel for the petitioner, Shri Ajai Lamba, the<br \/>\nlearned counsel for respondent No. 1 and 2 and Shri Rajbir<br \/>\nSehrawat, the learned Deputy Advocate General, Haryana for<br \/>\nrespondent No. 3.\n<\/p>\n<p>4. At the outset, Shri Ajai Lamba, the learned<br \/>\ncounsel appearing for respondent No. 1 and 2 has brought<br \/>\nto my notice a copy of the judgment dated December 21, 1998<br \/>\npassed by the learned Chief Judicial Magistrate, Hisar,in<br \/>\na criminal complaint filed by Dr. M.R. Sapra under Sections<br \/>\n420, 452, 504, 506, 34 IPC whereby the petitioner Vinod Kumar<br \/>\nalongwith Parmod Kumar had been convicted under Sections<br \/>\n452, 420, 506 read with Section 34 IPC. However, the said<br \/>\npersons were ordered to be released on probation vide<br \/>\norder dated December 21, 1998 passed by the learned Chief<br \/>\nJudicial Magistrate, Hisar. Shri Lamba has also placed on<br \/>\nrecord a certified copy of the judgment dated February<br \/>\n26, 2002 passed by the learned Additional Sessions Judge,<br \/>\nHisar whereby the aforesaid order of probation granted by<br \/>\nthe learned Chief Judicial Magistrate, Hisar has been set<br \/>\naside and the petitioner Vinod Kumar and aforesaid Parmod<br \/>\nKumar have been convicted and sentenced to undergo<br \/>\nrigorous imprisonment for 1-1\/2 years and pay a fine of<br \/>\nRs. 1,000\/- under Section 420 IPC, rigorous imprisonment<br \/>\nfor a period of 1-1\/2 years and to pay a fine of<br \/>\nRs. 1,000\/- under Section 452 IPC and rigorous imprisonment<br \/>\nfor a period of six months under Section 506 IPC.\n<\/p>\n<p>5. It is submitted by Shri Ajai Lamba, the learned<br \/>\ncounsel for respondent No. 1 and 2 that since the version<br \/>\nput up by the respondents has been accepted by the learned<br \/>\nCourts below, therefore, it could not be taken that the<br \/>\nimpugned order passed by the learned Additional Sessions<br \/>\nJudge in any manner is improper under the circumstances of<br \/>\nthe case.\n<\/p>\n<p>6. I have given my thoughtful consideration to the<br \/>\nentire matter.\n<\/p>\n<p>7. I have also gone through the order dated<br \/>\nSeptember 16, 1992 passed by the learned Additional<br \/>\nSessions Judge, Hisar setting aside the summoning order<br \/>\npassed by the learned trial Magistrate. In my considered<br \/>\nopinion, the aforesaid order passed by the learned<br \/>\nAdditional Sessions Judge does not suffer from any<br \/>\ninfirmity. Further I do not find that any impropriety has<br \/>\nbeen committed by the learned Additional Sessions Judge.<br \/>\nEven otherwise, the version put up by the respondents has<br \/>\nbeen duly accepted by the learned Chief Judicial<br \/>\nMagistrate while pronouncing the judgment dated December<br \/>\n21, 1998 convicting the present petitioner alongwith one<br \/>\nParmod Kumar.\n<\/p>\n<p>8. In this view of the matter, no interference is<br \/>\ncalled for in the present petition.
