         Petitioner, the third accused in<\/p>\n
Crime  No.469\/CR\/S1\/04                  of        Narcotic     and<\/p>\n
Economic Offences, Cell, Thiruvananthapuram<\/p>\n
filed this petition under Section 482 of<\/p>\n
Code of Criminal Procedure                     contending that<\/p>\n
though the petitioner has been implicated<\/p>\n
as an accused, he has nothing to do with<\/p>\n
the offence and there is nothing to connect<\/p>\n
the petitioner with the offence and in such<\/p>\n
circumstances, it is not in the interest of<\/p>\n
justice  to       continue               the          prosecution.<\/p>\n
Petitioner   would         contend             that     he  is  a<\/p>\n
building contractor and has been implicated<\/p>\n
on the allegation that Renjitha Subramanian<\/p>\n
was arrested by              Emigration Authorities,<\/p>\n
Crmc 4334\/10               2<\/span><\/p>\n
International      Airport,  Thiruvananthapuram  on<\/p>\n
19\/11\/2004      on the allegation of possessing a<\/p>\n
forged emigration clearance endorsement      in her<\/p>\n
passport and the said Renjitha disclosed that<\/p>\n
visa and air ticket were arranged by one Rafeeq<\/p>\n
of National Travels and Vijay Nair of Shine<\/p>\n
Associates and one Babu      who is her neighbour.<\/p>\n
It is on that basis the petitioner has been<\/p>\n
implicated      as  an   accused  and  though   the<\/p>\n
incident      was  in  2004, till  this  day  final<\/p>\n
report has not been submitted and nothing was<\/p>\n
collected      to   implicate  him   and  in   such<\/p>\n
circumstances,        prosecution    against    the<\/p>\n
petitioner is to be quashed.\n<\/p>\n
            2.   Learned  counsel appearing for the<\/p>\n
petitioner and learned Public Prosecutor       were<\/p>\n
heard.\n<\/p>\n
            3.   Learned  counsel appearing for the<\/p>\n
petitioner      pointed  out   that  even  if   the<\/p>\n
Crmc 4334\/10               3<\/span><\/p>\n
statement of Renjitha is accepted, in the light<\/p>\n
of     her     statement   shown  in    Annexure-C,<\/p>\n
petitioner cannot be implicated, as at best, it<\/p>\n
could       only  be  said   that  the   petitioner<\/p>\n
introduced Renjitha to a travel agency but he<\/p>\n
did not take part further in the transaction<\/p>\n
and in such circumstances, the case against the<\/p>\n
petitioner is to be quashed.\n<\/p>\n
            4. Learned   Public  Prosecutor      on<\/p>\n
verifying the case diary submitted that nothing<\/p>\n
was so far collected against the petitioner<\/p>\n
except       original   statement  that    Renjitha<\/p>\n
informed the petitioner that she needs a visa<\/p>\n
and    petitioner   introduced  her  to  Rafeeq  of<\/p>\n
National Travels. It is submitted that there is<\/p>\n
nothing further to show apart from the said<\/p>\n
statement that petitioner had anything to do<\/p>\n
with the transaction or received any benefit.<\/p>\n
            5. Annexure-C communication sent by the<\/p>\n
Crmc 4334\/10               4<\/span><\/p>\n
Port     Registration   Officer,  Thiruvananthapuram<\/p>\n
Airport      to the Sub Inspector of Police based<\/p>\n
on which Annexure-A FIR was registered shows<\/p>\n
that     on   19\/11\/2004  at  5.10  a.m    Renjitha,<\/p>\n
holding       Indian    passport    No.E   9513105,<\/p>\n
approached the Immigration counter          for her<\/p>\n
onward      journey  to  Muscat    by  Oman  Airways<\/p>\n
Flight,      for   employment   as   housemaid.   On<\/p>\n
verification Sub Inspector got suspicion about<\/p>\n
the genuineness of the         Emigration clearance<\/p>\n
endorsement, which is purported to be        issued<\/p>\n
by         the     Protector      of     Emigrance,<\/p>\n
Thiruvananthapuram. It was verified        with the<\/p>\n
specimen available      in the office to ascertain<\/p>\n
whether it is genuine. Finding that it is not<\/p>\n
genuine, Renjitha was questioned. She disclosed<\/p>\n
that her air ticket and visa were       arranged by<\/p>\n
one    Rafeeq    of  National  Travels,  East  Nada,<\/p>\n
Guruvayur and one Vijay Nair and Babu, her<\/p>\n
Crmc 4334\/10               5<\/span><\/p>\n
neighbour by paying Rs.25,000\/- and she is not<\/p>\n
aware of anything about the forged       Emigration<\/p>\n
clearance. It is based on the said statement,<\/p>\n
the petitioner was implicated       as an accused.<\/p>\n
The statement of Renjitha, recorded, reveals<\/p>\n
that       she  contacted   the   petitioner,   her<\/p>\n
neighbour to know whether she could get visa<\/p>\n
and he promised to introduce her to Rafeeq of<\/p>\n
National Travels. Petitioner introduced her to<\/p>\n
Rafeeq. There is nothing in the statement that<\/p>\n
the petitioner had anything to do with either<\/p>\n
the    visa   or  the  air  ticket  or  the  forged<\/p>\n
Emigration clearance. For the sole reason that<\/p>\n
the petitioner introduced Renjitha     to a travel<\/p>\n
agent, it cannot be said that the petitioner<\/p>\n
was a party to       the forgery committed. Learned<\/p>\n
Public      Prosecutor  also  submitted  that  case<\/p>\n
diary      does not contain anything to connect the<\/p>\n
petitioner      with   the   offence   except   the<\/p>\n
Crmc 4334\/10               6<\/span><\/p>\n
statement of Renjitha      referred to earlier. It<\/p>\n
is    to    be  born in  mind  that  the  case  was<\/p>\n
registered in 2004 and for more than six years,<\/p>\n
it is being investigated. Still, nothing could<\/p>\n
be collected to establish any connection        for<\/p>\n
the     petitioner   with  the   forged  Emigration<\/p>\n
clearance. In such circumstances, continuation<\/p>\n
of the case against petitioner is only an abuse<\/p>\n
of process of the Court.\n<\/p>\n
            Petition is allowed. Prosecution of the<\/p>\n
petitioner in Crime No.469\/CR\/S1\/04 of Narcotic<\/p>\n
and Economic Offences Cell, Thiruvananthapuram<\/p>\n
is quashed. But investigation against the other<\/p>\n
can be proceeded.\n<\/p>\n<\/p>\n
