Justice P.S.GOPINATHAN\n\n Dated :15\/05\/2009\n\n O R D E R\n                        P.S.GOPINATHAN, J.\n           ======================================\n                       B.A.No.2542 of 2009\n            ======================================\n                Dated this the 15th day of May 2009\n\n                              ORDER\n<\/pre>\n<p>      Petitioners are accused in Crime No.65 of 2009 of<\/p>\n<p>Ambalathara Police Station for the offences punishable under<\/p>\n<p>Sections 143, 147, 148, 452, 324, 326 and 308 read with<\/p>\n<p>Section 34 IPC. They were arrested on 20.4.2009 and produced<\/p>\n<p>before the Judicial First Class Magistrate I, Hosdurg. They were<\/p>\n<p>remanded to judicial custody.      Their application for bail was<\/p>\n<p>rejected by Annexure-A order for the reason that there is every<\/p>\n<p>chance for absconding and tampering the evidence. Now this<\/p>\n<p>petition.\n<\/p>\n<p>      2. Having heard either side, I find that it would be<\/p>\n<p>appropriate to grant bail on conditions.<\/p>\n<p>      3. In the result, this petition is allowed and there will be<\/p>\n<p>an order directing the petitioners to be released on bail on their<\/p>\n<p>executing a bond for Rs.50,000\/- (Rupees Fifty thousand only)<\/p>\n<p>each with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the Judicial First Class Magistrate I, Hosdurg on<\/p>\n<p>or after 20.5.2009 on the following conditions:-<\/p>\n<blockquote><p>    i)   The    petitioners    shall   report   before   the<\/p>\n<p>         Investigating Officer as and when required by<\/p>\n<p>         him.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A.No.2542 of 2009         2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>       ii)    The  petitioners shall not directly or indirectly<\/p>\n<p>            make any inducement, threat or promise to any<\/p>\n<p>            person acquainted with the facts of the case so as<\/p>\n<p>            to dissuade him from disclosing such facts to the<\/p>\n<p>            Court or to any police officer.<\/p><\/blockquote>\n<p>                                   P.S.GOPINATHAN, JUDGE<\/p>\n<p>css\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.R.Rajesh vs State Of Kerala on 15 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2542 of 2009() 1.
