(J)\n\nCITATION:\n 1996 AIR 1007\t\t  1996 SCC  (2)\t 66\n JT 1995 (9)   556\t  1996 SCALE  (1)9\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Two questions  arise in this appeal, namely,(1) whether<br \/>\nthe State  should hear the respondent\/employer before making<br \/>\na reference  on a  second representation under Section 10 of<br \/>\nIndustrial Disputes  Act, 1947\t(for short, `the Act&#8217;) since<br \/>\nit was\trejected on  an earlier\t occasion; and\t(2)  whether<br \/>\nthere is an order of reference by the State Government so as<br \/>\nto entitle  the appellant to have the dispute adjudicated by<br \/>\nthe tribunal.\n<\/p>\n<p>     The facts\tare not\t in dispute.  Way back\tin 1955, the<br \/>\nappellant had joined the respondents as a workmen (Khalasi).<br \/>\nHe was\tpromoted on  September 6,  1972 as a tape-reader. He<br \/>\nwas served  with a  chargesheet on  June 28,  1979  and\t his<br \/>\nservices were  terminated on  August 9,\t 1979. On  June\t 30,<br \/>\n1981, he  made\ta  demand  on  the  respondent\/employer\t for<br \/>\nreinstatement which  was rejected.  Thereafter, he  made  an<br \/>\napplication for reference under Section 10 of the Act to the<br \/>\nState Government  which was  rejected by order dated October<br \/>\n20, 1981. The appellant again made a representation on March<br \/>\n25, 1982  and the Minister made a note on the representation<br \/>\ndirecting  to\tmake  a\t  reference.   However,\t  since\t  no<br \/>\ncommunication was  received by\tthe appellant,\the  wrote  a<br \/>\nletter to  the Labour  Commissioner, Haryana,  on April\t 26,<br \/>\n1984 but  to no\t avail. He  then filed the writ petition. By<br \/>\norder dated  August 6,\t1984 in\t CWP No.  2885\/84, the\tHigh<br \/>\nCourt dismissed the writ petition.\n<\/p>\n<p>     The first\tquestion is  whether the State should give a<br \/>\nhearing to  the employer before making a reference on second<br \/>\napplication, since  on an earlier occasion, it was rejected.<br \/>\nSection 10(1)  of the Act provides that where an appropriate<br \/>\nGovernment is  of the  opinion that  any industrial  dispute<br \/>\nexists or  is apprehended,  it may, at any time, by order in<br \/>\nwriting refer  the dispute  to\tnamed  authorities.  Section<br \/>\n12(5)  of   the\t Act   postulates  that\t  on   receipt\t and<br \/>\nconsideration of  a report from the conciliation officer, if<br \/>\nthe Government\tis  satisfied  that  there  is\ta  case\t for<br \/>\nreference to  the Board,  Labour Court, Tribunal or National<br \/>\nTribunal, as  the case\tmay be,\t it may make such reference.<br \/>\nWhere the  appropriate\tGovernment  does  not  make  such  a<br \/>\nreference it  shall record  reasons therefor and communicate<br \/>\nto the parties concerned.\n<\/p>\n<p>     A conjoint\t reading,  therefore,  would  yield  to\t the<br \/>\nconclusion that\t on making  an application for reference, it<br \/>\nwould be  open to  the State  Government to  form an opinion<br \/>\nwhether industrial  dispute exists  or apprehended  and then<br \/>\neither to make a reference to the appropriate authorities or<br \/>\nrefuse to make the reference. Only on rejection thereof, the<br \/>\norder needs to be communicated to the applicant. Nonetheless<br \/>\nthe  order  is\tonly  an  administrative  order\t and  not  a<br \/>\nquasijudicial order.  When it rejects, it records reasons as<br \/>\nindicated in  sub-section (5)  of Section 12 of the Act. The<br \/>\nappropriate Government\tis entitled  to go into the question<br \/>\nwhether an  industrial dispute\texists or is apprehended. It<br \/>\nwould be  only a subjective satisfaction on the basis of the<br \/>\nmaterial on  record. Being an administrative order no lis is<br \/>\ninvolved. Thereby  there is  no need  to issue any notice to<br \/>\nthe employer  nor to  hear the\t employer  before  making  a<br \/>\nreference or  refusing to  make a reference. Sub-section (5)<br \/>\nof Section  12 of  the Act  does not  enjoin the appropriate<br \/>\nGovernment to  record reasons  for  making  reference  under<br \/>\nSection 10(1).\tIt enjoins  to record  reasons only  when it<br \/>\nrefuses to make a reference.\n<\/p>\n<p>     The need  for hearing  is obviated, if it is considered<br \/>\non second  occasion as\teven then  if it makes reference, it<br \/>\ndoes not  cease to  be an administrative order and so is not<br \/>\nincumbent  upon\t the  State  Government\t to  record  reasons<br \/>\ntherein. Therefore,  it is  not necessary to issue notice to<br \/>\nthe employer  nor to consider his objections not to hear him<br \/>\nbefore making  a reference.  Accordingly, we are of the view<br \/>\nthat the  High Court was wholly wrong in its conclusion that<br \/>\nbefore\tmaking\treference  on  second  application,  it\t was<br \/>\nincumbent upon\tthe State  Government to  give notice to the<br \/>\nemployer and  to give  an opportunity  to the  employer\t and<br \/>\nrecord reasons\tfor making  reference. The previous decision<br \/>\nof that\t Court relied  on in  the case\tat hand\t was wrongly<br \/>\ndecided.\n<\/p>\n<p>     The second\t question is  whether, as  a fact, reference<br \/>\nhas been  ordered by  the Government. It is seen that on the<br \/>\nearlier occasion  admittedly reference\twas rejected  on the<br \/>\nground that  the appellant  had settled\t the matter with the<br \/>\nemployer. In  the second  application, the  Minister made  a<br \/>\nnote directing\treference, but\tin  the\t order\tcommunicated<br \/>\nlater to  the appellant\t by the\t Labour Department,  it\t was<br \/>\nindicated that\tin view\t of the\t decision already taken, the<br \/>\nGovernment did\tnot consider  it necessary to reconsider the<br \/>\ndecision already  taken. In  other words,  they were  of the<br \/>\nopinion that  there  existed  no  industrial  dispute.\tThey<br \/>\ndeclined to  make reference  under Section 10(1). Therefore,<br \/>\nthere is  no reference,\t in fact,  made to  the\t appropriate<br \/>\nTribunal\/Labour Court or Industrial Tribunal.\n<\/p>\n<p>     In these  circumstances, we  cannot give  relief to the<br \/>\nappellant,  since   there  is\tno  reference  made  by\t the<br \/>\nGovernment. The appeal is disposed of accordingly.
