Justice K.SURENDRA MOHAN\n\n Dated :15\/10\/2009\n\n O R D E R\n        PIUS C.KURIAKOSE &amp; K.SURENDRA MOHAN, JJ.\n                      ------------------------\n                    L.A.A.No.1088 OF 2005\n                      ------------------------\n\n             Dated this the 15th day of October, 2009\n\n                           JUDGMENT\n<\/pre>\n<p>Pius C.Kuriakose, J.\n<\/p>\n<p>      This appeal by the Government pertains to acquisition of<\/p>\n<p>land in Nanminda Village in Kozhikode Taluk for the purpose of<\/p>\n<p>laying pipeline and for construction of water tanks. The nature of<\/p>\n<p>the land was wet land and the Land Acquisition Officer awarded<\/p>\n<p>land value at the rate of Rs.1493\/- per cent in this acquisition<\/p>\n<p>which was pursuant to notification dated 22\/6\/1998.       Exts.A1<\/p>\n<p>and A2 were the documents produced by the claimant in support<\/p>\n<p>of her claim for enhancement of land value.     Ext.A2, which was<\/p>\n<p>a post notification document, was executed three years<\/p>\n<p>subsequent to the date of Section 4 (1) notification. But, what<\/p>\n<p>the learned Sub Judge did was to make a deduction of 25% of<\/p>\n<p>Ext.A2 for the passage of time and to do guess work.      We are<\/p>\n<p>unable to approve the action of the learned Sub Judge in having<\/p>\n<p>relied on post notification document alone for the purpose of<\/p>\n<p>refixing the market value of the land. Of course, as pointed out<\/p>\n<p>by the learned counsel for the respondent Sri.V.Santharam, the<\/p>\n<p><span class=\"hidden_text\">LAA.No.1088\/2005                  2<\/span><\/p>\n<p>advocate commissioner had recommended for enhancement at<\/p>\n<p>the present rate.         But it is trite that when       advocate<\/p>\n<p>commissioners recommend for higher value, unless their<\/p>\n<p>recommendations are supported by the value reflected by the<\/p>\n<p>registered sale document and that registered document also<\/p>\n<p>placed on record, recommendations          are not to be accepted.<\/p>\n<p>Sri.Santharam     submitted that if opportunity is given, the<\/p>\n<p>respondent will be able to produce documents revealing higher<\/p>\n<p>land value at the relevant time.            Considering the above<\/p>\n<p>submission of the learned counsel for the claimant         we are<\/p>\n<p>inclined to grant opportunity.\n<\/p>\n<p>      2. The result is, accordingly, as follows;<\/p>\n<p>               i).   The judgment and decree under<\/p>\n<p>         appeal   are    set   aside   and   the  L.A.R.\n<\/p>\n<p>         No.5\/2001 is remanded back to the Sub<\/p>\n<p>         Court, Kozhikode. That court is directed to<\/p>\n<p>         permit both sides to adduce whatever further<\/p>\n<p>         evidence they want to in support of their<\/p>\n<p>         claim and to pass revised judgment on the<\/p>\n<p>         basis of the entirety of the evidence which<\/p>\n<p><span class=\"hidden_text\">LAA.No.1088\/2005                 3<\/span><\/p>\n<p>          comes on record.\n<\/p>\n<p>                ii). The revised judgment as directed<\/p>\n<p>          above shall be passed by the learned Sub<\/p>\n<p>          Judge at the earliest and at any rate within<\/p>\n<p>          five  months    of   the    parties entering<\/p>\n<p>          appearance pursuant to this order.\n<\/p>\n<p>               Iii).
