The delay of 259 days in filing the L.P.A. is condoned.\n\n2.   Heard learned counsel for the parties on merit.\n\n3.   The appellant was charge-sheeted and we have\n\nperused the charge as referred in the order (Annexure-8)\n\nand we are of the considered opinion that it is a case of\n\ngross indiscipline in the armed force as well as playing\n\nwith the security and further abusing the officers and not\n\naccepting   the    order       of   suspension     and    thereafter\n\nremaining absent from duty and before this incident of\n\n14.04.2006<\/pre>\n<p>, followed by the incident of 15.04.2006 and<\/p>\n<p>16.04.2006, the appellant was also found guilty on earlier<\/p>\n<p>occasion for the charge of threatening the higher officers.<\/p>\n<p>4.   Learned counsel for the appellant could not draw our<\/p>\n<p>attention   towards   unfairness       in   the   enquiry    or   not<\/p>\n<p>following the rule of procedure in the enquiry. The findings<\/p>\n<p>are based on the evidence and so far as quantum of<br \/>\n                  punishment is concerned, we are of the opinion that the<\/p>\n<p>                 awarded punishment cannot be said to be disproportionate<\/p>\n<p>                 to the guilt of the appellant. Therefore, learned Single<\/p>\n<p>                 Judge was wholly justified in dismissing the writ petition of<\/p>\n<p>                 the petitioner.
