4. Brief facts of the case are:\n<\/p>\n
3<\/span><\/p>\n
That on 10.03.2007, when the claimant
\nwas riding his motor cycle bearing registration No.<\/p>\n
KA–05–EG 2476 on Aralu Mallige Partha Sarathi____road<\/p>\n
near Girinagara traffic police station, a Scorpio-ijbeharing<\/p>\n
registration No. KA–~4l–~M~l451 came in  V’<\/p>\n
negligent manner and dashed a;gainst his <\/p>\n
as a result, he fell down and t1sustain_ed’~ .griey’ous’._V<\/p>\n
injuries. Hence, he filed  “p’etition:  the<\/p>\n
MACT, Bangalore,’  seekingilj\u00e9 ‘compensation of
\nRs.6,00,000\/~. The   judgment<\/p>\n
and award  of Rs.1,84,400\/..\n<\/p>\n
with interest   1 ,69,400\/–.\n<\/p>\n
5. 51′-\\.-sop there’ ‘is’: no’ dispute regarding occurrence of<\/p>\n
 negligence and liability of the insurer of the<\/p>\n
 the only point that remains for my<\/p>\n
consideration in the appeal is:\n<\/p>\n
n T Whether the quantum of<\/p>\n
 compensation awarded by the Tribunal is<\/p>\n
  just and proper or does it call for
\nenhancement?\n<\/p>\n
fffs’<\/p>\n
two occasions and he recently examined the claimant
\non 6.02.2008 and found that there was discharge of
\nsinus present over the right knee lower Sm of the right<\/p>\n
leg and that there is gross swelling present on .rig.ht<\/p>\n
knee leg and ankle and that the  .\n<\/p>\n
walking, movement of right knee. and _righ’t::l’_:;1n’l{le’..are 0″‘<\/p>\n
restricted and painful. He assessed r~60%. <\/p>\n
the right lower limb and  thehwhole\n<\/p>\n

awarded by the and suffering is<\/p>\n
just and”ipro\u00a7;ger arid ‘there is””no’ scope for enhancement<\/p>\n

9.  The claimant in his evidence has stated that he<\/p>\n
\u00bb received\u00ab.hos~pita1 expenses through medi claim scheme<\/p>\n
H  medical bills for Rs.l,185\/–and<\/p>\n
 the has awarded Rs.5,000\/~ towards medical<\/p>\n
 and, incidental expenses such as conveyance,<\/p>\n
nourishment and attendant charges, thereby awarded<\/p>\n
only Rs.3,815\/– towards incidental expenses which is<\/p>\n
on the lower side. He was inpatient in the hospital<\/p>\n
%.\n<\/p>\n
assessed the disability at 60% to right lower limb and<\/p>\n
20% to whole body.\n<\/p>\n<\/p>\n
13. Learned Counsel for the appellant subrrlitsas<\/p>\n
the doctor has stated 20% disability to the’..’:Whole’lhi:bodyA <\/p>\n
the same has to be taken as funetioiial disability. V  <\/p>\n
14. Learned Counsel for the Insurance. “‘Cor{iepan\u00a7,*l<\/p>\n
submits that on recent examination Vthej’dLocVtVQIt:\\\u00a7<\/p>\n
stated that swelling which -presentllinthe  earlier
\nnow disappeared and j.l,O–?\/go  taken by the
\nTribunal whilewgrking  loss:-of  income is just<\/p>\n
and proper. V V’ <\/p>\n
15. Consideririlgg   all situation justice would be<\/p>\n
 j meit~:.:by_tA’tal<ing'"fu.;1_ctional disability at 15%. Muitiplier<\/p>\n
 'ap'plicable;*to"his age group is '16'. Therefore, future<\/p>\n
ieeeeieiiaeeegeiwerite out to Rs.1,29,600\/– [Rs.4,500\/– x<\/p>\n
 15%  X16) and it is awarded as against Rs.86,400\/–<\/p>\n
  'iIf'i4exi2etded by the Tribunal.<\/p>\n
  Considering the nature of injuries Rs.l5,000\/–<\/p>\n
awarded by the Tribunal towards future medical<\/p>\n
expenses is just and proper and it does not call for<\/p>\n
enhancement.\n<\/p>\n
17. Thus the claimant is entitled for the <\/p>\n
