              The petitioners are presently working as Assistant<\/p>\n
Engineers in the Local Self Government Department. They were<\/p>\n
recruited as Assistant Engineers in the Water Resources<\/p>\n
Department.     Pursuant to the decision taken by the State<\/p>\n
Government evidenced by Ext.P1, they were deployed to the<\/p>\n
Local Self Government Department. One of the terms of such<\/p>\n
deployment was that the deployment would be for a period of<\/p>\n
three years, except when the personnel who are deployed get<\/p>\n
promoted in their parent cadre in the meanwhile. Ext.P1 also<\/p>\n
stipulates that the deployed staff would be relieved by the Local<\/p>\n
Self Government Department only after a substitute is posted in<\/p>\n
their place.\n<\/p>\n<\/p>\n
              2. The petitioners submit that they have completed<\/p>\n
three years of service in the Local Self Government Department<\/p>\n
pursuant to their deployment and that they are entitled to be<\/p>\n
W.P.(C) No.27506 of 2008<\/p>\n
                                2<\/span><\/p>\n
repatriated to their parent department. The petitioners further<\/p>\n
submit that they have moved the third respondent, the Chief<\/p>\n
Engineer in Exts.P3 to P7 representations, seeking repatriation<\/p>\n
to their parent department. The petitioners have, in this writ<\/p>\n
petition, prayed for a writ in the nature of mandamus<\/p>\n
commanding the respondents to repatriate them to the Water<\/p>\n
Resources Department.       They also pray for a writ in the nature<\/p>\n
of mandamus commanding the respondents to take appropriate<\/p>\n
action on Exts.P3 to P7 representations.\n<\/p>\n<\/p>\n
                3.    I have heard Dr.K.P.Satheesan, the learned<\/p>\n
counsel appearing for the petitioners and Smt.Anu Sivaraman,<\/p>\n
the learned Government Pleader for the official respondents.<\/p>\n
The    learned     Government   Pleader   appearing    for  official<\/p>\n
respondents submits that petitioners can be relieved only if<\/p>\n
substitutes are appointed in their place and that clause xiii of<\/p>\n
Ext.P1 is subject to clause xiv thereof. She, however, submitted<\/p>\n
that the Chief Engineer before           whom Exts.P3 to P7<\/p>\n
representations have been submitted will consider the matter,<\/p>\n
W.P.(C) No.27506 of 2008<\/p>\n
                                  3<\/span><\/p>\n
taking into account the availability of substitutes and take a<\/p>\n
decision thereon, within a time limit to be fixed by this Court.<\/p>\n
                In the light of the said submission, this Writ Petition<\/p>\n
is disposed of with a direction to the third respondent Chief<\/p>\n
Engineer, to consider the request made by the petitioners in<\/p>\n
Exts.P3 to P7 and take a decision thereon, expeditiously and in<\/p>\n
any event, within six months from the date on which petitioners<\/p>\n
produce a certified copy of this judgment.           While taking a<\/p>\n
decision on Exts.P3 to P7 representations, the third respondent<\/p>\n
shall also take note of the fact that persons placed similarly as<\/p>\n
the petitioners have already been repatriated to their parent<\/p>\n
department.\n<\/p>\n<\/p>\n
