In pursuance of the said impugned order, the<br \/>\ndetenue is detained in Sub-Jail, Mehsana.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that only one offence being<br \/>\nIII-CR No.5001 of 2008 under the provisions of Section 66B, 65A,E, 81<br \/>\nand 116(2) under the Bombay Prohibition Act, was registered with<br \/>\nSomnath Marine Police Station, wherein a quantity of total 2364<br \/>\nbottles of foreign  liquor were found from the possession of the<br \/>\ndetenue. On the basis of registration of this case, the detaining<br \/>\nauthority held that the present detenue was carrying on activities of<br \/>\nselling country made liquor which is harmful to the health of the<br \/>\npublic. It is held by the detaining authority that as the detenue is<br \/>\nindulged in illegal activities, it is required to restrain the detenu<br \/>\nfrom carrying out further illegal activities, i.e. selling of liquor.<br \/>\nThe detaining authority has placed reliance on the above registered<br \/>\noffences and statements of unnamed witnesses.  In the opinion of this<br \/>\nCourt, the activities of the detenue can, by no stretch of<br \/>\nimagination, be said to be disturbing the ?Spublic order.?? It is<br \/>\nseen from the grounds that a general statement that has been made by<br \/>\nthe detaining authority that consuming liquor is injurious to health.<br \/>\n In fact, a perusal of the order passed by the detaining authority<br \/>\nshows that the grounds which  are mentioned in the order are in<br \/>\nreference to the situation of ?Slaw and order?? and not ?Spublic<br \/>\norder??.  Therefore, on this ground, the subjective satisfaction<br \/>\narrived at by the detaining authority is vitiated on account of<br \/>\nnon-application of mind and the impugned order, therefore, deserves<br \/>\nto be quashed and set aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling country made liquor which is harmful to the<br \/>\nhealth of the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai<br \/>\nSolanki v. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n?Slaw and order?? and not ?Spublic order??.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the ?Spublic  order??<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to ?Spublic order??. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this<br \/>\nSpecial Civil Application is allowed. The<br \/>\nimpugned order of detention dated 26.2.2008 passed by the detaining<br \/>\nauthority is hereby quashed and set aside. The detenue is ordered to<br \/>\nbe set at liberty forthwith, if not required in any other case. Rule<br \/>\nis made absolute accordingly.
