Justice R.BASANT\n\n Dated :29\/01\/2008\n\n O R D E R\n                                   R.BASANT, J\n\n                            ------------------------------------\n\n                         B.A.Nos.570 &amp; 579 of 2008\n\n                            -------------------------------------\n\n                 Dated this the 29th day of January, 2008\n\n\n\n                                        ORDER\n<\/pre>\n<p>       These applications by the common petitioner are for regular<\/p>\n<p>bail.     Crimes   are   registered   under   Section   379   I.P.C.     The<\/p>\n<p>allegation   is   of   theft   of   motor   cars.     The   cars   in   question   were<\/p>\n<p>stolen on 03.12.07 and 07.11.07.  The petitioner was arrested and<\/p>\n<p>remains   in   custody   from   13.12.07.     His   applications   for   regular<\/p>\n<p>bail were earlier dismissed as per common order dated 10.01.08.<\/p>\n<p>He   was   permitted   to   move   this   Court   again   after   24.01.08.<\/p>\n<p>Accordingly these applications have been filed on 24.01.08.<\/p>\n<p>       2.     I have adverted to facts in detail in the common order<\/p>\n<p>dated 10.01.08 in B.A.Nos.7595 and 8011 of 2007.  This common<\/p>\n<p>order must be read in continuation of the said common order.   I<\/p>\n<p>am not, in these circumstances, adverting to facts in any greater<\/p>\n<p>detail in this order.  The learned counsel for the petitioner submits<\/p>\n<p>that the co-accused, who was also arrested on 13.12.07, has now<\/p>\n<p>been granted regular bail by the learned Sessions Judge in Crime<\/p>\n<p>No.618 of 2007.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.Nos.570 &amp; 579 of 2008                 2<\/span><\/p>\n<p>         3.     The   learned   counsel   for   the   petitioner   prays,   the<\/p>\n<p>learned Public Prosecutor  does not  oppose the said prayer and I<\/p>\n<p>am   satisfied   that   the   petitioner   can   now   be   enlarged   on   bail   in<\/p>\n<p>both   cases   subject   to   appropriate   terms   and   conditions.     In   the<\/p>\n<p>absence of opposition by the learned Public Prosecutor, I am not<\/p>\n<p>adverting to facts in any further detail.\n<\/p>\n<\/p>\n<p>         4.     In the result, these bail applications are allowed.   The<\/p>\n<p>petitioner   shall   be   released   on   bail   on   the   following   terms   and<\/p>\n<p>conditions.\n<\/p>\n<\/p>\n<p>         i)     In   each   case,   the   petitioner   shall   execute   bonds   for<\/p>\n<p>Rs.50,000\/- (Rupees Fifty thousand only) with two solvent sureties<\/p>\n<p>each for the like sum to the satisfaction of the learned Magistrate;<\/p>\n<p>         ii)    The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p>12  noon  on all  Mondays  and  Fridays  for  a  period   of  two  months<\/p>\n<p>and thereafter as and when directed by the Investigating Officer<\/p>\n<p>in writing to do so.\n<\/p>\n<\/p>\n<p>                                                        (R.BASANT, JUDGE)<\/p>\n<p>rtr\/-\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court D.Muhammed Navas vs The Station House Officer on 29 January, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 570 of 2008() 1.
