Appellant(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT &amp; 2 - Defendant(s)\n \n\n=========================================================\n \nAppearance : \nMR\nMB GANDHI for Appellant(s) : 1,MR SUNIL M\nAGRAWAL for Appellant(s) : 1, \nNone for Defendant(s) : 1 -\n3. \n========================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.S.DAVE\n\t\t\n\t\n\n \n\nDate\n: 12\/04\/2006 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.S.DAVE)<\/p>\n<p>This<br \/>\n\tLetters Patent Appeal is filed under Clause 15 of the letters<br \/>\n\tPatent.\n<\/p>\n<p>In<br \/>\n\tview of the reasons given in earlier Letters Patent Appeal No. 613<br \/>\n\tof 2006, challenging the orders impugned dated 12.7.2005, 18.7.2005<br \/>\n\tand finally 19.7.2005, it is to be noted that Special Civil<br \/>\n\tApplication No. 13512 of 2005, lateron was heard by the learned<br \/>\n\tSingle Judge and the same is disposed of on 1.2.2006 by following<br \/>\n\tobservation:\n<\/p>\n<p>?S7.Under<br \/>\n\tthe above circumstances,  it appears that in the adverse remarks,<br \/>\n\twhich were now restored to the file, on account of the decision by<br \/>\n\tthe State Government through the Minister of Finance, the petitioner<br \/>\n\tmay ventilate grievance as may be permissible in law before the LPA<br \/>\n\tBench and as the LPA Bench is seized with the matter, direction<br \/>\n\tcannot be given at this stage in the present proceedings leaving<br \/>\n\tliberty to the petitioner to resort to appropriate  application in<br \/>\n\tthe pending LPA, if otherwise permissible in law.  However, so far<br \/>\n\tas the period after 2001 is concerned, the matter can be considered<br \/>\n\tby DPC on the basis of the confidential remarks as prevailing after<br \/>\n\t2001 onwards.\n<\/p>\n<p>8.\tTherefore,<br \/>\n\tthe petition is disposed of with the direction that the DPC in the<br \/>\n\tnext meeting shall consider the case of the petitioner together with<br \/>\n\tthe other eligible officers for promotion by taking into<br \/>\n\tconsideration the confidential remarks of the petitioner after 2001<br \/>\n\tonwards.  So far as the confidential remarks of 2000 is concerned,<br \/>\n\tthe petitioner may resort to appropriate proceedings in the pending<br \/>\n\tLPA.  Disposed of accordingly.??\n<\/p>\n<p>In<br \/>\n\tview of the above directions given by the learned Single Judge to<br \/>\n\tconsider the case of the petitioner along with other eligible<br \/>\n\tofficers for promotion, and the reasons given by us in the order we<br \/>\n\thave passed in LPA 613 of 2006, we do not find any reason to<br \/>\n\tinterfere with the order passed on 12.7.1987 and 19.7.2005, which<br \/>\n\twas a subject matter of grievance raised by the present petitioner,<br \/>\n\twhich has been finally disposed of. Even the contention of Shri<br \/>\n\tM.B.Gandhi, learned advocate for the petitioner that the learned<br \/>\n\tSingle Judge, while exercising powers under Article 226 of the<br \/>\n\tConstitution of India, no jurisdiction to issue the notice of<br \/>\n\tcontempt and to hear the same, it is to be noted that the present<br \/>\n\tAppellant was very much present and participated in the said<br \/>\n\tproceedings.  Not only that but it was a matter between the Court<br \/>\n\tand alleged contemner, who had   lateron realised and withdrew the<br \/>\n\torder, by which the decision of August 2003 of Special Civil<br \/>\n\tApplication was tempered with.\n<\/p>\n<p>Considering<br \/>\n\tthe above aspect, no grievances were raised during the pendency of<br \/>\n\tthe proceedings by the present Appellant about the exercise of power<br \/>\n\tand issuance of the show cause notice to the then Hon&#8217;ble Finance<br \/>\n\tMinister, we do not find any substance to interfere in the Appeal<br \/>\n\tproceedings, which have arisen out of the interlocutory orders<br \/>\n\tpassed and particularly now the matter is set at rest by the final<br \/>\n\torder of 1.2.2006.\n<\/p>\n<p>It<br \/>\n\tis to noted that very basis of prayer made in Special Civil<br \/>\n\tApplication No. 13512 of 2005, seeking direction to the respondents<br \/>\n\tto reconstitute the Departmental Promotion Committee and to consider<br \/>\n\tthe case of the petitioner, is erroneous, since by an order dated<br \/>\n\t18.8.2003, Special Civil Application No. 12057 of 2003 came to be<br \/>\n\trejected and against which even LPA (Stamp) No. 91 of 2005 was also<br \/>\n\tdismissed.  Therefore, once this Court had given final verdict with<br \/>\n\tregard to adverse remarks, communicated to the petitioner, any<br \/>\n\tprayer based on subsequent acceptance of representation of the<br \/>\n\tpetitioner against the very same adverse remarks cannot be<br \/>\n\tentertained and therefore also resurrection of the whole issue and<br \/>\n\tto adjudicate the same on merit, as submitted by Shri M.B.Gandhi,<br \/>\n\tlearned advocate for the appellant do not require any interference<br \/>\n\tand the learned single Judge has rightly rejected the same, which do<br \/>\n\tnot require any interference at our end.\n<\/p>\n<p>Shri<br \/>\n\tM.B.Gandhi, learned advocate for the Appellant has produced a copy<br \/>\n\tof the final order dated 1.2.2006 passed in Special Civil<br \/>\n\tApplication No. 13512 of 2005.
