SIRI JAGAN, J.\n                ------------------------------------\n                   W.P.(C)No.13027 OF 2008\n              ----------------------------------------\n                 Dated this the 4th day of June, 2008\n\n                           JUDGMENT\n<\/pre>\n<p>     The petitioners are senior students of the 2nd respondent&#8217;s<\/p>\n<p>College.    They have been suspended from the College on<\/p>\n<p>allegations of ragging, involving physical assault of junior<\/p>\n<p>students.   A Criminal case has already been registered against<\/p>\n<p>them. Their grievance in this writ petition is that they are not<\/p>\n<p>being reinstated in spite of the enquiry authority finding in favour<\/p>\n<p>of them. The petitioners, therefore, seek the following reliefs:<\/p>\n<blockquote><p>               &#8220;i)   To issue a Writ of Mandamus to the 2nd<br \/>\n         respondent to revoke the suspension of the<br \/>\n         petitioners forthwith.\n<\/p><\/blockquote>\n<blockquote><p>               ii)   To issue a Writ of Mandamus to the 2nd<br \/>\n         respondent to furnish the copy of the final enquiry<br \/>\n         report with findings to the petitioners.\n<\/p><\/blockquote>\n<blockquote><p>               iii)  To issue a Writ of Mandamus directing<br \/>\n         the 2nd respondent to consider and pass orders on<br \/>\n         Ext.P3.&#8221;<\/p><\/blockquote>\n<p>     2.    A counter affidavit has been filed, in which it has been<\/p>\n<p>categorically stated that the petitioners have been found guilty in<\/p>\n<p>the enquiry conducted.     They have also produced the enquiry<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.13027\/08                2<\/span><\/p>\n<p>report finding the petitioners guilty of the misconducts alleged<\/p>\n<p>against them. But I find that in Ext.P6, it is stated that the<\/p>\n<p>College has not proposed any action against the petitioners on<\/p>\n<p>the basis of the enquiry report since a criminal case as per the<\/p>\n<p>Kerala Prohibition of Ragging Act, 1998 is pending against<\/p>\n<p>them.\n<\/p>\n<p>      I am of opinion that for finalising disciplinary proceedings<\/p>\n<p>against the petitioners, it is not necessary to await out comes<\/p>\n<p>of the criminal case. Therefore, I dispose of this writ petition<\/p>\n<p>with a direction to the 2nd respondent to pass final orders on<\/p>\n<p>the basis of Ext.R2(a) enquiry report, within a period of one<\/p>\n<p>month.\n<\/p>\n<\/p>\n<p>                                          S.
