Munshaw, learned counsel for the petitioner  and Ms.P.C.<br \/>\n\tFernandis , learned counsel for the respondent.\n<\/p>\n<p>The<br \/>\n\tpetitioner, being aggrieved by the order dtd.23\/12\/1997 passed by<br \/>\n\tthe Presiding Officer, Labour Court, Ahmedabad in Recovery<br \/>\n\tApplication No.2033 of 1989, is before this Court with the<br \/>\n\tsubmissions that neither the application was maintainable under<br \/>\n\tsec.33-C-2 of the Industrial Disputes Act, nor the same could be<br \/>\n\tallowed on the merits.\n<\/p>\n<p>Short<br \/>\n\tfacts necessary for disposal of the writ application are that the<br \/>\n\tpresent respondent   workman tendered his resignation letter on<br \/>\n\t11\/6\/986, it was accepted w.e.f. 11\/6\/1986, in lieu of the notice,<br \/>\n\tthe workman deposited one month&#8217;s salary with the petitioner<br \/>\n\temployer. Thereafter, the workman withdrew a sum of Rs.25,296.38 ps.<br \/>\n\tdeposited under the Contributory Provident Fund Scheme, because at<br \/>\n\tthe time of his resignation, there was no scheme for grant of<br \/>\n\tpensionary benefits.\n<\/p>\n<p>Under<br \/>\n\tthe Circular dtd.2\/2\/1984, the petitioner  evolved a scheme<br \/>\n\tcontending inter-alia that the employees may opt for Contributory<br \/>\n\tProvident Fund Scheme or may go for pensionary benefits. The<br \/>\n\trespondent   workman, thereafter, taking advantage of yet another<br \/>\n\tresolution No.102 dtd.31\/3\/1987, which implemented the scheme, made<br \/>\n\tan application that he be given pensionary benefits. The petitioner<br \/>\n\tcorporation denied the rights saying that the scheme was applicable<br \/>\n\tto the persons who were either in service, or, who had retired by<br \/>\n\treaching  the age of superannuation and the same would not apply to<br \/>\n\tthe persons who had tendered their voluntary resignation.\n<\/p>\n<p>In<br \/>\n\tview of the dispute raised by the present petitioner employer, the<br \/>\n\tworkman, instead of filing a Reference under sec.10 of the<br \/>\n\tIndustrial Disputes Act, made an application under sec.33-C-2 of the<br \/>\n\tIndustrial Disputes Act. The present petitioner  defended the<br \/>\n\tapplication on various counts and submitted that there was<br \/>\n\tdistinction between retirement and resignation, therefore, the<br \/>\n\tapplication was not maintainable. Despite there being a dispute<br \/>\n\trelating to entitlement of the workman and application of the<br \/>\n\tscheme, the Labour Court allowed the recovery application.\n<\/p>\n<p>Mr.Munshaw,<br \/>\n\tlearned counsel for the petitioner submitted that  proceedings under<br \/>\n\tsec.33-C-2 of the Industrial Disputes Act are in nature of recovery<br \/>\n\t\/ execution  and if there is no pre-existing undisputed right or<br \/>\n\tpre-adjudicated right in favour of the  workman, an application<br \/>\n\tunder sec.33-C-2  of the I.D. Act would not be maintainable. Even on<br \/>\n\tthe merits, he submitted that the respondent   workman, having<br \/>\n\tresigned from the services, would not be entitled to the pensionary<br \/>\n\tbenefits flowing from the scheme of 1984.\n<\/p>\n<p>Ms.Fernandis,<br \/>\n\tlearned counsel for the respondent,   on the other hand,  submitted<br \/>\n\tthat as 1984 Circular was made effective under Circular<br \/>\n\tdtd.31\/3\/1987 and a person, who resigned and retired as a resignee,<br \/>\n\twould be entitled to such benefits. She submitted that the learned<br \/>\n\tLabour Court, after considering the pros and cons,  has come  to the<br \/>\n\tright conclusion.\n<\/p>\n<p>It<br \/>\n\twould be trite to say that an application under sec.33-C-2 of the<br \/>\n\tIndustrial Disputes Act is in nature of an execution.  The execution<br \/>\n\twould only be  maintainable if there is pre-existing undisputed<br \/>\n\tright or there is some pre-adjudicated right in favour of the<br \/>\n\tclaimant.  If the Labour Court is required to make an inquiry into<br \/>\n\tthe entitlement of the claim, then, an application under sec.33-C-2<br \/>\n\tof the Industrial Disputes Act would not be maintainable.  As the<br \/>\n\tapplication itself, in the opinion of this Court, not maintainable,<br \/>\n\tthis Court is not required to enter into the larger issue pertaining<br \/>\n\tto the merits.\n<\/p>\n<p>The<br \/>\n\tpetition deserves to be allowed, it is accordingly allowed.
