              The petitioner organization is a public spirited organization,<\/p>\n
which espouses the issues relating to the general public and, it appears, it<\/p>\n
is constituted for protecting the civil rights of the people and also for<\/p>\n
ensuring social justice to the people of the locality.<\/p>\n
              2. The grievance of the petitioner in this writ petition is that<\/p>\n
the authorities of the State Government are attempting to stop the<\/p>\n
functioning of the Medical College Chest Hospital, Mulankunnathukavu<\/p>\n
in Thrissur district. Therefore, the petitioner seeks the following reliefs:<\/p>\n
              “I.     Call for the records relating to issuance of<\/p>\n
      Exhibit P-5 orders of the Government and to quash the same<\/p>\n
      by issuing a writ of certiorari or other appropriate writ or<\/p>\n
      order.\n<\/p><\/blockquote>\n
              II.     To issue a writ of mandamus or other<\/p>\n
      appropriate writ or order or direction, directing the<\/p>\n
      respondents, not to take any steps, which would adversely<\/p>\n
      affect the smooth functioning of the Medical College<\/p>\n
      Hospital, Mulankunnathukavu as assured by them before<\/p>\n
      this Honourable Court in Exhibit P1 judgment.<\/p>\n<\/blockquote>\n
              III.    To issue a writ of mandamus or other<\/p>\n
      appropriate writ or order or direction, directing the<\/p>\n
      respondents to restore all the facilities including new<\/p>\n

      admission of inpatients, better treatment by the efficient<\/p>\n
      doctors and also providing food to the inpatient etc. as<\/p>\n
      directed by this Honourable Court in Exhibit P1 judgment”.<\/p><\/blockquote>\n
             3.   When the matter was posted before this Court for<\/p>\n
admission, the learned Government Pleader was directed to get<\/p>\n
appropriate instruction.\n<\/p>\n
             4. Dr.M.A.Raveendran, Superintendent, Medical College<\/p>\n
Chest Hospital, Thrissur has written a letter to the learned Government<\/p>\n
Pleader dated 11th July, 2008. In that, he has stated, that, the said Hospital<\/p>\n
is taking care of the T.B. patients. The information given by the<\/p>\n
Superintendent of the Hospital to the learned Government pleader is as<\/p>\n
under:\n<\/p>\n
             “Medical     College    Chest    hospital   which     was<\/p>\n
      commissioned       on    12-12-1986       as    per     GO(Rt).<\/p>\n
      4383\/86\/H&FWD Dated 12-12-1986 is having 75 beds in<\/p>\n
      the H block.\n<\/p><\/blockquote>\n
      The Tuberculosis patients are given all the facilities:<\/p>\n<\/blockquote>\n
      1.     OP service on all days except Sundays,\n<\/p><\/blockquote>\n
      2.     24 hour casualty service on all 365 days of year,\n<\/p><\/blockquote>\n
      3.     Hospitalization (inpatient care) whenver required,
\n             with Medicines under DOTS and diet,\n<\/p><\/blockquote>\n
      4.     All routine blood, urine and sputum examination,\n<\/p><\/blockquote>\n
      4.     Special investigations including x-rays, ECG, Lung
\n             function tests and bronchoscopy.\n<\/p><\/blockquote>\n
      5.     Consultation services in Medicine and other Medical
\n             specialties in MC Chest Hospital and Surgical
\n             consultation in New Medical College Hospital.<\/p>\n

             In accordance with the spirit of judgment of Hon.<\/p>\n
     High Court in OP No.4054\/83 TB patients are given all the<\/p>\n
     facilities they were getting at the time of judgment.<\/p>\n<\/blockquote>\n
             The treatment of Tuberculosis has undergone a<\/p>\n
     breakthrough by the introduction of the Revised National<\/p>\n
     Tuberculosis Control Programme (known as RNTCP).<\/p>\n
     Under this programme Designated Microscopic centre<\/p>\n
     (DMC) was started in Medical College to detect sputum of<\/p>\n
     TB patients to detect the TB bacteria on 16.2.2003. The<\/p>\n
     Districution of Medicines and follow ups are done through<\/p>\n
     the DOTS centre (Directly Observed Treatment Strategy)<\/p>\n
     attached to Medical College Chest Diseases Department<\/p>\n
     whwich started functioning since 10.3.03.<\/p>\n<\/blockquote>\n
             The DOTS regime of treatment under the National<\/p>\n
     programme was found to be very effective and hence it is<\/p>\n
     administered on all India basis. The policy is to provide<\/p>\n
     domiciliary drug administration under Supervision of TB<\/p>\n
     patients 3 times a week. The patients are evaluated in the<\/p>\n
     DOTS centre and they are referred to local Primary Health<\/p>\n
     Centers (PHC) near their residence where medicines for<\/p>\n
     Tuberculosis patients are made available free of cost. If the<\/p>\n
     patient is ill or if he requires admission, patient is admitted<\/p>\n
     in Medical College Hospital and later transferred to the<\/p>\n
     PHCs. Under this scheme there is a drastic reduction in the<\/p>\n
     number of Tuberculosis patients who requires admission.<\/p>\n<\/blockquote>\n
             In the judgment of OP 4054\/1983 it is mentioned that<\/p>\n
     there are 3000 patients registered for sanatorium care. TB<\/p>\n
     ward of the District hospital was also stopped and the<\/p>\n
     patients were transferred to Medical College when the new<\/p>\n

      building H block was commissioned in 1986. The 6 doctors<\/p>\n
      in the Health Services on working arrangement were<\/p>\n
      transferred to Chest hospital on that occasion as per GO<\/p>\n
      (Rt).No.4383\/86\/H&FWD         dated    12-12-86.     The   staff<\/p>\n
      transferred is under the administrative control of the<\/p>\n
      Director of Medical Education. Further proposal for<\/p>\n
      additional post creation has not been requested from the<\/p>\n
      office of the Principal.\n<\/p><\/blockquote>\n
             RNTCP programme<\/p>\n

\n             Admitted\/treatment initiated and

             Chest hospital<\/p>\n
             Hospitalization TB patients new\/readmission\/and
\n             Old TB included Average days of
\n             hospitalization – 7 days.           470 in year 2007″.<\/p><\/blockquote>\n
             5.     Having gone through the information that the<\/p>\n
Superintendent of the Hospital has furnished to the learned Government<\/p>\n
Pleader, we are of the opinion that there is neither an attempt nor a serious<\/p>\n
attempt on the part of the respondents to stop the functioning or<\/p>\n
W.P.(C).No.20231 of 2008-S            – 5 –<\/span><\/p>\n
downgrading     of    the     Medical     College     Chest    Hospital,<\/p>\n
Mulankunnathukavu, Thrissur district. In that view of the matter, no<\/p>\n
orders need be passed in this writ petition and the same is, accordingly,<\/p>\n
closed.\n<\/p>\n
