Justice KURIAN JOSEPH\n\n Dated :24\/09\/2008\n\n O R D E R\n                          KURIAN JOSEPH, J.\n                ----------------------------------------------\n                      W.P.(C) No.16 of 2006\n                ----------------------------------------------\n                  Dated 24th September, 2008.\n\n                            J U D G M E N T\n<\/pre>\n<p>            The surviving grievance is on prayer No.2, which reads<\/p>\n<p>as follows :-\n<\/p>\n<blockquote><p>                      &#8221; Issue a writ of mandamus or any other writ, order or<br \/>\n         direction directing the respondents 1 and 2 to return the amount<br \/>\n         already collected towards RR collection charges to the petitioner or<br \/>\n         adjust the same towards balance payment in OTS.&#8221;<\/p>\n<\/blockquote>\n<p>It is submitted that the issue is covered in favour of the petitioner<\/p>\n<p>by two decisions of this court, (1) in <a href=\"\/doc\/1658487\/\">Bhaskaran v.
