It is alleged, in the plaint, that<\/p>\n<p>one Badna Singh, morgaged the suit land with the forefathers of the<\/p>\n<p>appellants, more than 100 years ago. As the respondents, who are<\/p>\n<p>successors-in-interest of the mortgagor, have failed to redeem the<br \/>\n<span class=\"hidden_text\"> RSA No.893 of 2006                                             2<\/span><\/p>\n<p>mortgaged property, within the prescribed period of limitation, the<\/p>\n<p>appellants have become owners in possession.\n<\/p>\n<p>            In opposition to the averments in the plaint, the respondents<\/p>\n<p>admitted the mortgage but denied that they had become owners and also<\/p>\n<p>asserted that the suit was filed by concealing the fact that an application<\/p>\n<p>had been filed for redemption of the mortgage.\n<\/p>\n<p>              The trial Court dismissed the suit by holding that as the<\/p>\n<p>mortgage did not prescribe a period for redemption, the mortgage subsists<\/p>\n<p>and as a result, the appellants had not become owners in possession, by<\/p>\n<p>efflux of time. Aggrieved by the said judgement, the appellants filed an<\/p>\n<p>appeal. The Additional District Judge, Bathinda, dismissed the appeal and<\/p>\n<p>affirmed the findings recorded by the trial Court.<\/p>\n<p>            I have heard learned counsel for the appellants and perused the<\/p>\n<p>impugned judgements.\n<\/p>\n<p>            The appeal was admitted on 8.8.2006 on the following question<\/p>\n<p>of law :-\n<\/p>\n<blockquote><p>            &#8220;Whether the right to seek redemption would arise on the date<\/p>\n<p>            of mortgage itself in case of usufructuary mortgage when no<\/p>\n<p>            time limit is fixed to seek redemption ?&#8221;<\/p><\/blockquote>\n<p>            Admittedly and as accepted by counsel for the appellants, the<\/p>\n<p>question of law has been answered against the appellants and in favour of<\/p>\n<p>the respondents by a Full Bench of this Court in <a href=\"\/doc\/627172\/\">Ram Kishan and others<\/p>\n<p>V. Sheo Ram and others<\/a>, 2008(1) PLR 1, wherein while considering the<\/p>\n<p>period of limitation prescribed for filing an application, for redemption of a<\/p>\n<p>usufructuary mortgage, it was held as follows :-<br \/>\n<span class=\"hidden_text\"> RSA No.893 of 2006                                              3<\/span><\/p>\n<blockquote><p>               &#8220;33. The arguments that after the expiry of period of<\/p>\n<p>               limitation to sue for foreclosure, the morgagees have a<\/p>\n<p>               right to seek declaration in respect of their title over the<\/p>\n<p>               suit property is not correct.           From the aforesaid<\/p>\n<p>               discussion, it is apparent that the mortgage cannot be<\/p>\n<p>               extinguished by any unilateral act of the mortgagee.<\/p>\n<p>               Since the mortgage cannot be unilaterally terminated,<\/p>\n<p>               therefore, the declaration claimed is nothing but a suit for<\/p>\n<p>               foreclosure. It is equally well settled that it is not title of<\/p>\n<p>               the suit, which determines the nature of the suit. The<\/p>\n<p>               nature of the suit is required to be determined by reading<\/p>\n<p>               all the averments in the plaint. Such declaration cannot<\/p>\n<p>               be claimed by an usufructuary mortgagee. Thus, we<\/p>\n<p>               prefer to follow the dictum of law laid down by the larger<\/p>\n<p>               Bench in Seth Ganga Dhar&#8217;s case (supra) as well as<\/p>\n<p>               judgements of Hon&#8217;ble Supreme Court in Jayasingh<\/p>\n<p>               Dnyanu     Mhoprekar&#8217;s      case    (supra),    Pomal   Kanji<\/p>\n<p>               Govindji&#8217;s case (supra), Panchanan Sharma&#8217;s case (supra)<\/p>\n<p>               and Harbans&#8217;s case (supra) in preference to the<\/p>\n<p>               judgements     relied   upon       by   the    mortgagees   in<\/p>\n<p>               Prabhakaran&#8217;s case (supra) and Sampuran Singh&#8217;s case<\/p>\n<p>               (supra).\n<\/p><\/blockquote>\n<blockquote><p>               34.   Therefore, we answer the questions framed to hold<\/p>\n<p>               that in case of usufructuary mortgage, where no time<\/p>\n<p>               limit is fixed to seek redemption, the right to seek<\/p>\n<p>               redemption would not raise on the date of mortgage but<br \/>\n<span class=\"hidden_text\"> RSA No.893 of 2006                                             4<\/span><\/p>\n<p>                   will arise on the date when the mortgagor pays or tenders<\/p>\n<p>                   to the mortgagee or deposits in Court, the mortgage<\/p>\n<p>                   money or the balance thereof. Thus, it is held that once a<\/p>\n<p>                   mortgage always a mortgage and is always redeemable.&#8221;<\/p><\/blockquote>\n<p>             It is, therefore, apparent that in a usufructuary mortgage, where<\/p>\n<p>no time limit is fixed for redemption, the right to seek redemption accrues<\/p>\n<p>on the date the mortgagor pays or tenders to the mortgagee or deposit in<\/p>\n<p>Court, the mortgage money or the balance thereof and not from the date of<\/p>\n<p>the mortgage. In the instant case, as the mortgage does not assign a date or<\/p>\n<p>a period for redemption, the limitation for filing a suit\/application for<\/p>\n<p>redemption of the mortgaged property, has not expired. The Courts below,<\/p>\n<p>therefore, rightly dismissed the suit and the appeal.
