Justice ANTONY DOMINIC\n\n Dated :03\/10\/2007\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ===============\n                   W.P.(C) NO. 26411 OF 2007\n                 ====================\n\n            Dated this the 3rd day of October, 2007\n\n                          J U D G M E N T\n<\/pre>\n<p>      The proceedings initiated against the petitioner under the<\/p>\n<p>Securitisation and Reconstruction of Financial Assets and<\/p>\n<p>Enforcement of Security Interest Act, 2002 is under challenge.<\/p>\n<p>One of the submissions made is regarding the pendency of the<\/p>\n<p>proceedings before the Debts Recovery Tribunal and that<\/p>\n<p>simultaneous proceedings have been initiated. Legally there is<\/p>\n<p>no bar for the Bank to initiate parallel proceedings.<\/p>\n<p>      2.   It is now contended that the petitioner had withdrawn<\/p>\n<p>all his contentions in the proceedings before the Debts Recovery<\/p>\n<p>Tribunal and on that basis final order has been passed by the<\/p>\n<p>Debts Recovery Tribunal on 18\/9\/07, permitting the petitioner to<\/p>\n<p>pay off the liability in two instalments payable on 31\/11\/07 and<\/p>\n<p>28\/2\/08. This submission of the learned counsel for the Bank is<\/p>\n<p>confirmed to be correct by the learned counsel for the writ<\/p>\n<p>petitioner also.    However, he only apprehends that in the<\/p>\n<p>WPC 26411\/07<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>meanwhile the Bank may proceed further with the proceedings<\/p>\n<p>impugned in this writ petition.
