No.3450\/2011-E\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n         Dated this the 3rd day of February, 2011\n\n                    J U D G M E N T\n<\/pre>\n<p>    The petitioner is presently working as Principal<\/p>\n<p>of  Government   Higher   Secondary  School,   Kattoor,<\/p>\n<p>Irinjalakuda in Thrissur District.  She is a native of<\/p>\n<p>Thiruvananthapuram District.   She was promoted as per<\/p>\n<p>Ext.P1  order   dated  27\/03\/2010.      She  filed   an<\/p>\n<p>application for transfer pointing out various vacancies<\/p>\n<p>in Thiruvananthapuram District.   Her first choice was<\/p>\n<p>Government  H.S.S.,   Attingal;   second   choice   was<\/p>\n<p>Government  H.S.S.,   Vakkom   and;   third  choice   &#8211;<\/p>\n<p>Government H.S.S., Elamba.   Ext.P2 is the copy of the<\/p>\n<p>application  which  was   submitted  pursuant   to  the<\/p>\n<p>invitation of application for general transfer.  Ext.P3<\/p>\n<p>is the guidelines for transfer.\n<\/p>\n<\/p>\n<p>    2.   The list prepared thereafter, as per Ext.P4<\/p>\n<p>shows  that   the  petitioner   was   proposed  to   be<\/p>\n<p>transferred to the school of her first choice i.e.<\/p>\n<p>Government H.S.S., Attingal.  It is pointed out that in<\/p>\n<p>the light of the seniority as well as other conditions<\/p>\n<p>of the norms, she was proposed to be transferred to<\/p>\n<p>W.P.(C). No.3450\/2011<br \/>\n<span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>Attingal.    The  case   of  the  petitioner  is   that<\/p>\n<p>thereafter, at the final stages, an alteration has been<\/p>\n<p>made in the list even though all the authorities have<\/p>\n<p>concurred with the benefits granted to the petitioner.<\/p>\n<p>It is pointed out that respondent Nos.4 to 7 have been<\/p>\n<p>benefited by the final orders issued.    The petitioner<\/p>\n<p>has raised several contentions in the writ petition<\/p>\n<p>alleging extraneous reasons for the refusal to grant<\/p>\n<p>the request of the petitioner.\n<\/p>\n<\/p>\n<p>    3.   The   petitioner   has   already   moved   the<\/p>\n<p>Government by filing Ext.P8 representation.     In the<\/p>\n<p>light of the urgency shown by the petitioner, there<\/p>\n<p>will be a direction to the Government to take a<\/p>\n<p>decision on Ext.P8 with notice to the petitioner and<\/p>\n<p>respondent Nos.4 to 7 within a period of one month from<\/p>\n<p>the date of receipt of a copy of this Judgment.     The<\/p>\n<p>petitioner will produce a copy of the writ petition<\/p>\n<p>along with a copy of the Judgment before the Government<\/p>\n<p>for compliance.
