             Plaintiff Ram Chander filed a suit for specific performance<\/p>\n
and the same was decreed by the Additional Senior Sub Judge,<\/p>\n
Rajpura vide judgment and decree dated 5.1.1991. In appeal, the<\/p>\n
said judgment and decree were upheld by District Judge, Patiala vide<\/p>\n
judgment and decree dated 8.1.1996 . Hence, the present appeal by<\/p>\n
the defendant.\n<\/p>\n
             Brief facts of the case, as noticed by the lower appellate<\/p>\n
Court in para Nos. 2 and 3 of its judgment, are as under:-
\n R.S.A.No. 191 of 1996                                            2<\/span><\/p>\n
         “2.         Brief facts of the case are that plaintiff<\/p>\n
         Sh.Ram Chander filed a suit for possession by way of<\/p>\n
         specific performance against defendant\/appellant Pala<\/p>\n
         Singh alleging that Pala Singh defendant agreed to sell<\/p>\n
         the suit land fully described in the headnote of the plaint<\/p>\n
         to the plaintiff for a sum of Rs.2,50,000\/- vide agreement<\/p>\n
         to sell dated 28.2.1986.     Defendant received a sum of<\/p>\n
         Rs.30,000\/- out of the sale consideration.        Amount of<\/p>\n
         Rs.5,000\/- was paid to the plaintiff on 30.10.1985 when<\/p>\n
         the earlier agreement was executed and amount of<\/p>\n
         Rs.25,000\/- was paid to the plaintiff when the agreement<\/p>\n
         dated 28.2.1986 was executed between the parties.<\/p>\n
         Latest   agreement is dated         28.2.1986.        The first<\/p>\n
         agreement merged into the second one dated 28.2.1986.<\/p>\n
         It was agreed upon that the sale deed would be executed<\/p>\n
         on or before 31.8.1986 on payment of the remaining<\/p>\n
         consideration of Rs.2,20,000\/-. Plaintiff alleged that he<\/p>\n
         was always ready and willing and still ready and willing to<\/p>\n
         perform his part of the contract and he is also ready to get<\/p>\n
         the sale deed executed in his favour in terms of the<\/p>\n
         agreement      but   the   defendant    has   breached       the<\/p>\n
         agreement. Hence this suit.\n<\/p><\/blockquote>\n
         3.          Notice    of   the   suit   was   given     to   the\n\n         defendant\/appellant who filed written statement.             He\n R.S.A.No. 191 of 1996                                        3<\/span>\n\n         admitted execution of the agreement.      Defendant also\n\n<\/pre>\n
         admitted that he received a sum of Rs.30,000\/- by way of<\/p>\n
         earnest money. He issued a notice dated 29.8.1986 to<\/p>\n
         the plaintiff requesting him to reach the office of the Sub<\/p>\n
         Registrar for getting the sale deed executed and<\/p>\n
         registered for an amount of Rs.2,50,000\/- as per terms of<\/p>\n
         the agreement. On 1.9.1986 he went to the office of the<\/p>\n
         Sub Registrar, but the plaintiff did not turn up. 31.8.1986<\/p>\n
         was a holiday, therefore, defendant went to the office of<\/p>\n
         the Sub Registrar on 1.9.1986. The defendant waited for<\/p>\n
         the plaintiff till evening. So much so, defendant made an<\/p>\n
         application in the office of the Sub Registrar, Dera Bassi<\/p>\n
         for marking his presence. The presence of the defendant<\/p>\n
         was marked.     Aftter marking his presence, application<\/p>\n
         was returned to the defendant. Plaintiff never cared to<\/p>\n
         get copy of the jamabandi from the Patwari and plaintiff<\/p>\n
         did not serve any notice upon the defendant nor sent any<\/p>\n
         draft of the proposed sale deed. Defendant was never<\/p>\n
         called upon by the plaintiff to execute the sale deed. The<\/p>\n
         plaintiff did not have requisite fund for stamps and money<\/p>\n
         for registration fee.    He committed breach of the<\/p>\n
         agreement. Plaintiff was not ready and willing to perform<\/p>\n
         his part of the contract and under these circumstances,<\/p>\n
         his earnest money stood forfeited. Time was the essence
\n R.S.A.No. 191 of 1996                                              4<\/span><\/p>\n
            of the contract and it was known to the plaintiff. Plaintiff<\/p>\n
            failed to perform his part of the contract.       He is not<\/p>\n
            entitled to pay decree for specific performance. Plaintiff<\/p>\n
            has got forfeited his money.         Defendant has suffered<\/p>\n
            damages.       Defendant wanted to purchase some land.<\/p>\n
            Price of the land which he wanted to purchase from<\/p>\n
            Shamsher Singh son of Kaka Singh had increased and<\/p>\n
            defendant incurred a loss of Rs.60,000\/- due to non-<\/p>\n
            performance of the agreement by the plaintiff.”<\/p><\/blockquote>\n
           On the pleadings of the parties, following issues were<\/p>\n
framed by the trial Court:-\n<\/p>\n
            “1.           Whether defendant has committed the breach<\/p>\n
            of the agreement dated 28.2.1986? OPP<\/p>\n<\/blockquote>\n
            2.            Whether the plaintiff has always remained<\/p>\n
            ready and willing to perform his part of the contract? OPP<\/p>\n<\/blockquote>\n
            3.            Whether the time was the essence of the<\/p>\n
            contract? If so its effect? OPD<\/p>\n<\/blockquote>\n
            4.            If issue No.1 and 2 are proved, whether the<\/p>\n
            plaintiff is entitled to the relief of specific performance of<\/p>\n
            the contract of sale? If so on what terms? OPP<\/p>\n<\/blockquote>\n
            5.            Whether     in the alternative the plaintiff is<\/p>\n
                 entitled to claim Rs.2,50,000\/- as alleged? OPP<\/p>\n<\/blockquote>\n
            6.            Whether the suit is barred by delay and<\/p>\n
                 laches? If so its effect? OPD

            7.          Relief. “<\/p><\/blockquote>\n
            The substantial question of law that arises in this case<\/p>\n
is ” whether both the Courts below had failed to appreciate the<\/p>\n
evidence on record and the finding of the Courts below to the effect<\/p>\n
that the plaintiff was always ready and willing to perform his part of<\/p>\n
the contract was perverse?”\n<\/p>\n
            Learned counsel for the appellant has submitted that the<\/p>\n
Courts below had erred in decreeing the suit of the plaintiff for<\/p>\n
specific performance as he had failed to establish that he was ready<\/p>\n
and willing to perform his part of the contract.<\/p>\n
            Learned counsel for the respondent, on the other hand,<\/p>\n
has argued that both the Courts below, after appreciating the<\/p>\n
evidence on record, had rightly come to the conclusion that the<\/p>\n
plaintiff was ready and willing to perform his part of the contract as<\/p>\n
time was not the essence of the contract. The suit had been filed by<\/p>\n
the plaintiff    within the period of limitation     seeking    specific<\/p>\n
performance of the agreement to sell.\n<\/p>\n
            The execution of the agreement to sell in question is not<\/p>\n
in dispute in this case. The case of the appellant rather is that the<\/p>\n
plaintiff was not ready and willing to perform his part of the contract,<\/p>\n
whereas, he had remained present in the office of Sub Registrar on<\/p>\n
the stipulated date fixed for execution of the sale deed but the<\/p>\n
plaintiff had failed to appear. Hence, the controversy involved in this<\/p>\n
appeal is narrowed down to the extent as to whether the plaintiff was
\n R.S.A.No. 191 of 1996                                           6<\/span><\/p>\n
ready and willing to perform his part of the contract. In this regard<\/p>\n
material evidence on record has been ignored by the Courts below.<\/p>\n
Ex.D-4 is the relevant document in this regard vide which the<\/p>\n
appellant had got marked his presence in the office of Sub Registrar<\/p>\n
on 1.9.1986 as 31.8.1986, the date fixed for execution of the sale<\/p>\n
deed was Sunday.       This shows that the appellant was ready to<\/p>\n
execute the sale deed in favour of the plaintiff. However, the plaintiff<\/p>\n
has failed to establish that on the date fixed for execution of the sale<\/p>\n
deed, he was present in the office of Sub Registrar.        Hence, the<\/p>\n
findings of the Courts below that the plaintiff was always ready and<\/p>\n
willing to perform his part of the contract are perverse and against<\/p>\n
the evidence on record.\n<\/p>\n
           Accordingly, the substantial question of law that arises in<\/p>\n
this appeal stands answered in affirmative.\n<\/p>\n
           Consequently, this appeal is allowed.       The suit of the<\/p>\n
plaintiff for specific performance of the agreement to sell in question<\/p>\n
is dismissed. However, the suit of the plaintiff in the alternative for<\/p>\n
recovery of the earnest money of Rs.2,50,000\/- is decreed. No order<\/p>\n
as to costs.<\/p>\n
