He further submits that<br \/>\nthere is a provision in Criminal Procedure Code that during<br \/>\nproduction of evidence before the learned Judge if there may be some<br \/>\noffence in connection with the offence under Sections 406, 409 etc.<br \/>\nof Indian Penal Code then the complainant has right to make a request<br \/>\nbefore the learned Judge to frame charge against the applicant. He<br \/>\nfurther submits that when the complaint for the offence under Section<br \/>\n138 of Negotiable Instruments Act is pending before the learned Chief<br \/>\nJudicial Magistrate in connection with same offence, second complaint<br \/>\ncannot be filed for that offence and therefore the same is required<br \/>\nto be quashed. Learned advocate for the applicant placed reliance on<br \/>\nthe decision in the case of G.Sagar Suri &amp; Anr. V\/s State of U.P.<br \/>\nand others reported in (2000)2 SCC 636.\n<\/p>\n<p>\t\tLearned<br \/>\nadvocate Mr.Sevak appearing for the respondent no.2-bank submits that<br \/>\nit is shown in the charge sheet that the complaint is forged by the<br \/>\npresent applicant and therefore prima facie offences under Sections<br \/>\n406, 420 etc. of Indian Penal Code are made out and that the present<br \/>\napplicant is shown as absconding.\n<\/p>\n<p>\t\tIn<br \/>\nthe case of G.Sagar Suri (supra), the Honourable Supreme Court has<br \/>\nobserved as under:\n<\/p>\n<p>&#8220;A<br \/>\ncriminal complaint under Section 138 of the Negotiable Instruments<br \/>\nAct is already pending against the appellants and other accused. They<br \/>\nwould suffer the consequences if offence under Section 138 is proved<br \/>\nagainst them. In any case there is no occasion for the complainant to<br \/>\nprosecute the appellants under sections 406\/420 IPC and in his doing<br \/>\nso it is clearly an abuse of the process of law and prosecution<br \/>\nagainst the appellants for those offences is liable to be quashed.<br \/>\nAccordingly, the judgment of the High Court is set aside and<br \/>\nprosecution of the appellants under Section 406\/420 IPC is quashed.&#8221;\n<\/p>\n<p>\t\tConsidering<br \/>\nthe judgment referred hereinabove and the facts as well as<br \/>\nsubmissions made by the learned advocates for the respective parties,<br \/>\nthis application is allowed.
