Heard learned counsel for the parties.<\/p>\n<p>                               The         petitioner&#8217;s           husband,       while<\/p>\n<p>                    functioning       as    Junior     Selection       Correspondence<\/p>\n<p>                    Clerk     in     the    office     of     Executive      Engineer,<\/p>\n<p>                    Planning       and     Monitoring       Division     No.6,   Water<\/p>\n<p>                    Resources Department, Patna died on 10.10.1992.<\/p>\n<p>                    After     the     death    of    her      husband,     petitioner<\/p>\n<p>                    started    to     get     family    pension.        Subsequently,<\/p>\n<p>                    Second Time Bound Promotion was granted to her<\/p>\n<p>                    husband with retrospective effect and thereafter,<\/p>\n<p>                    authorization for pension and gratuity was made<\/p>\n<p>                    vide Annexures 4 and 5 to the writ petition by<\/p>\n<p>                    the Accountant General.\n<\/p>\n<p>                               Learned        counsel       for    the     petitioner<\/p>\n<p>                    submits that instead of sending authorization for<\/p>\n<p>                    pension and gratuity to                 the Treasury Officer,<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Patna Secretariat, it was addressed to Treasury<\/p>\n<p>Officer, Patna and as such petitioner could not<\/p>\n<p>get payment in view of Annexures 4 and 5.<\/p>\n<p>             On    instruction,        Shri     S.M.     Ehtesham,<\/p>\n<p>learned      counsel     for     the    respondent\/Accountant<\/p>\n<p>General submits that steps are being taken and<\/p>\n<p>same will be corrected very soon.<\/p>\n<pre>          In      view   of     the    stand    taken    by     Shri\n\nEhtesham,           learned           counsel          for       the\n\n<\/pre>\n<p>respondent\/Accountant General, the court expects<\/p>\n<p>that correction in authorization of pension and<\/p>\n<p>gratuity relating to Annexures 4 and 5 shall be<\/p>\n<p>done within a period of ten days from today.<\/p>\n<p>Thereafter, court expects that payment will be<\/p>\n<p>made without any delay.\n<\/p>\n<p>          The     petitioner      has    further       prayed    for<\/p>\n<p>directing the respondents to revise her family<\/p>\n<p>pension in view of Government Resolution No.820<\/p>\n<p>dated     23.9.2009        (Annexure-7          to      the     writ<\/p>\n<p>petition). Shri Siya Ram Shahi, learned counsel<\/p>\n<p>for the petitioner has specifically placed para<\/p>\n<p>2(v)    of        the    Government        resolution         dated<\/p>\n<p>23.9.2009.\n<\/p>\n<p>          After going through the said provision,<\/p>\n<p>the court is of the view that the respondents can<\/p>\n<p>be   directed      to    take   immediate       step    to    revise<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>        family pension in the light of Annexure-7 to the<\/p>\n<p>        writ petition.\n<\/p>\n<p>                    Accordingly,                the            respondents,<\/p>\n<p>        particularly respondent no.3\/The Chief Engineer,<\/p>\n<p>        Planning       and        Monitoring,          Water     Resources<\/p>\n<p>        Department, Patna is directed to take all steps<\/p>\n<p>        for    issuance      of     authorization        after    revising<\/p>\n<p>        family pension of the petitioner within a period<\/p>\n<p>        of two months from the date of receipt\/production<\/p>\n<p>        of      a      copy          of         this      order.
