On: - 04\/11\/2009                       Delivered On: - 6\/11\/2009\n                                             ...\n5\/ 6.11.2009<\/pre>\n<p>                  Petitioner, in this writ application, has prayed for the following<br \/>\n              reliefs: &#8211;\n<\/p>\n<blockquote><p>                                                    (a)     For issuance of a writ of certiorari<br \/>\n                                                    for quashing the district order No. 1418<br \/>\n                                                    dated-17.11.2000, issued pursuant to the<br \/>\n                                                    order dated-09.11.2000, by the Director<br \/>\n                                                    General of Police, Bihar.<\/p><\/blockquote>\n<pre>\n                                                    (b)     For issuance of a writ in the nature of\n                                                    mandamus        commanding        upon     the\n<\/pre>\n<blockquote><p>                                                    Respondents to promote the petitioner to the<br \/>\n                                                    post of Steno\/Typist A.S.I.\n<\/p><\/blockquote>\n<blockquote><p>                                                    (c)     For a direction to the Respondents to<br \/>\n                                                    pay the petitioner his salary for the post of<br \/>\n                                                    Steno\/Typist A.S.I. on which, he has been<br \/>\n                                                    officiating since, 1997.\n<\/p><\/blockquote>\n<p>              2.             Counter affidavit has been filed on behalf of the Respondents.\n<\/p>\n<p>              3.             Heard the learned counsel for the petitioner and learned counsel for<br \/>\n              the Respondents.\n<\/p>\n<p>              4.             Facts of the petitioner&#8217;s case are as follows: &#8211;\n<\/p>\n<blockquote><p>                                                            The petitioner was appointed as a<br \/>\n                                                    Constable in the year 1988 in the State<br \/>\n                                                    Police Service and after his completing the<br \/>\n                                                    requisite Training, he was posted in the<br \/>\n                                                    Office of the Superintendent of Police,<br \/>\n                                                    Palamau, where he was allotted the work of<br \/>\n                                                    Steno\/Typist.<\/p><\/blockquote>\n<p>                                                            His superiors in Office, including the<br \/>\n                                                    Deputy Inspector General of Police and the<br \/>\n                                                    Inspector General of Police, recommended<br \/>\n [2]<br \/>\n                           [W.P. (S) No. 6900 of 2005]<\/p>\n<p>      his name vide Annexure-1 series, to post<br \/>\n      him as a Typist-cum-Steno A.S.I.\n<\/p>\n<pre>               On               considering           the\n      recommendations,             the   petitioner   was\n<\/pre>\n<p>      promoted to the post of Steno\/Typist A.S.I.<br \/>\n      on ad hoc basis initially for a period of four<br \/>\n      months       and     a     recommendation       was<br \/>\n      forwarded to the Headquarters, Bihar for his<br \/>\n      regular promotion by the Deputy Inspector<br \/>\n      General of Police.\n<\/p>\n<p>               Instead of regularizing his services<br \/>\n      on the aforesaid post, by the orders of the<br \/>\n      Superintendent of Police of the District<br \/>\n      where the petitioner was employed, the<br \/>\n      petitioner was reverted to the post of<br \/>\n      Constable and posted in the District Police<br \/>\n      in the Department.\n<\/p>\n<p>               However,         subsequently,    by   the<br \/>\n      orders of the Inspector General of Police, the<br \/>\n      petitioner     was       again granted     ad   hoc<br \/>\n      promotion on 24.10.2000 to the post of<br \/>\n      Steno\/Typist, A.S.I.\n<\/p>\n<p>               Thereafter, at the time of bifurcation<br \/>\n      of the State of Bihar, the Deputy Inspector<br \/>\n      General of Police, Headquarters, Bihar,<br \/>\n      issued an order on 09.11.2000 for reverting<br \/>\n      the petitioner to the post of Constable and<br \/>\n      this   order       was     implemented     by   the<br \/>\n      impugned             order         dated-17.11.2000<br \/>\n      (Annexure-4).\n<\/p>\n<p>               The petitioner claims that against the<br \/>\n      aforesaid order, he had submitted several<br \/>\n      representations, but the same were not<br \/>\n      considered.\n<\/p>\n<p>               The petitioner&#8217;s grievance is that he<br \/>\n      had admittedly, officiated in the higher post<br \/>\n      of Steno\/Typist A.S.I. for a considerable<br \/>\n      period continuously and was therefore,<br \/>\n      entitled to be promoted to the aforesaid post.\n<\/p>\n<p>                              [3]<br \/>\n                                                         [W.P. (S) No. 6900 of 2005]<\/p>\n<p>                                      His further grievance is that though he was<br \/>\n                                      made to officiate and work on the higher<br \/>\n                                      post of Steno\/Typist, A.S.I. but he was never<br \/>\n                                      paid the salary applicable to the aforesaid<br \/>\n                                      post nor was he given any officiating pay at<br \/>\n                                      all, although he has been working on the<br \/>\n                                      post since 1997 and he is still working on<br \/>\n                                      the aforesaid post.\n<\/p>\n<p>                                             The petitioner&#8217;s further grievance is<br \/>\n                                      that another co-employee, namely, one<br \/>\n                                      Ramnath Pandey, who was also inducted in<br \/>\n                                      service initially as a Constable and was<br \/>\n                                      granted ad hoc promotion to the post of<br \/>\n                                      Steno\/Typist A.S.I., his services have since<br \/>\n                                      been regularized on the higher post, whereas<br \/>\n                                      the petitioner has been arbitrarily reverted to<br \/>\n                                      the post of Constable instead of regularizing<br \/>\n                                      him on the post.\n<\/p>\n<p>5.             Per contra, learned counsel for the Respondents would submit that<br \/>\nthe substantive post to which the petitioner was appointed is that of the Constable,<br \/>\nand since he knew Typing, his services for typing work was also taken, as per<br \/>\nrequirement, from time to time. Learned counsel argues that merely because his<br \/>\nservices have been engaged as a Typist, the petitioner cannot claim promotion to<br \/>\nthe rank of Steno\/Typist A.S.I., since the procedure as laid down for promotion,<br \/>\nstipulates that such promotions should be considered only in accordance with<br \/>\nseniority and that too after the candidate concerned is declared passed in the<br \/>\ndepartmental examination conducted by the Police Headquarters and declared by<br \/>\nthe D.G. Board.\n<\/p>\n<p>                      Learned counsel contends further that the Range D.I.G. has<br \/>\nno authority to promote or to appoint any officer on the post of A.S.I. and as per<br \/>\nthe procedure laid down in Appendix 41 of the Police Manual. Such appointments<br \/>\non promotion are to be done only after conducting the examinations by the Board.<br \/>\nOn the aforesaid basis, learned counsel would want to justify the order of the<br \/>\nrevocation of the petitioner&#8217;s ad hoc promotion.\n<\/p>\n<p>6.             The facts which emerge from the rival submissions are that the<br \/>\npetitioner was appointed as a literate Constable and he was called upon to<br \/>\nofficiate on the post of Steno\/Typist A.S.I. Such engagement of the petitioner on<br \/>\nthe higher post was admittedly taken ever since, 1997 by way of ad hoc<br \/>\n                                [4]<br \/>\n                                                        [W.P. (S) No. 6900 of 2005]<\/p>\n<p>promotion for limited periods and such periods were extended from time to time<br \/>\nby fresh Notifications.\n<\/p>\n<p>7.                It appears therefore, that the petitioner&#8217;s claim for his<br \/>\npromotion\/regularization in service on the post of Steno\/Typist, A.S.I. is on the<br \/>\nonly ground that his efficiency was tested by his concerned superiors in office and<br \/>\nthey being satisfied, have engaged him, almost continuously, to officiate in the<br \/>\naforesaid post.\n<\/p>\n<p>8.                Admittedly, the Rules referred to by the learned counsel for the<br \/>\nRespondents under Appendix 41 of the Police Manual and under Rules 660 and<br \/>\n660 A of the Police Manual lay down the procedure for appointment\/promotion.<br \/>\nThe petitioner has neither appeared in any such departmental examinations nor<br \/>\nhas he been declared by the Board as qualified for his promotion.\n<\/p>\n<p>9.                The fact that the petitioner was given ad hoc promotions from time<br \/>\nto time would only signify that he was given to officiate in the higher post though<br \/>\nretaining his lien on the substantial post of Constable. Since the grant of<br \/>\npromotion of the petitioner has to be guided by the specific Rules, the<br \/>\nRespondents cannot possibly be directed to ignore the Rules and proceed to<br \/>\npromote the petitioner on the higher post, merely on the basis of his claim of<br \/>\nefficiency and long officiation.\n<\/p>\n<p>10.               I am conscious of the fact that the petitioner has been made to<br \/>\nofficiate on the higher post continuously for a long period. This would only entitle<br \/>\nthe petitioner to claim for consideration of his case for his promotion to the higher<br \/>\npost but nevertheless, subject to his qualifying of the requisite Tests. He would be<br \/>\nentitled to be called upon to appear at the requisite Tests by the Board to qualify<br \/>\nand prove his competence. The petitioner would however, be entitled to the<br \/>\nofficiating pay for the period, he was made to officiate in the higher post.\n<\/p>\n<p>11.               In the light of the above facts and circumstances, I direct the<br \/>\nRespondents as follows: &#8211;\n<\/p>\n<blockquote><p>                                        (i)    The Respondents shall conduct the<br \/>\n                                        requisite departmental examination to enable<br \/>\n                                        the petitioner to appear at the same,<br \/>\n                                        preferably within a period of six months<br \/>\n                                        from the date of this order and upon the<br \/>\n                                        petitioner qualifying at the prescribed Test,<br \/>\n                                        shall take appropriate decision regarding the<br \/>\n                                        petitioner&#8217;s promotion to the higher post.\n<\/p><\/blockquote>\n<blockquote><p>                                        (ii)    The Respondents shall pay the<br \/>\n                                        officiating pay to the petitioner for the<br \/>\n                                        period his services are engaged in officiating<br \/>\n                                   [5]<br \/>\n                                                            [W.P. (S) No. 6900 of 2005]<\/p>\n<p>                                           capacity in the higher post of Steno\/Typist,<br \/>\n                                           A.S.I. Such payment shall be paid on and<br \/>\n                                           from the date, such services were obtained<br \/>\n                                           in the higher post.\n<\/p><\/blockquote>\n<blockquote><p>      12.            With these observations, this writ application stands disposed of.\n<\/p><\/blockquote>\n<blockquote><p>      13.            Let a copy of this order be given to the learned counsel for the<br \/>\n      Respondents.<\/p><\/blockquote>\n<p>                                                                  (D.G.R.
