SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioners have prayed for an appropriate writ, order or<br \/>\ndirection quashing and setting aside the impugned judgement and award<br \/>\ndated 10\/12\/2009 passed by Labour Court, Bhavnagar in Reference (LCB)<br \/>\nNo. 151\/2005, by which the Labour Court has partly allowed the said<br \/>\nReference by directing the petitioners to reinstate the respondent<br \/>\nwith 20% backwages and with continuity in-service.\n<\/p>\n<p>2.\tAfter<br \/>\nthe matter was argued by learned advocates appearing on behalf of the<br \/>\nrespective parties and considering the fact that the<br \/>\nrespondent-workman was serving as Daily Wager and considering the<br \/>\nfact that the dispute was raised after a period of four years and<br \/>\nconsidering the recent decision of the Hon&#8217;ble Supreme Court rendered<br \/>\nin the case of Senior Superintendent Telegraph (Traffic), Bhopal,<br \/>\nVs.  Santosh Kumar Seal and others, reported in (2010) 6 SCC<br \/>\n773, there is a broad consensus between the learned advocates<br \/>\nappearing on behalf of the respective parties that the impugned<br \/>\njudgement and award dated 10\/12\/2009 passed by the Labour Court,<br \/>\nBhavnagar be modified to the extent that in lieu of reinstatement and<br \/>\nbackwages, the respondent can be paid lumpsum compensation of<br \/>\nRs.50,000\/-, they do not invite any further reasoned order.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above broad consensus between the learned advocates<br \/>\nappearing on behalf of the respective parties and even otherwise<br \/>\nconsidering the facts and circumstances of the case as narrated<br \/>\nhereinabove that the respondent was working as daily wager only and<br \/>\nhe raised the industrial dispute after a period of four years and<br \/>\nconsidering the recent decision of the Hon&#8217;ble Supreme Court in the<br \/>\ncase of Santosh Kumar Seal and others (supra), the impugned<br \/>\njudgement and award dated 10\/12\/2009 passed by Labour Court,<br \/>\nBhavnagar in Reference (LCB) No. 151\/2005 is hereby modified to the<br \/>\nextent that in lieu of reinstatement and 20% backwages with<br \/>\ncontinuity in service, the respondent shall be paid lumpsum<br \/>\ncompensation, which is quantified at Rs.50,000\/-, to be paid by the<br \/>\npetitioners to the respondent- workman by Account Payee Cheque within<br \/>\na period of three months from today. Rule is made absolute to the<br \/>\naforesaid extent.
